  1. Hi everyone, currently preparing to file I-485 (AOS from K1) and I'm stumped by the I-864 Affidavit of Support.

    Under part 6, question 13 has a checkbox next to "I have filed a Federal tax return for each of the three most recent tax years." My husband's salary is well above the poverty line, but he only has tax returns for the most recent 1 year as he was still in college for the two years before that.

    Do we leave the box unchecked and include his most recent tax returns + a letter of explanation? Or do we check the box anyway and explain in the letter.

    For the first option, I'm afraid of giving them the (false) impression that my husband has not filed taxes at all. For the latter, not sure if this is considered fraud or misrepresentation since he filed for one, and not three, years.

  2. Hi everyone, preparing to file AOS soon. I know JolyDan has asked a similar question, but I still feel unsure. We have gotten married at the courthouse and plan on going to the SSA office soon to change my maiden name to my husband's. (I already have a SS card under my maiden name) Is this advisable or is it better to wait until after AOS is done to change my name? We assume it makes more sense to change name now (so future documents like my green card will bear my new family name), but am now unsure how to explain a name change on the AOS forms. Do we just include a simple statement about marriage and a copy of our marriage cert?

  3. Does anyone have experience with how quickly the Singapore embassy gets the passport + approved package ready for Aramex pick up? Our interview went well and was about a week ago but our status on the CEAC website still says 'Ready' though the date last updated shows today's date. Liznaj7 - I see you had 1 week between the interview and having the passport in hand. Did you do the pick up or delivery and did you see the approval on the CEAC website before? What are the different CEAC updates (Ready --> AP --> approved)?

    We have been really lucky so far with our processing time so I am not trying to come off as impatient but just curious because my fiancee was supposed to travel this next weekend in Asia and would need her passport for it! She called the embassy who told her that if she did not hear from Aramex by Wednesday, she could come in and pick up her passport but that it would need to be re-submitted at a later time....we would much rather have the processed visa + passport in hand rather than risk making the process any longer than it needs to be. I guess it was a bit of a nice problem to have where my fiancee had booked this travel not anticipating the interview so quickly.

    As whitetiger mentioned, your status will change and say "Issued" when your visa has been approved. Once my status changed to "Issued",it only took Aramex two days to deliver the passport and sealed envelope to my office. Hope you guys get the official approval really soon!

  4. I think you are fine if I understand what you did properly - that you just sent back the checklist without writing anything along with the signed form. My fiancee didn't tick anything either!

    Also, my fiancee had her interview and it went pretty smoothly!! Trying to bug her to write a review now but from what she described to me, the questions were pretty simple and the 2nd interviewer informed her that her case was straightforward. The only thing was that they had not received her medical yet even though she had done it some 10 days prior. She called the medical office after to check on it, and they had said that they sent it so maybe it's in delivery. YAY!!!!

  5. no, AP is not just for emergency travel. it can be used in situations like you described. don't forget to also apply for EAD if you are planning on working. even if you are not, it can come in useful in other ways, e.g. many states will let you get a drivers license with an EAD.

  6. Approved! Really really happy.
    Question for those who have already gone through this -- I'm planning on applying for Advanced Parole at the same time as AOS. Is AP to be used only for emergency situations? E.g If I leave the country on AP to attend my sister's graduation, will I be questioned upon return because it's not an emergency?

    Thanks! Yeah I'm excited to get this show on the road already haha. Yup they want it unsealed! The COC office will hand both your certificate and an envelope to you. I assumed I was supposed to place the certificate in the envelope, I was wrong there. Congrats on getting to the next step!, viraj1303

  9. Just had my interview this morning :) It went well, short and sweet. CO said he doesn't see any problems with our case and I should get my passport back in a week! The only thing that wasn't in order was my COC, I had placed it in the sealed envelope given to me by the COC office... apparently I'm not supposed to do that as the embassy has to send all sealed documents to another department to open and check. CO said this will add a couple of working days to the waiting time, but everything should be fine :) Relieved to be done with the interview.
