  1. Hello,

    So, I had to get my congressman, Lamar Smith, involved in my case after so many delays. We filed at the first of April. After three transfer notifications and a RFE for the 130 (when I filed the 129f) and documents that I already sent, my approval came Oct. 6. The case never showed up at NVC. I called daily for weeks. I sent scanned copies of the approval notice to the NVC research center and contacted USCIS multiple times. Finally, my congressman's aide was able to get information this week. It seems that a newly hired agent at USCIS mailed a bunch of approved cases to the wrong place. More files than mine were affected. They have now sent them to NVC, but as of this morning they had not arrived.

    I'm writing this in case there is another couple approved in early October that can't figure out what happened. My congressman's aide is following up with NVC next week, and upon arrival she is requesting that the case be expedited in both NVC and in London. I don't know if that will work or not, but it is worth a shot. She says these things happen too often. If your case is delayed like mine - contact your congressman's office ASAP and request the expedite. Sorry for all the woes some of us are going through.

  2. Hi guys, Help me with a question...

    I haven't been on here a while because I've been depressed about this. We were approved Oct. 6 by USCIS. I have called NVC every day for a month and a half and they still don't have my file/approval notice. I have emailed it to their research dept twice...I have called and emailed USCIS multiple times. Last week a woman there told me she thinks several early October files were lost. I have even contacted my congressman, but the file has never shown up. So we don't have an N# from NVC. My fiance has everything ready to go - except the medical exam.

    We haven't seen each other since August. He wants to come over here now - before the visa interview in London. Is this a good idea? He wants to come Dec. 28-Jan. 25 since it looks like it will take ages to get an N# and visa interview in London. What do you all think? Good idea or bad idea?

  3. Last week one kind agent at NVC told me to email a copy of my approval notice - which I did. I also put in a case number with USCIS last week. I have been calling every other day and it still hasn't arrived. Some agents at NVC are rude. I couldn't get through yesterday even though I tried. It is frustrating. I've done everything I could, but there are still unnecessary delays that might ruin my xmas wedding. We'll see - I hope it arrives this week.

    I'm sorry about the RFE taking so long. These things just don't seem fair do they? Hang in there...

  4. Hello :-) The letter from the bank is NOT needed if you qualify with income. If your income is enough you don't need to present statements from the banks or show you have other assets.

    I had my interview last month and the employer letter, tax return and pay stubs were enough.

    I'm happy to hear about the other approvals! Let's keep our fingers crossed for a quick transfer to the next step :) I have a question. I'm done filling out the I134. I send this to my fiance to take with him to the consulate, right? I am including an employer letter, two pay stubs, and last year's tax return. Do I have to include a letter from the bank, or is that enough? Thanks!

  6. Wow! I just (like 1 min ago) got a text...and we are approved:) So, since they received my RFE on the 26th of September, it took them one week and two days! Not too bad :) Now let's hope that they can be fairly speedy with the next step. I've still got my fingers crossed for a late December marriage. I wish all of you the best of luck. I'm going to stay around on the boards.

  7. Is it possible to not be able to get the divorce decree and only be able to get the divorce certificate? We got RFE for "Proof of legal termination of marriage" and we had sent in the divorce certificate. Is the divorce decree only issued by courts? What if the divorce didn't go through court?

    I sent in my official, stamped divorce certificate in the first petition. The RFE requested my divorce decree (a 150 pg. document with judge's signature). I sent that and have been waiting one week so far. THe other two items were mistake on their part (1) my birth certificate which I already sent, 2) my fiance's divorce decree - he was never married so I resent the bio page where we marked single for him and explained)

  8. can anyone help me with the acknowledgement criminal record question? I don't understand why I got a RFE for it. question 2 part 3 was all no. they said I didn't answer question 3 in part 3 but it is not applicable to me and no where am I able to state it is not applicable I am confused

    Hi there. I think they made a mistake. On my RFE for the I129F, the list said "Your I130 is missing...1) my birth certificate (which I definitely already sent), 2) Divorce Decree (I had sent the official, stamped certificate of divorce so this time I sent the full decree copy, 3) my fiance's non-existent divorce decree (he was never married).

    When I called USCIS, they told me papers get lost and mistakes are made and to simply explain all of this in the cover letter. I did. What I think you should do is send a copy of the original criminals records page and explain in the cover letter that you have no criminal records. Just double-check the boxes and explain again. The officer may have looked for it wrong. I hope it goes well:)

  9. I mailed my RFE back with documents today. The form came with a letter that said "documents missing for I130 application! I filed K i129f not I130! I called and spoke to a level two officer who said "note the mistake and lost documents on your cover letter". He said "I can't say they 'lost' your birth certificate but things happen. Ask them to compensate for your lost time by expediting". So I put his words in my cover letter...politely. Hang in there guys...maybe they are breaking In a load of newly hired adjudicators?

However, the RFE said nothing about these or evidence of intent to marry - just wanted copies of docs is already sent (birth certificate, divorce decree). For his UK "divorce decree", I'm sending a cover letter staring that he was never married and his bio page again where we had checked "single". Sound legit?

    1) my birth certificate. (I included this already - it was an original freshly-issued)

    2) my divorce decree from my previous marriage (I included this already - it was an original freshly-issued)

    3) my fiance's divorce decree (we checked that his marriage status was "single" because he was NEVER married before)

    So, frustrated, I called customer service to say that all these were in the original file and I HAVE PROOF. The level 1 agent just said "sometimes things get lost. Send them again fast or go see your local USCIS office and show them proof that you turned them in". I asked to speak to a level 2 agent and she said "if I transfer you it will drop your call because they are flooded and not accepting any additional calls today. Try them in the morning."

    WTH, government?! I could scream. I'm delayed by weeks or more because they screwed up. This sucks.

  14. I planned my first wedding in only four months because I was pregnant and didn't want to be showing too much. So I called every venue in town and found the right one. It was small and beautiful. My first marriage didn't work out, and having been through some really difficult things makes me realize how small the ceremony is in the scope of spending lives together. That being said, every girl deserves a chance to plan her big day. It can be empowering and magical to become a true bride - and we should never deprive ourselves of that no matter what stage in life we are. I've decided to go to a justice of the peace (that's JP) when my fiancé enters on his visa. We won't wait the full 90 days. We are ready to get the spousal visa underway (assuming this K-visa and RFE works out). However, we are going to plan our ceremony at our leisure together:). I want a handfasting in England with flower wreaths and ancient trees. Why not let ourselves dream? Isn't part of our love lives the joy we get in dreaming together and sharing the fascinating parts of one another's cultures? Meagan - don't give up on your wedding day. I think what Andrey is saying is that you have to separate the JP and paperwork from your actual blissful day. It will still be just as beautiful if it is in a different sequence of events. If he loves you, he won't deprive you of that - but the bureaucracy requires patience and order first. Sending a hug.
