  1. Wow! I heard this before.

    I guess the message for the rest of us is to either book a return flight way out for when the AP will be through or just book a one-way.

    How are you gonna go about proving he never left? Using the flight cancellation? Trying the get the I´94 corrected?

    Hi TabeaK - It's such an annoying thing to have to go through now, on top of the long waits and thousands of steps and everything we've all been dealing with for the last year already. Meh!

    We'll do exactly that - he's managed to remove the false entry from his I-94, and is meeting with an immigration officer tomorrow to show the cancellation record. Hopefully they can help him. There's something else about correcting some Freedom of Information Act piece but I'm not sure if that's necessary yet or not.

    You know, when they sent the RFE, they didn't give any help whatsoever. They just said prove you didn't leave, and left it at that! Left us feeling helpless really - how are you supposed to prove that you're right here in the country opening up the letter they just sent? So this is taking some research and trial but hopefully all will go well now. Joke of a system we have!

  2. Hi! We got our letter finally this weekend. It said processing is delayed now because he left the country while this is pending... Even though he never left the country at all! What happened is when he came here on the k1 visa it was a round trip ticket. So they recorded him as having left the country... A week before the date of the flight and after he had already cancelled it. It's a ridiculous system we have!!! So now he has to prove that he didn't leave the country. So stupid!!

    My husband received an RFE on his i-485 application over a month ago. It was for my W-2 form and we sent it back. According to their website they are still "reviewing" the mail we sent back.



    Just today we received online an RFE for both the AP/EAD applications (71 days after they received these) and now have the dreaded wait of the letter explaining what they need from us. Of course I do not think we forgot anything in the initial filing but I must have.



    Has anyone gotten an RFE on the EAD/AP applications? We filed these jointly with the green card app.

  4. Hi all, I know my timeline isn't filled in since we received K1, but posting here anyway. We sent in the application for green card, AP and EAD in the middle of March, received an RFE in the middle of April, and now the recent case status on USCIS website says our RFE correspondence was received and USCIS is reviewing it. The funny thing is they never even looked at the AP and EAD applications yet! Seems pretty backwards. Hoping everything gets processed soon as hubby wants to visit home again within the month!

    Just clarifying that the National Benefits Center sends these cases off to the local office for processing, right? Will they just send the cards in the mail once done?

  5. Hi all,

    My husband entered on the K1 visa at the end of January, and we got married last week. We are in the process of filling out the forms for his green card application. In the instructions of the AOS form, it says we need to submit another Affidavit of support, another copy of his birth certificate, and the vaccinations report of his medical exam that he got before his consulate interview.

    We've already submitted all of that in order for him to get the visa. Does anyone have experience here NOT submitting that again for the green card application and still being approved? He didn't bring another copy of his birth cert here with him, it's a balls to have to do the Affidavit of support AGAIN, and he submitted the medical records when he entered the US in January so doesn't have them (shouldn't USCIS have them already?).

  6. Blah. How depressing. What time of day did you call?

    And did you get any notification from USCIS that your application had been sent?

    When I stopped getting a busy signal it was about 3:00pm eastern time, and then when I finally connected with an agent it was a few minutes after 3:30pm. So frustrating!

    I didn't get any text or email or even update on the website about them sending my application to NVC. The last e-notice I got was just that they approved the petition. However on the hard copy of the NOA2 it says they sent my application to NVC as of my approval date, Sept 12.

    I think I've learned by now to not trust what anyone on any customer service line says, or any e-notice they may send either. The paper seems to be ruling the roost so I'll believe snail mail (even though that's probably foolish to do also :P)

I called the NVC today, and when I finally got through (after hitting redial countless times) I waited on hold for more than a half hour. some guy finally got on the phone and sounded incredibly frazzled. he was also so brief with me that I ended up telling him he was rude lol. anyway only one of his three sentences was "helpful" when he said it could take the NVC 4-6 weeks to receive the app and they haven't received mine yet. hanging up with him I felt worse off. thinking of just letting it run its course at this point for the next two weeks or so and then contacting the embassy to see if they've received it. not up for wasting all that time trying to speak to someone at NVC again.

  8. Since some applicants have been posting that they received their NOA2 after they called USCIS, I decided to call. I’m only a week short of the 5 month mark. The Tier 1 caller told me my application was in Mesquite Texas even though I got a hard copy notice telling me I was transferred to California (8/11). I asked to talk to a Tier 2 officer. Contrary to what other are posting, the T2 officer re-affirmed that my application was in Texas. I asked if it was transferred back to Texas from California. She put me on-hold and said she was going to “look more into it”. She came back and told me that it was definitively in Texas and they had no record of it ever being transferred to California. NOW I AM COMPLETELY CONFUSED. :ranting:

    Conclusion – I don’t think either T1 or T2 officers have any clue what is going on. We just have to sit tight and wait.

    I think you should ignore what they tell you on the phone because I really don't think they know details at all. If you got the hard copy notice that you are transferred, then you are definitely transferred! When I called and spoke to Tier 2 he said he couldn't see any details about my case. In fact, when they transferred me to him they gave him my wrong case number at first also, so they are simply out of the loop. The officer I spoke to also expressed his own frustration with the adjudicators but made it seem like he has no contact or connection to them.

    You could always try and call again and speak to someone else to see what they say, or get a senator involved to find out what's going on exactly. But in my opinion I think a hard copy notice signifies you were definitely transferred.

  9. Okay so I've been reading a lot of threads on this forum for months and knowing that TSC is going slow has been depressing us....

    I truly admire those who have waited 9 months for their NOA2. :( I know that our Noa1 date is only August 12th and we are very excited to start this journey (don't get me wrong lol) but after checking the VJ timelines everyday and reading so many posts here about how long TSC is processing cases I'm expecting to wait at least 8 months to get an approval...

    I refuse to be away from her any longer so I've decided to move in with her in France, then move back to the States once she gets her K-1 in hands. It will be a great adventure!

    My concern is about the address change: I'm planning to use my parents address is this going to cause a problem? or should I leave my old address and use international mail forwarding services? I just wanna make sure we receive every documents (hopefully no rfe! ;) )

    Hi! Good thinking in moving to be together while processing. If you are able to do it you definitely should!

    Before you go, though, look into the I-134 affidavit of support document that your fiancé will need to bring with her to the interview after NOA2. This document will show that you can sponsor her while she is in the states and awaiting her green card. If you aren't receiving a salary after you move back to the states it may be harder to establish that you can sponsor her. I'm not saying you won't be able to, though. You may still be able to prove it with bank account statements and assets list or you may get a co-sponsor, but maybe wouldn't hurt to ask here more details about it before you leave so that you can go with a clear head and enjoy your time together while waiting :)

I am well aware of the history but for the last year CSC has been very fast and is still processing files much faster than TSC so I know my file will be processed before July filers at TSC....unfair yes but thats the way things are going! We are well aware of the differences between the centers and that is why the post specifically asked CSC filers.....dont understand why TSC has to interject negative statements onto this thread?? Could things change at CSC? yes we know it could but highly unlikely at this point of time....wish we could make TSC files go faster but we cant so let us enjoy our hopes of fast processing times.

    You know life is not fair. It sucks for us all at times.

    But you know it people want to be upset especially the TSC petitioners. Then the link above is one to be upset about.

    There are of TSC Filipino applicants way ahead of them. Heck even i am ahead of them.

    Now before people get on the kick filipino applicants are getting preference take a look at all the filipino applicants who being processed through the three different servicing centers many habe been waiting several months.

    No what we have here is someone going and grabbing a few fresh applicants once in awhile and running them through to help improve their processing numbers. I see several from different countries in the mix of one to three week approvals and that is just ones who have registered on VJ.

    The only negative statements on here came from the man/woman with the Canadian application - please read back in the posts. It sometimes helps to hear to set expectations low, and if it didn't help you well it may have helped someone else reading it. Also, all of the people on here represent just a tiny portion of the overall applications at USCIS, which come in thousands each week. So no "stats" here, processing times, or anything else you read from here is indicative of how it will be for your case, unless you've gotten solid information from USCIS themselves, or someone who may be connected (we all pray for one of those people on here...). Also it helps to read past experiences but again, each case different, each "trend" on here not really a solid trend due to the small sample size. CSC says 5 months processing time on the official USCIS website, TSC 6 months. Better to set the bar to 5 months and be pleasantly surprised if it goes faster.

    And... as I was transferred to CSC, I am actually a CSC petitioner now .. and was approved last night so that is good news for ya'll.

    Tension is high all around on here because this process sucks, we can all understand. Just for future reference, a public forum is, well, public right? You can't stop others from commenting. In fact it's quite American to encourage it, whether you think they are negative comments or not, so maybe see if you can start a private thread next time (if that exists here?) to get exactly the responses you are looking for ;). Even Canada lady/man was entitled to be snippy unfortunately.

    I think you're right that it may go down like that - grabbing recent applications to keep processing average times down on the website. In the group on here that got transferred with me from TSC to CSC (April and May filers), it appeared as though most of the May filers were getting approved before us April. Really confused people but the thinking there too was maybe they are trying to keep the numbers balanced.

    I am really happy to be approved but I'm also really annoyed to have been forced to feel such anxiety over this for the last 5 plus months. Glitches in their system, incompetence, being left in the dark, no one there able to give proper updates... it's really a disgrace!

    I feel for everyone still waiting and know that it is truly coming any day now!! Best of luck to you all!

    I have no idea what it could possibly be for. I included every little tiny thing that I could, now I'm just frustrated and upset. It's been such a long wait, what could I have forgotten that would be so awful that they wouldn't just approve us after such a long wait :'(

    On September 12, 2014, we mailed a notice requesting additional evidence or information in this case I129F PETITION FOR FIANCE(E). Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    The not knowing has got to be terrible, but you will know soon and get it all sorted! They looked at your application and that's what the good news is! At least you know that as soon as you send whatever they're looking for, you'll be approved soon after. Cheer up, I view this as a good thing!

  13. Exactly. We're all practising patience as well as we can. I just can't figure out why TSC filers can't respect CSC filers' questions and threads. It's not like CSC filers go into Texas threads and nanner nanner boo boo everybody. Or do they? :)

    Lots of people who may have just filed and joined this forum site might not be aware of recent occurrences at the different service centers, or even the process involved to approve, etc, or simply haven't been following and researching these threads because of being new to them. Its a frustrating experience, and when someone who has been going through the process longer can shed some light on expectations, that is being respectful and helpful. Those who decide to react by trolling ::cough cough:: are the ones with disrespect.

    Sabrina I agree with supporting each other and that is what anyone who can read could see I intended on doing with my posts. I don't blame the canada lady for being snappy, though. Some people react on instinct and she is upset like the rest.

    But every time someone starts a CSC thread, a Texas filer has to get all up in his britches. It's so predictable that it's tiresome.

    They need to leave the CSC filers to their discussions because we have questions and expectations, too.

    Is it unfair? Maybe. But no one was handing out fairness medals when I was born. It's part of life.

    I understand why TSC filers would remind us to wait 5 months before we get upset but it has been years since CSC has had longer than a 2-3 month late....I know that doesnt seem fair to TSC but CSC filers know we are likely to get approved faster than TSC! I am glad your file has been moved to CSC but June filers are almost all approved at CSC and a few July Filers at CSC have been approved already despite the extra files from TSC....it is hard for everyone to wait.

    Recently CSC has been very fast, but just a year or two ago they were the slow ones and people had to be transferred out. I read a bunch of old postings here and it seems to shift each year, and also multiple times a year depending on what each center is focused on processing, etc.

    It is certainly hard to wait, we all know that! I wanted to encourage you all to be patient and set the bar low so that you're not disappointed if it doesn't come sooner.

  16. blah don't mean to sound like a ***** but there's lots of us who have been waiting much, MUCH longer than you guys. I really do hope you all get approved very soon because we all know how brutal this is, but please don't set the expectation so high right now for a speedy approval because that will only drive you mad. Start to get anxious at the 4-5 month mark because as it's looking it just might be that long or longer for ya... or you may be very lucky and get approved sooner ... I genuinely hope that happens for you. The best thing you can all do, though, is to just try to be patient at first to save your sanity!

  17. by the way (just another speculation...) ... seems like these get approved by the adjudicator and then sit and wait on a supervisor's desk until final approval, and then when the supervisor gets around to giving the final say they have a whole chunk of them that they approve at once and then the system gets updated.

    I wish we had some recent inside scoop haha. i used to work as a claims adjuster at an insurance company and that's how it worked there anyway (totally different i know, but probably the same :secret::P)
