  1. Hi everybody,

    I received a RFE regarding good faith marriage, insufficient evidence :(.  I have been collecting documents for the past two weeks. I think I have like 100 pages for them and I am ready to mail it. 

    On the last page they are asking about G-28 form. I have never used a lawyer. Shall I leave it blank or select "No, there is not a new G-28 form"

  2. Hi, I have a question. I am collecting my documents.

    I am going to submit the most recent join tax return transcripts from IRS. In my RFE it says:

    "federal and state tax return including relevant schedules and attachments such as W-2 records with evidence of filling with the appropriate authority" For my first green card application, I submitted just IRS documents, do I need to submit W-2 forms and whatever else they are asking? I don't understand what does "evidence of filling with the appropriate authority mean.

     

    Also, what is G-28 card?

  3. I have already submitted our car insurance and health insurance documents when I was sending the documents a year ago. RFE says that the insurnace documents are correct and no need to resubmit unless there are some changes. Thus I was trying to focus on other documents . RFE also said to support our plane tickets and picture from trips with passport stamps and I will do so. We have traveled oversees a few months ago and I will include pics and stamps.

    Do you think 12 months of bank statements and bills will be good enough?

    Pick from the list what you may have.
    Besides a lease (or letter from the landlord you mentioned) you need joint financial accounts, at the very least one joint account
    with statements going back to when you married.
     

     

     

        Examples of documents showing a bona fide relationship (Submit COPIES only. Do not send originals):

    1. A deed, showing co-ownership of your property or a lease agreement with both of your names on the
    lease.
    2. Utility bills, credit card bills, and other types of bills which have both of your names on them. Since many utilities will only put a bill in one person's name, some bills in one name and other bills at the same address but in the other spouse's name serve the same purpose: showing your financial & social lives intermingled.
    3. Copies of actual credit cards, health insurance cards, or other "joint" cards that you have together,
    showing same account number.
    4. Car, health, or life insurance that has both of your names on the policy or the other spouse listed as the
    beneficiary.
    5. 401K or other retirement plan with spouse listed as beneficiary (right to survivorship is the technical term)
    6. Bank or stock accounts with both of your names on them.
    7. A copy of your joint federal and state tax returns (including W-2's and other applicable Schedules and attachments). Sending an official tax transcript from the IRS (for Federal) is beneficial and often preferred as it reflects what was actually filed.
    8. A car title or other titles to property showing joint ownership with your spouse.
    9. Birth certificate of any children that have been born to your marriage.
    10. Documentation of any vacations that you have taken, including flight itineraries, hotel bills, pictures of you
    together on vacation.
    11. Other family pictures of you together.
    12. Documentary proof showing evidence of your children together (Copy of Birth Certificate, photos, etc)

    Thank you. I printed out our bank sttatments and bills for the past 12 months. We have been married 3,5 years. Thiis is what I have for now:  dental insurance showing both names, life insurance showing both names, 2 x 3rd party affidavit, note from the landloard that we have been living this place for the past 3,5 years and we are the only renters, copy of our ID showing the same address,  joint bank account (12 months of statments), joint tax return for the past three years, SDGE bill showing both names 12 mnth, phone bill 12 months, copies of stamps in passport showing 3 international trips together, plane ticket for the future international trip. Please let me know if this sounds sufficient. 

     

  5. Thank you! Yes, I meant 10 years not 5. I will go through my documents and let you guys know what I have included. As I remember, I provided the tax returns, medical and car insurance, plane tickets, pictures and phone bill.  

     

    I will set an appt to get a stamp today.

     

    Does the third party affidavit have a lot of value? It says this can be included on my RFE. They are asking for lease document or Id document showing that we live under same roof. 

  6. Hi everybody, 

    In February 2017 I applied for my green card renewal from 2 year to 5 year, green card through marriage. Tomorrow, After 1 year and 3 months I received RFE in the mail. I freaked out! In July we have a trip scheduled and I am scared that I May not go. My questions are:

    1. They are questioning if the marriage is bona fide. I guess because I didn’t include any lease documents ( only bills). I don’t have a lease as we are month to month. I asked my landlords to issue us some document stating that we are both the renters. Hope this would help. 

    3 what is the stronger evidence that the marriage is real? 

    3. Would I have trouble in getting a stamp when being on RFE and traveling with it? My one year letter has expired a few days ago:(

    I have a question concering the form G 325A and information about work and places I lived. I wrote that I lived one place from 06 2012 till 08.2012 and then next place from 08.2012 till 04.2013. I usually was changing place in the middle of the month so thats why the dates kinda overlap. Is this ok ? Or shall I write from 06 2012 till 08 2012 and then from 09 2012?

  9. Ive just found some inf on the internet that the new number is given every time you reenter the us. So i guess a new no was given to me as I came back from my vacation. So everywhere they ask me, I put the new number. However, I do not know what I should write on the form I-130 under no 14- Arrival/ departure record?

    old number which is in my passport or the new one?

    please help!

  10. Asking your LLC is the last thing I would do. They dont know exactly how j1 works (at least mine) plus they dont like when au pairs get married and i know cases when au pairs were kicked out of the program after reavling the marriage plan. So I dont want to be this person lol

    Ya, just I am not sure if I can write about something ahead of time- that i will be unemployed from 9th of Decmber and i will send my papers before this time...

  11. Hi, so Im working on g325a form. I am an au pair and Im finishing the program on the 9 of december ( according to the ds form). However, im leaving my work on 26th of November as i am using my vacation days.

    Im sending my asos package when I am teoretically on the program ( first week of december, so lets say still employed as a nanny) but pratically im done- i will be moved to my fiencee house and without work.

    Shall i write that im unemployed from 26th till present (but my papers say till 9th decmber) or employed as au pair till 9th?

    If i need to write i am employed till 9 th of decmber, can i write im that unemployed from 9th dec till present even tho i will send my package e.g. 1st? ( so what I mean, I write about the future)

    2. Do they check taxes from abroad? I worked as a private tutor for kids when I was in college and I was making some small money for college girl expenses. But i did not register this as a my business and pay taxes from it either.

    Hope you guys understand my point.

    In my home country , when i was a full time student, I worked as an English tutor and I was making some small money which could pay may small expenses when being in college. However, i did not pay taxes for it ( not sure if it even reached the taxtable income point). Shall I write I was self employed ( tutor) or just sate unemployed? Do they check taxes outside the US?

    Also, not sure what to write under question about your current status. At the time of sendung, I will have been on my 30 grace period. Shakk I write; Current status- j1 30 days grace period?
