  1. You should try another bank. My husband came in on the Visa Waiver and had no ssn, but they let him open his own checking account with just his passport (Bank of America and Wachovia)

Bank of America is well known for giving accts to illegals, so they don't count.

Your marriage certificate, proof that you live together (mail that was addressed to both of you, rental lease with both your names on it), your name on some utilities if possible, a "family plan" for your cell phones with both your names on it, Blockbuster/Hollywood Video card with both names, renter's/homeowner's insurance with both names (if possible without a SSN), signed and notarized affidavits from your family members stating the validity of your relationship.

Secondary information would be dated photos of your wedding and you two together since then. Those alone are not proof enough.

Verizon won't allow both our names on my account...has to be in one person's name (at least that's what they told me, his name appears nowhere on the account).

What do you mean "they don't count"? Says who? It's a completely legitimate bank ...

Completely legitimate depends on who you ask - just ask the guy in West Palm (I believe that's where he's from) that they stole the Keep the Change idea from.

I say they don't count, because they shouldn't be used as an example that any bank will let you open an account - they're infamous for catering to illegals (we received mail shortly after we opened the account saying to comply with the US Patriot Act they needed my husband's SSN or ITIN (he had the ITIN) and proof of his permanent resident status - which he didn't have because he was on an expired I-94 from a tourist visa, and married to me with AOS papers not even filed, but to them proof was a copy of his "valid foreign passport" - so I made a copy of his invalid, expired passport and they never closed the account, lucky for me). They make a big deal of how they cater to illegals by offering secured credit cards to those without SSNs etc ... but then, look...they really don't.

There's more, but it's irrelevant. The OP could get lucky there, but I thought we would too, and they wound up requesting the SSN or ITIN anyway - if their spouse has neither, it could mean a closed account.

Fair enough, but I never used it as an example that any bank will let you open an account. I was just listing two banks that I know for a fact will let you open an account without a ssn. But it doesn't matter if you think it doesn't count-- it matters if USCIS thinks it counts.

  3. Many said that one has to reschedule his/her flight then.. would be 300 bucks for me (600 ticket price) to reschedule it  Not a good option tho since the USCIS isnt worth 300 bucks again.. my opinion ;)

I cant even bring the ticket since Ive got an eticket and just have to bring to confirmation with me to the air port. Guess the confirmation should be enough for the officer as well.

Confirmation of what - your approval? If you leave the country without valid proof you could be facing serious issues! You'd risk losing your GC over $300?

I think he means to bring the flight confirmation, since it's an e-ticket, to his interview, since that's what he has to bring to the airport to get his ticket.

  4. My question is when my fiance comes and we apply for the adjust. of statua do we have to get the vacciantions and also go to the civil surgeon before we send in our applications and documents? and if so do we go anywhere and get the vacinations then make our own appt with civil surgeon? or do we wait for them to appt one? \

You have to make your own appointment with a civil surgeon-- USCIS only gives you appointments for biometrics and interview. You'll need to send the sealed envelope from the civil surgeon in with your AOS package. Your fiance will need vaccinations if he hasn't already had them done.

  5. I-485 package:

what do you mean by additional info, letter and 7 pages of additional evidence? it is form I-130 that asks for additional evidence (see page 2 of instructions)

If your wife wants to work or travel, you should also submit forms I-765 and I-131

    I-130 package:

be sure to include a certified copy of the marriage certificate!!

why do you want to submit 2 pictures of yourself (USC)?

The I-130 asks for passport-style photos of both people.

  6. I am worried for my AOS interview.

My husband and I married on October 15, 2007.

Filed and submitted application on December 26, 2007.

I received my EAD card in the mail on March 17,2007.

I went to apply for my social security card on March 19, 2007.

My AOS interview is on April 16. Because I don't have my social security yet, I am unable to file any joint bank accounts, car insurance, and life insurance with my husband. We are both newly college graduates and are currently still living with my parents.

For the interview, we are asked to bring any documentation that would show that are marraige is bonafide. However, what we only have is a cable bill under my husband's name (as he is paying for that as part of the living expenses to my parents).

I know this is a valid reason to not have any of those documentations, but I am worried that we might not have enough evidence to bring to the interview.

I wanted to know if any of you guys have had this problem or any suggestions that might help us through the interview. Thanks!!

Have you tried to open a joint account? My husband doesn't have his SSN, but we have 3 joint accounts at 2 different banks.

  7. I just realized I may have created a problem for myself. My husband and I have been living in an apartment since October, but I knew we were going to be moving (2 weeks from now), so on the AOS/EAD applications, I put my grandmother's address (she lives 10 minutes away and we lived with her before we got our apartment) as our address. The problem [potentially] is that all of our proof of living together and sharing assets (bank accounts, bills, etc.) have our current apartment address on them, and I didn't note it on any of the applications.

Will this be an issue? I'll be submitting the address change as soon as we get into the new apartment (it's in the same complex). I knew this address was only temporary, so that's why I left it off-- do you think this would hurt anything? I'm probably worrying over nothing, but I just don't want it to look like we totally lied about where we were living because of something shady when really it's because we knew it was a temporary thing.

  8. lostunderwaves,

As I wrote, the Notice Date refers only to when the notice was ordered or printed.

Whether your husband has 360 days of overstay or 366 days of overstay, he does not want to leave the USA. Either way he will be gone for a long time.

    lostunderwaves,

The Notice Date is the date that someone ordered the notice to be printed. Or, it may be the date that the notice was printed. Either way, it refers only to the notice (the piece of paper) itself.

I was just wondering if it's the receipt date or notice date on NOA1 for AOS that is the day that out-of-status days stop accumulating?

Right, so then it (the receipt date) is not the date actual acknowledgment of having an AOS pending? Which would mean we would go by March 20, the notice date?

I know, he's not planning on leaving, I just wanted to know out of curiosity on the off-chance that his AOS is denied ... then it would become extremely relevant. Maybe I'm misinterpreting what you're saying, but I'm still not sure which date he stopped accumulating days out-of-status. I understand that the notice date is when the notice was ordered to be printed, I just don't see which date is the relevant one.
