  1. Most embassies will want to see 125% of the poverty guidelines for a K-1 visa. This is because they know that 125% is required when adjusting status. Yes, the embassy has great discretion on whether or not to accept income at 100%, 125%, or anywhere in between, but realistically you are not likely to get approved if you have less than 125%. So although the amount you listed is correct IF the embassy accepts only 100% of the poverty guidelines, in the real world your figure is incorrect to what the embassy will likely require to see. Philippines is one of those countries that requires 125% for the K-1 visa. For the OP, best to ask around in the regional forums on how strict they are on income guidelines.

  2. How long does it take uscis to make a decision about a response to an rfe? They received my response on 12/15 and today is 1/7 and still no word from uscis. My rfe was for letter of intent....this is ridiculous. Way to start the new year.....

    Its always a case to case. We had an RFE but 5days after receiving our reply, we were approved! TSC here.

  3. Its always a case to case. But, right, Philippines applications were worked faster than the others. Why expedited? It was due to the biggest typhoon ever hit the entire world. Most cases were processed in less than 6month due there are cases who got delayed also. Some couples finishes the process in 3 months time though.

  5. NVC letter often comes in later. you have to call NVC after 10 days case has been received by them. They will issue you a case number to check the status of your case. Status could be: At the NVC (receipt), In-transit (to Consular Embassy), Ready (In Consular Embassy ready for interview). NVC letter do comes sometimes later than what you expected. Good luck!:)

  6. OK guys so a couple things here that I want your insight on if you would be so kind.

    My case apparently arrived at NVC but they didn't have the case number for me yet. I will call tomorrow or maybe next week to see if I can get that. Now I had already planned a trip to Philippines March for my fiance birthday, no matter where we would be at in this entire process. With recent approvals it is possible now for me to attend her interview and even be with her for her medical exam. It doesn't matter for her if I am there or not BUT...

    1. If she ends up being able to take her medical lets say middle January and hopefully passes. As I understand this process the clock for the 90days to get married starts at that time, is this correct?

    2. For those of you who attended your fiance's interview. Did it help you feel? Did they interview you also (the petitioner)?

    For Me I personally would like her to fly back with me March 18th when I leave Philippines. If we have the interview say March 2nd (I arrive the 1st) what is the possibility she would have her visa in 17days from where I leave? I know the golden rule don't buy tickets until visa in hand but I gotta think by the time she has visa in hand there may not even be any seats left on my flight....

    wow..so you called up NVC already, got your case there but not assigned MCN yet. Ill start calling Monday then.

    With your questions:

    1. 90 days clock start from the day your fiancée enters the US.

    2. Read some stories, beneficiaries with their fiancé on the interview. Some are just put to listen while the interview goes on, while some were asked some simple basic questions. the focused of the interview is on your fiancée. Yes, it will help boost the confidence of your fiancée with your presence:)

    3. Visa on hand varies from case to case. some waits for days, some weeks. depending on your case. as long as your papers are complete at the consular, no 221g issued, you will be alright. in less than 2weeks time it can be issued. Goodluck!:)

  7. 4 vs 2? From the I-129F instructions:

    Submit two completed and signed Forms G-325A, Biographic Information; one for you and one for your

    beneficiary. Except for name and signature, you do not have to repeat the information given on your Form I-129

    G325 is an old form in the past, only it is 4 copies long carbonless. G325A is the NEW revised form of G325, shorten into 2 copies long only. Same content and information. The only difference with this form you see online now, is the 'A'. That's why we made a mistake too, you cant tell the difference.

  8. Hi Pianist27..we got same RFE! G325 is and old form and that's what we gave them for the petitioner which was an honest mistake we never noticed. RFE required us to submit the G325A form too. I had searched several answers to my confusions on the both forms. Most common answers are they are same forms, but old and new. Currently G325a is being used. Have you submitted a new G325A form with your RFE? Or did u submit same G325 forms maybe? so they can just deny the application with just minimal mistakes. They could have issued you another RFE instead. But, it all depends on the hands doing you case. We got approved after 5days of giving them what they need. Im sorry I fully understand how you feel right now.

    On October 10th, I was sent an RFE to submit "properly filed out and signed G325As" my myself and the beneficiary. There was no indication what was wrong with the original G325As which I submitted, but after reading them over and over again, I found two errors:

    1) In the "form is submitted in connection with an application for" section, we wrote "K-1 Visa" rather than "I-129F" - that doesn't seem serious, but I can see a strict adjudicator not liking it.

    2) In the bottom box which asks for family name, first name, middle name, we accidentally wrote my fiance's name in Cyrillic letters.

    I corrected these two mistakes and sent in these new G325As. They received them on October 10th.

    My denial letter, which I just received, states the following:

    "The petitioner responded to our request on October 30th, and submitted an additional copy of the Form G325 already submitted for the petitioner and the beneficiary. However, he did not submit the required Form(s) G-325A as requested.

    The petitioner has not complied with the instructions on the forms by submitting the required evidence. Therefore, the petition is denied."

    I note their lack of consistency - is it a G325A or G325 form?

    The appeal process appears to cost $630. This is quite obviously their mistake, I'm going to refrain from some editorializing about the irony of them insisting on absolute accuracy when they don't seem to pay attention to details either.

    Suggestions? Refile? Have a good lawyer look over the application first? At last check, my state still goes through CSC, which is moving relatively quickly, I have to think refiling is not only cheaper, but faster.

    Sorry to hear that. But your lawyer is useless! Letter of Intent is one of the main important requirements we need to provide. We do our papers personally, no lawyer. Just got RFE as I haven't noticed that my F filled up the old G325 form instead of the new G325A. Talk to you lawyer how they are doing your case.

  10. Hello!

    I have a question and would appreciate any insight I can get. I received notice that I recd an RFE on Nov 22. I never received the hard copy then this past Tuesday my lawyer got the hard copy and informed me what the RFE was for. The RFE was for letter of intent for the beneficiary. So I sent it Wednesday. Then I look on the USCIS website and it says an RFE was mailed on December 11 and the case was updated in dec 11!? What does that mean? Does that mean I have another RFE?! I have an infopass appt (i actually made the appt last weekend thinking that it was for this past Monday when accidentally I put it for this coming Monday). Should I go to the infopass appt anyway and find out what they have to say?

    I'm so confused because I thought I got an RFE on 11/22 then the case was updated on 12/11 to indicate that an RFE was mailed on 12/11. What is that about?!

    What was the first RFE all about?

  11. I been in Cfo yesterday and its sucks for me tht i need to come back and give some requirements! Why they need the verry first time we chat need te date and etcetera! But embassy they never ask for it and i get my visa! And i think that couseling is not really help for me! Shhhhhhh!!!!!!!

    Is there an age gap difference? CFO are quite strict into huge age difference but just prove them that you really love each other. That's what they need. Just give what they need:)

  12. Our NOA1 was Oct 6, NOA2 Nov 10, NVC READY Dec 10, and Embassy interview is set for Jan 10. My fiance will be going to his medical exam on Dec 15 and 16. There were actually Embassy interview appointments still available in December, but we wanted more time to ensure all of our paperwork is in order and to allow plenty of time for the medical exams. We still haven't received the NVC case number hardcopy, but we have screenshots of the CEAC case status stating that our case is ready for consulate interview. We have been so fortunate that everything up to this point has fallen into place so beautifully. We are praying for our good fortune to continue and praying that every other loving couple can be together soon. God Bless us all.
