  1. Hi all. Beneficiary here. Married in 2014 to US citizen, filed I-130 petition in that same year.

     

    20 August 2015 - I was refused at my interview (actually, exactly 6 years ago) due to a CIMT (shoplifting - one lipstick in 1990 when I was 18 - I'm almost 50 now - theft committed by the person I happened to be with, without my knowledge - was arrested as an "accessory" but charged and convicted in chambers without my knowledge of "theft".) I didn't even know that I had a criminal record until I filed my I-130 petition and saw it on my police clearance. I declared everything in my petition, and was still denied at the interview. Subsequent request for reconsideration under the petty offense exemption was ignored, and I was told to file a waiver.

     

    At that point we just abandoned the process because we had already been apart for too long, and didn't have the extra $5,000 that we would need to file the waiver.

     

    Current situation: My husband's mom passed away in May 2021, and he had to return to US to take care of things. We had been living together in Vietnam (Hanoi) for the prior two years. He is unable to return due to COVID-related visa restrictions for entry into Vietnam. We re-hired Lizz Cannon, and she is just about ready to go ahead and file the waiver.

     

    Is there anyone else in a similar position now - that is, just about to, or already filed an I-601? Is there anywhere I can go to see current processing times, and updates from others who are going through this right now? Would love to connect with others in a similar boat.

  3. dwheels76, please help if you can, I'm freaking out a little bit. My interview is coming up on August 20th, and I only have a scanned copy of my husband's divorce decree from his previous marriage. My divorce decree from my previous marriage is fine - it's original and apostilled, but neither my husband nor his ex-wife have an original of this document, and neither of them are in the country to request an original. Will it be fine if I just take the original of my decree, and the scanned (not certified!) copy of my husband's decree?

  4. So my P4 letter just arrived in the mail. I am so nervous/excited for the interview. Can't believe this is finally going to happen, after all this time. 35 days and counting! Good luck to all those who are preparing for their interviews now, and holding thumbs for all of those still waiting for a date.

    After all this waiting, it feels strange to be preparing for something I sometimes thought would never come.

  5. Woah emotion overload.

    Just drifting off to sleep and my phone made the familiar *new email* bleep... Curiosity at receiving an email so late made me discover we have an interview at the embassy in London scheduled for August 21st.

    Sucker punch! Wasn't expecting that at all!

    Yay!! The day after mine!! Congratulations! Awesome feeling isn't it?? Suddenly, after all the months (in my case, 16 months!) of waiting, there is so little time left to get everything done! Still haven't received my email confirmation yet, but things are finally looking up!

    Huge congratulations to everybody who got their interview dates - wow, the NVC has really been flying through the scheduling...can't remember ever seeing so many interviews popping up in such a short space of time - good!!

    To all those still waiting, holding thumbs for all of you that your dates come soon!!!

    Haven't checked it properly; fiddly to do so on tablet so will have a look on computer tomorrow.

    And yes, totally agree, so relieved. I told my husband the other day that if the only thing our attorney got right during this whole process was to get us through NVC with no checklists, I would happily forgive him all the other unnecessary stress he caused us. So, looks like all is forgiven!

    Have you called the NVC yet to ask them about interview dates? I did, and I got a really cryptic answer. The convo went something like this:

    Me: Can you please tell me when I'm likely to get an interview date?

    Rep: But you only just got case complete a week ago.

    Me: I know, I'm not expecting to have the date already, I'm just trying to find out when it's likely to be - an estimate.

    Rep: Well we only schedule interviews a month in advance.

    Me: So when will you be starting to schedule interviews for the Johannesburg consulate?

    Rep: I already told you, ma'am...a month in advance.

    Me: *silence*

    I just can't even.

  7. At the rate it's going September seems more realistic for us than August, but I can't help but hope based on that june CC with interview in October, that by some miracle we can still get an August date!! I miss my hubby!!! ?

    Yes, but even if your hubby got an interview date earlier than your daughter, wouldn't he have to wait for hers so they could interview together? Really praying for August interviews for all of us...this separation is really awful. Hang in there, soon this will all be a memory for all of us and we will be with our loved ones again :goofy:

    Congratulations for being able to shuffle another few steps forward in the queue. Welcome to the group, good to see you here :)

    Man, I hope we don't have to wait too long for an interview date! Seems the average for the South African embassy is around 50 days from CC to interview, so I'm hoping that's the case with me too.

    Have you checked the spreadsheet to see what the average is for London?

  9. Just so you all know now, WE GOT OUR INTERVIEW DATE ! for early/mid August. Hopefully that gives you clearance

    Hi ShelbyvdMerwe, so if my calculations are correct, you got your interview roughly 48 days after CC, right? My CC is July 2nd, so hoping for an interview around August 20th (if all goes well!)

  10. Hey dwheels76, you're an absolute angel - you've made such a difference in the lives of people who are already going through a difficult situation. My only regret is that I didn't discover these threads a year ago, BEFORE I shelled out an indecent sum of money to a lawyer who, as it turns out, we really didn't need. So, thank you :)

    Just saw CC on the CEAC website on July 4th, haven't yet called to confirm the actual CC date, but 3 N/As so I'm pretty sure I'm done with NVC - whoop whoop! :)

    Question, if you know: I looked at your CC to interview spreadsheet, and can see South Africa isn't a really busy consulate when it comes to IR1/CR1 (about one a month by the looks of things). I've read here before that NVC only schedules interviews in the first and last weeks of the month - is this true? So do you think I've missed the "first week of the month" boat and will now have to wait till the last week of the month? Any insight into the wait time for the South African consulate?

  11. It's very rough, you shouldn't feel embarrassed for crying though, totally understandable :)

    Thanks PeteandJoe. I'm over the embarrassment now. Going to collect myself and get ready to call again on Monday for my CC. The champagne is chilling in the meantime :)

    sorry to hear MrsBrook, I had my breakdown monday when I was printing out everything to send to hubby so he has a copy of everything when the interview comes, the whole folder disappeared without any error or anything, i broke down. I had to recollect all documents and redo all of it, luckily this time it was quicker as i had them in multiple places and i store most of them in an online secure vault. They just needed to be reconsolidated.

    hang in there ..... we all have to stay strong.

    I'm so glad you managed to get everything back - and good advice! I keep everything in a purple ring binder and have made certified copies of all the originals, plus everything is scanned and saved on my computer, in DropBox and on my external hard drive. Plus everything backed up to TimeMachine. So no fear of losing anything! As for 'hanging in there', I have no choice but to just get up and keep going. Today is exactly a year since my NOA1. In some respects it's gone really quickly, but in other ways it's been the longest year of my life. So close to the finish line, time seems to drag, doesn't it?
