  1. So it seems it is finally over (for now). We filed for AOS back in December 2006 and after a financial RFE and receiving our EAD, the case was transferred to the CSC (good thing you guys know the abbreviations or I'd feel I was speaking in tongues).

    It ended up sitting there for awhile and we were patient enough now that he was able to work, until we got another RFE to update his medical info because it was now a year old. Boo. We ended up spending about $250 because that was the cheapest civil surgeon price we could find in our area, and frankly we just wanted to get it done and over with. The doctor he saw (Dr. Murray Moliken, Cherry Hill NJ) was fantastic and very straightforward with everything he did, as well as told my hubby the results of whatever tests he needed to do. Anyway, he was happy with him and they took care of everything we needed done - good enough.

    I sent back the RFE and a little over a week later, our case had been reopened and approved. Card production ordered and welcome letter sent.

    Nearly 9 months (12/11-9/6) from our starting point, the greencard is on its way. This forum helped a ton (it was quite literally my only source of information aside from the USCIS site) and also helped me to persuade my hubby from getting a pricey lawyer to assist us. If your case is as cut and dry as ours was, I see no reason to seek expensive legal assistance. Just keep copies of everything, stay organized and check your online status like it's your job. We were one of the lucky ones I guess to get through without an interview, but even if we had had one I don't see how it ever would have been a problem.

    (My friend just got engaged to and Englishman and I certainly feel for her and all of the others who now have to pay the exhorbatant fees. Yeesh!)

    "You are ineligible for interim employment authorization persuant to Title (blah blah some numbers) until 90 days after the missing initial evidence is recieved.

    So does that mean that I can't work now for even longer??

    we got that, too. however, our employment papers ended up getting processed and approved almost immediately after the RFE was back in their hands. don't fret too much, it's what they pretty much have to tell you to keep you off their backs about it for awhile. you might very well just have our luck ;)

  3. You would not put N/A on the line, you would put -0- on the line, and include a note explaining why you were exempt from filing a return.

    Better yet, why not wait to file the AOS until after you file your 2006 return, or get a co sponsor?

    well, our K-1 expires on january 2, 2007 so we want to apply before then and i really don't need a co sponsor (even if i got one, the initial inquiry would still stand). i'm putting "0"on the line for 2005 and adding an explanation (like you had suggested) and hoping that should cover it.

  4. here's a question. i am hoping to fill out the I-864EZ, as i make enough money to sponsor my husband and myself - a household size of 2. however, i lived outside of the US for the entire year of 2005 while i went to school full-time and don't have a tax return for that year. considering 2005 is the 'most recent tax year' to be put on the form, i don't know what to do.

    i have the tax returns from 2004 and 2003, 6 full months of up-to-date pay stubs from my current job, and a new handsigned letter from my boss on official letterhead stating my positon, full-time status, and salary.

    would i just put "n/a" for most recent tax year and a dollar amount of $0.00, or start with 2004 and include a statement about my overseas student status? i even have some letters and my degree to prove i was there.

    any thoughts? would i get away with the EZ form?

    Our re-approval was a week after yours. We are now waiting for Packet 4 from the London Embassy. Have you received your packet, and if not, how do you know of your Interview Date?

    we've not physically received Packet 4 yet, but my fiance emailed the embassy with a change of address notification and they responded with the following:

    "Thank you for the information you have furnished. An interview appointment has been scheduled on your behalf for September 8, 2006 at 10:00 am. Written notification of your appointment has been sent to your new address, as requested.

    Thank you for your e-mail correspondence.

    Consular Information Unit

    U.S. Embassy London"

    i'll take that as a big hint as to what information our Packet 4 contains. :)

  6. my fiance phoned the london embassy today to change his address (he's moving in with his sister for the last month or so) and they told him that they have everything and are just waiting until his turn comes up to schedule an interview. it sounded great to me, but i phoned the NVC just to check and the woman told me that they sent the petition out on the 10th! excellent, and back on track! i'm just happy that this whole thing only added a few weeks to our process instead of the dreaded months and months. here's hoping we get an interview soon! :dance:

  7. i called both the VSC and NVC today about how they are forwarding the petitions to the embassies. a woman at VSC told me that nothing in the process will change and that all the applications will be sent through the NVC (it could take up to 30 days, of course! big effin' surprise at that answer).

    i then called the NVC and a woman there told me that they were just a sort of holding station for the petitions and had no idea what would happen and to call 'immigration'. i asked her if by 'immigration', she meant the VSC. she answered yes. she also had no record of my petition being there at the moment.

    so i got nowhere with those uninformed toolbags. i guess i'll just have to wait and have my fiance ring the embassy (at something like £1.50/minute) to see if the petition arrives there anytime soon...

    EDIT - i just read another thread that seems to confrim everything being sent through the NVC. i haven't been online much in the past week, so i totally missed it. disregard this comment! ;)

    that's that. not the same message as you got, but still clear as day (in my opinion) that it is indeed approved. weird though, i agree.

    Woah! VSC is sending different messages! I'd have expected CSC to send different notices, but not VSC. Oh, well.

    Hey, could you call NVC and VSC next week and see what answer they give you as to who will be sending the petition back to the consulate? So we'd add one more set of answers to the ones we've collected...

    i was already planning on it :thumbs: do you happen to have the two numbers handy? i'll probably give them a day or so leeway and call tuesday.

  9. Of all the approvals so far in VSC and CSC, did you guys use marriage brokers, have been arrested(expunged?), or filed a waiver for multiple petitions filed? I see a lot of people saying that the dating websites aren't considered marriage brokers, are these websites free or do you have to pay?

    i just got (re)approved today - no marriage broker, no criminal history, and no multiple petitions. clean sheet, me.

    We've gotten more answers saying they're sending directly from the services centers. I think I was the only one who got a "I have no idea, but your petition is not here".

    It´s not only that.

    The reapproval-update itself says it will be fwd to DoS.

    VSC officers are saying the opposite.

    Who knows what happens next.

    I just know I wanna have this problem. Wait for the RFE to beapproved is the worst.

    I need something else to think about.

  12. Ok, so Mew's petition took 14 days to process (the minimum stated on the RFE). If Vermont holds true to it's previous efficiency, we should start seeing a bunch of recalled approvals soon.

    man, i hope so. maybe the summer isn't shot after all. ending on a high note would be nice, eh?

  13. I think if you have the hard copy approval notice in your hand, it HAS to be an approval, right? The fact that they didn't update the website or send an email doesn't mean a whole lot since they don't always do that anyway. So CONGRATULATIONS!!!

    yep - not sure what all of the doubt is about 'round these parts. maybe we're all just so disheartened with everything lately. i see this as a nice light towards the end of the tunnel. congrats, indeed! :D

  14. I am really, really, REALLY hoping that the "30 days until case adjucated" email that was sent to my senator (Evan Bayh) was correct. That would keep Sian and I on our planned schedule, mostly. We really want an autumn (October 15th was the tenative date) wedding. If we receive our NOA2 within 30 days, then it might still be possible.

    Here's hoping that CSC approves a whole assload of I-129Fs very soon.

    ha! Yes, me too! I heard that 30 day deal from my senator as well.

    But October is still pushing it, it takes about 3 months to interview once NVC gets it for UK, if you check past interviews....

    daaaamn, that's a long time. is that from the embassy receiving the initial file and sending out packet 3? our case was recalled after we sent back our checklist AND on the day my fiance was in london for his medical. do you think it might still be a 3-month wait once the petition is reapproved and returned? (not expecting you to know, of course - just wondering on an opinion ;) )
