  1. Update....

This was the easiest interaction I've ever had with USCIS.  Scheduled the infopass 3 weeks out.  Could have been even earlier but I wanted to wait until my daughter's Thanksgiving break.  Told the interviewer that since her name was never mentioned in her mother's extension letter and we were planning to visit the Philippines next year I needed / wanted a 551 in her passport.  One stamp and 2 minutes later we were out the door.  No questions asked.

Getting a renewed Ohio ID at BMV was a whole different story that I won't get into here.

FWIW USCIS Officer said they were currently reviewing August '16 ROC filings, so it looks like my wife will be a USC before ever seeing a 10 year GC.

    What a racquet!

  2. This site is an amazing wealth of information and helpful supporters. It's guided me through the CR-1/CR-2 visa journey, the I-751 filing, this issue and most likely the naturalization process next year.

Kesenia... Thank you for your educational response.  I finally got through to a USCIS human by using the 'do not respond to the language prompt'.  Worked like a charm albeit I got connected to Jesse a fluent Spanish speaker, not so much English.  After explaining my situation and several waits for him to get answers, he confirmed that I need an infopass for the passport stamp which I've already scheduled.  I hope the office doesn't retain her green card.  It would make a great souvenir for her later.

FWIW I also discovered during the conversation that the receipt number on her mother's NOA got superseded by another receipt number on the biometrics scheduled notice which they both received. I would have thought that the originally assigned number would carry through the process, but I was wrong. Go figure.

Again thanks for your suggestions on how to solve the issue.  I'll report back with I hope is a successful outcome.

  3. Brief synopsis... My wife and step-daughter entered the US in Sep. '15 on CR1/CR2 visas.  I filed I-751 Petition to Remove Conditions on Residence in Jun '17. On the petition I entered my step-daughter's info in Part 5, Information about your children, and checked block 5, Is This Child Applying With You, Yes.

We received I-797, I791 Receipt Notice, in July.  Nowhere in the document does it mention my daughter's name or reference a one year extension to her visa, only my wife's.

My question: If we travel back to the Philippines next year before receiving the 10 year green card, can I expect any issues when my step-daughter re-enters the US, since she has no written evidence that her original CR-2 visa was extended by a year?

  4. Not sure if the correct forum to post in or not.

  5. Interesting.

I was wondering why a US citizen would need any document from the Philippine gvt to exit the country.  I guess this stated requirement:

    Philippine-born foreign nationals who will depart from the Philippines for the first time;

is the reason since the foreign national never had an entry visa to match up with the exit?

But if the kids exit the country on the Phil visa, wouldn't they then need to pay the exit tax?

    Just curious.

  6. As I understand it, the ROC can be applied for within 90 days of the 2 year anniversary of the petitioner entering the US.  Not sure what the repercussions are if you wait until after the 2 year anniversary.

And again, as I understand it, the petitioner can apply for citizenship, after 3 years of US Residence.  Each of these filings come with associated fee requirements.  Not sure what the status is of a resident, 2 year green card holder, that lets the card lapse, and jump directly to citizenship application.  Can't believe there is some illegality during that 1 year timeframe.  Hopefully not enough to be swept up in an ICE raid :).

  7. So you got the 10 year card in hand AFTER the date @ 3 years you could begin the citizenship application process?  What a racket.  And I thought the path would be smoother after the family hit the POE.  Guess I was sadly mistaken.

  8. Well I hope your kidding but somehow I think you're not.  We will be submitting our paperwork in June this year.

So you're say I should begin assembling 24 months of joint bank statements, electric, gas, cell statements, survivor benefit statements, car loan and insurance premium statements, etc.?

Seems more daunting than our initial CR1 data submission process.  I was planning on just sending in a few of each showing both our names but not 2 years worth.

And the current turnaround is 6 months +?

  9. Have your fiancé check the requirements at her LCO for their requirements prior to issuing a marriage license.  Most require both of you to attend a daylong pre-marriage seminar.  Also there is a 10 day cooling off period between issuing the license and actually being able to be married.  If you are planning for a Catholic church wedding there are many more hoops to jump through so your fiancé needs to start asking questions at her church now.

Can you elaborate on what issues you had with AA? That would help me make my decision. How is the in flight entertainment and the food? My wife is traveling with my 9 year old step son and he will need something to keep him occupied. The good thing versus Cathay Pacific is the longer flight is only 11 hours versus 17 hours.

Issues?: US flag carrier vs. foreign. ie level of provided passenger attention.. service provided by grandmothers vs. ?????. You get my drift. On 1 out of 3 transpac flights the entertainment was not operational. Big deal for some but for me, so what!

Food... None of it is gourmet cuisine, but JAL was better in my opinion. JAL wifi was cool and usable more of a novelty than a necessity for the casual traveler. I paid the $20 for the flight duration just to do it.  Can't even remember if it was available on AA.  Won't buy it again.

Recommend that Lisa and son travel with a cell loaded with personal music list, notepad to record thoughts along the way (historical memento), and maybe a favorite book or mag.

On the transpac leg you'll sleep, or try, for 6; eat for 2; and ??? for the other 3. Word of caution: leave extra food & snacks on the plane at ORD.  We took uneaten subs with us in our carryon and ended up getting an overweight, wide belt wearing, end of shift woman (I think) bag inspector after passing through the final immigration paper turn in checkpoint. We checked off 'Not bringing in any food'. Wrong answer. She went off when she saw the still wrapped subs in my wife's bag :). Welcome to the US!

Personal use... no reason to declare.. and gifts are personal use.

This last trip we brought 4 tablets, two phone, a laptop and a bunch of other stuff... and our dog. ;)  No one cares.  Nothing was confiscated.

Trip before that 7 tablets (mostly gifts), two laptops.

As long as it is for personal use no reason to declare.

Pray tell how that went over????? No quarantine, special papers, etc.  Just curious.  I sent 3 dogs, unaccompanied, to my son after he got settled at Lakenheath, UK.  Paperwork weighed as much as the dogs :).

OP.... My recommendation is to scrap the desktop PC, whatever size, and take a $250 laptop instead.  Much more convenient to use in the PI. Don't declare anything.
