  1. This is great! I did a bit of research and I only have three questions:

     

    1. It says you need to provide evidence of any arrests or citations. I have had traffic citations for speeding or a fix it ticket but never been arrested or anything. Do I have to show proof of that?

     

    2. I have traveled outside of the US while I've been a resident but only for the weekend or sometimes even just a few hours to TJ. How do I show proof of that since my passport was never stamped?

     

    3. Should I use an attorney for this process? I have done ALL the paperwork myself so far, even my waiver without an attorney but citizenship is a huge deal and I want to get it right. Do you recommend I do so or do you think it should be pretty simple? My wife and I have a rock solid marriage of 4 years, we have been together for 10 years, 2 kids (just had a new baby 2 weeks ago), have a house, cars and bank accounts together. I'm a director at the company I work for and make a very comfortable living plus my English is fluent written, spoken and reading and I am pretty well informed on my civics. I don't want to be too confident that it will be approved.

  2. Hi everyone,

     

    I'm currently waiting to hear back on my removal of conditions (I-751) so that I can get the 10 year green card. My question is, how long after I receive the card do I have to wait until I can apply for citizenship?

     

    I know for spouses of US Citizens, the wait time to be able to apply is 3 years but is that three years in total or three years when you get your 10 year green card?

    I recently became a US citizen and want to help my mom become a resident or get her a visa. However, she is currently living in the country illegally. She's never had a criminal record or any issues with authorities. The only issue I have is that my grandma is currently sick in Mexico and she wants to go back to be with her. I'm wondering if she leaves the country, how much would it affect the process BEFORE I submit any paperwork?

    I'm currently waiting for my AOS to be "approved" and in the meantime my Green Card has already expired. I received a letter that states my status has been extended for 16 months and I can work and travel but I'm wondering if it's safe to do so? I'm planning on traveling out of the country for vacation but I also need to travel for work. 

     

    I would appreciate any feedback or experience anyone's had with this :)

  5. Hello Guys,

    So I filed my AOS on June 2016 along with my EAD. My address was wrong so I was in the dark for about a month. Finally we got it all corrected and I did my biometrics and everything. I then found out that there is a separate receipt number for the EAD which ALSO had the wrong address. My EAD had been approved since July but I had not received it due to the wrong address.

    Anyway, I called and got it corrected and they told me they'd be sending it out but it just so happens that I have been scheduled for an interview next month for my AOS.

    My question is, does this mean I no longer need an EAD?

    Do I have to do another physical if mine was about a year ago? (October 23 2015 and interview is in November 18 2016)

    How long after I get approved (If I do) do I get my green card?

    What kind of questions will they ask?

    ANY information helps! Please give me your experience or any issues you had when doing this.

  6. Hello everyone!

    I'm getting ready to file my AOS but I have a few questions in regards to the Affidavit and I hope you all can help me out!

    So when I came to the US on a K1 my wife's dad was my sponsor. Now that we are getting ready to file my AOS we want him to sponsor me again since my wife is still a student and has a part time job and doesn't make much.

    I know my wife has to file form i-864 and since we want her dad to be my sponsor, should he file an I-864 as well?

    He claimed my wife in his most recent tax return, would that be an issue?

    If he fills out an I-864 does he have to put her and me as part of his household total? Or would my wife's form have to say that it's just me and her under the same household and her dads be just him and his wife?

    I ask because since he claimed her in his taxes, and we live in the same house, would we part of his household?

    This is really confusing but if anyone can help us straighten this out we would really appreciate it!!

    So here is the deal and I REALLY hope someone can help me with some info! :)

    I entered the US on a K1 visa and I am now married to my soulmate! Yay! :D

    We are now in the process of filing the AOS and I am doing it all with the help and information from this wonderful website.

    My question is, I entered as a K1 Fiance and when I had my medical in September of last year, I was told I didn't need any shots. So now here I am filing and I see in the steps by steps to submit an I-163 if I didnt get any shots while I was in Mexico.

    So do I need to file it? If so, where can I get a medical or the shots because I had my medical in September of last year so it has not even been a year since I have had my medical examination.

    ANY and ALL information would be great!

    I have a few questions that I hope some of you may help me with.

    I arrived to the US on a K1 Visa 15+ days ago and now I am wondering what the next step is?

    I have been reading online that I am able to get a Social Security Number and a work permit before getting married but how can I go about doing that and is it worth it to do it before I get married?

    Also, after getting married, do I have to notify USCIS? Or how do I go about processing my AOS and be able to work in the US?

    Any assistance and information is much appreciated!

    This is my story about how I went about getting approved for a K1 visa. I hope it helps!

    First, let me give you a little background story; I was taken to the US when I was a year old from Mexico. I lived my entire life in the US until I decided to voluntarily leave the US to continue my education in Mexico, since it was really tough for an inmigrant student to do so around 2012 in the US. I met my fiancee in high school and did not began dating until 3 months before my departure. I left 6 days before turning 19 years old and arrived to Mexico City for the first time since I was born. I was not expecting my then girl friend to stay with me since we had only been together for 3 months before I decided to come but thank God she did. We had been together for 2 years when we finally decided to get married (yes she visited me multiple times while I was in Mexico) and so we began the process of the K1. It is a simple process to be quite honest. I had no criminal records of any type in the US or Mexico and our relationship was really easy to prove. We gathered all the information that is needed for the I-129F along with all the evidence needed. We sent it to USCIS lockbox and was processed in Nebraska. That took about 3 months to get approved. After that, we got the letter from the Ciudad Juarez consulate to gather the documents needed which can be found in the 2nd packet. I gathered all the information and booked my ASC appoinent in Mexico City and my Consular interview. Right after that, I booked my medical exam at one of the clinics mentioned in the 2nd letter. Booked flight tickets, hotel and was ready to leave for my interview in Juarez...that was a year ago.

    When I arrived to Juarez on a Sunday, I had my medical exam on Monday because I had my interview on Wednesday so I wanted to give a day in between to make sure my medical exam was ready. The medical exam is simple. Blood drawn, vision test, X-rays, tattoo examination and questions about drug use plus a drug test (pee) and a visi to the Psychologist for some reason? Anyway, medical was ready the same day but you can never be too careful about the day in between.

    After that, I had my interview. I was prepared with it all. Even the police certificate, which TRUST Me, they DO NOT ask for lol and so after turning in all my documents, I was called up by the officer for my interview. After disclosing to the officer that I did come a few days before my 19th bday, she went to the back to talk to her supervisor I assume and came back to tell me that I was denied because I had left the US 6 moths after turning 18 but less than a year so that automatically set a 3 year ban for me. I was given instructions as to fill a waiver (for I-601 grounds of inadmissibility) and file it with USCIS. (If you want more details about the waiver, feel free to message me!)

    After filing the waiver, which by the way, we did on our own, we did not hear back from them until almost a year later. May of this year. My fiancee received a letter from USCIS stating I no longer needed a waiver and that I could contact the Consulate in Juarez to set up a new appointment. Now this is where it gets tricky. The reason why I no longer needed a waiver is because on February of this year 2015 it just so happens I have been in Mexico for 3 years so that automatically applied as my "sentence" and I could start my process again without a waiver. Waste of money? yes. Worth it? Of course!

    Now, about 2 weeks later I received a letter from the Consulate in Juarez EXACTLY the same as the first letter after my I-129F had been approved and so again, I started gathering the documents sent in the letter. Paid the Appointment, booked ASC in Mexico City and also booked my appointment at the clinic again (because the medical is only good for 6 months) got a flight to Juarez and hotel once again. Finally I repeated my same process as a year before. Left on a Sunday and had my appointment on a Monday. Medical was good and then my consular interview came up. I was prepared again. I had new documents such as a new police certificate (which again they DID NOT ask for) new proof of relationship and all that. The ONLY papers that I had to turn in were the new tax forms from my fiancee and our co sponsor. Nothing else since they already had my file from last year.

    I must have waited about 2 hours before being called to the interview and it was so short. Or at least that is how it felt. I came up to the window to this one lady and she kept looking at my documents and my medical. Once she finished reading it her only questions were "how did you meet your fiancee?" and "Have you tried to enter the US since you have been here?" to which I of course said no since I have never tried to. Then she literally told me "I see no issues with your documents. Congratulations, your visa has been approved!" I was very happy but I did have one question for her, I asked her why I no longer needed a waiver? To which she confirmed, that since I have been in Mexico 3 years straight and have no tried to re-enter since, that counted as my penalty and therefore, they cancelled the Waiver request and just needed to be interviewed again. So, I was finally approved and today I picked up my Visa at the DHL :D

    I know this is not detailed information, but if you have any questions about the process I went through, I will be more than happy to give you as much information as I can!

  10. Hello Guys,

    So I was finally given the go for my second (hopefully last) interview at the Juarez Embassy after I was denied the first time a year ago under the fact that I overstayed after I turned 18. To make a long story short, I have received the letter from the Consulate asking me to update my DS-160, and gather all the papers needed for my interview. Technically, it is asking for the same process as the first time I went to Juarez. My question is, do I have to sign a new I-134 Affidavit of support? or is it enough with the form I gave them last year? The affidavit is still the same. I have the new tax forms but I am wondering if I also have to give a new signed form with it?

    Any help is greatly appreciated!

    I have one quick question.

    So me and my fiancée have planned the wedding date to be December 11th of this year and I am leaving with a K1 visa to marry her within 90 days.

    If all goes well and I am able to get to the U.S. With no issues, how long do I have to file for AOS. I was planning on leaving at the end of September and our wedding would be Dec 11th. Would I have enough time to file the AOS or should I leave a moth or 2 later to have all 3 months to do the AOS?

  12. Would it be best I do an inquiry with the consulate to confirm this?

    Or would they not be able to provide me with the information?

    Just to be on the safe side, I will re-do all my documents again. I already asked my fiancee to get me her Tax forms and we are working on re-doing it all.

    I did see on the ais.usvisa-info.com site to set up my appointmet that I do have to pay 265 USD again to set up a new appointment. My only worry is, if I should do a new DS-160 since I can see on the ais.usvisa-info.com that they still have my previous DS-160 receipt number

    That is the only thing confusing me :/

  13. No my case is not found on that page but the letter I got was the same one that I first received when my I-129F was approved. It said to fill out the DS-160 and follow the instructions for the I-129F and stuff like that.

    Does this mean I have to do a new DS-160? A new I-134 Affidavit of support? New letters from me and my fiancee that we still want to marry?

    Pretty much, do I need to re-do my I-129F packet?

    Furthermore, I dont think I would have to pay for a new I-129F do it?

    I am beyond confused right now!! :(

    I really want this to be smooth and that there are no further issues with this process

    A few weeks ago, I received a letter from USCIS that my I-601 Waiver was closed because the Consulate in Ciudad Juarez had withdrawn the Inadmissibility on my case. The reason is that I was subject to a three year ban but it so happens that on February of this year I reached three years being in Mexico so the Consulate withdrew my Inadmissibility. I have now received the letter from the Consulate asking me to set up a new appointment with them so I have some questions that I hope I can get answered here :/

    1.) Do I have to re-print my DS-160 confirmation letter or start a new one?

    2.) My fiancee's dad is my affidavit of support, should I ask him for his Tax Return form again? My last interview was a year ago?

    3.) Do I have to preset more proof of our relationship since my last interview?

    4.) Would I need a new police certificate?

    5.) Do I have to take my finger prints again?

    Any information would be really helpful and I would really appreciate if anyone can share their story if they have gone through a similar process!!

    I am not sure if this issue has been addressed in the past or if anyone has dared talk about, but I want to know what everyone thinks.

    One of the main issues about being in a situation like this is the way it affects your relationship. For instance, what happens when you can´t see the person you love for more than 2-3 moths? Does it kill you inside? does it kill them inside?

    There are things in life you can´t fight alone, and in a long distance relationship you should both work together, but what happens when one of the two is not fighting for the relationship anymore? Is it time to give up on that person? or it is time to try even harder?

    One of the things that I can honestly tell you about my own experience is this, I love my fiancee with all my heart and I would do anything for her! Since the first time I decided to leave the US, she stuck with me through thick and thin and it seemed that our love couldn't get any stronger. We would be apart for 6 months and it would not matter because we were so in love.

    Then, after time, my fiancee started college. Yes the prime of her youth! She joined lots of clubs and took many units to try and finish her school faster and she also joined a Sorority. I had no issues with it and I am very proud of her but slowly, little by litte, I noticed the change. She was different. It is true that as you get older, you mature and so should your relationship. Of course I knew our relationship could not be a cheesy high school thing and it would mature but to my surprise things drastically changed.

    We would talk less and less everyday. She would go out with her friends, she had school and a job, while I´m stuck down here waiting on the approval of a waiver. Talking about marriage frustrates her now and although she says its because she doesn´t like getting her hopes up, I can just feel that she does not like talking about marriage and she doesn´t get as excited about it.

    I feel as if I have to beg her to talk to me sometimes and it sucks because I am really all alone down here. Don´t get me wrong, I don´t seek attention but there are times where the only person that can make your day, just tells you she/he has not time and it sucks.

    Anyway, my dilemma is this...she tells me that she loves yet, I don´t see it, and many people can say that it´s hard for her to show me love when we are not together but that was not an issue back then...I still love her very much and I would be willing to do anything for her. We have been approved out waiver and can now go back to Juarez to finish my process but I just don´t know if it will be worth it in the end. I come from a family where marriages have lasted decades and I look up to that, so it scares me to think that it may not work out.

    Thank you for filing form I-601 Application for Waiver of grounds of inadmissibility
    We, US Citizenship and immgration services (USCIS) on September 12 2014 under section 2 12 (A(9(B(B) of the immgration and notionality act (INA)
    After thorough review USCIS must inform you that we are closing your application as explained below:
    On march 11 2015, the US embassy consulate CD Juarez informed USCIS that they have withdrawn the inadmissibility determination and you no longer require a waiver under INA Section 2012 (A9 Bill) consequently USCIS has terminated all actions in this case and notified the consulate.
    If you have any questions about visa issues please contact the US Consulate Juarez"
    This is roughly what is says but what does it mean?
  17. I had my consular interview in Ciudad Juarez on June of 2014 for a K-1 Visa and was denied for an overstay. I then applied for the I-601 for Waiver for grounds of inadmissibility. My fiancee and I sent our Waiver packet in September and it was received on September 12 2014. It has been 8 months and we have not heard anything from USCIS and when I check the site it only says that my case was received. I already sent a form for my Local Senator's office to get some information on my case and I am hoping for good news since my form has gone out of regular processing times. Anyway, my question is, after and IF the waiver is approved do I have to pay a new fee for an appointment at the consulate again? I have checked at the website to make the consular appointments and it states I need to make a payment for 200+ dollars but I already have a case in Ciudad Juarez and I was informed it is still open, so I dont know if I have to pay again, or if it may be a mistake from them?

    Can anyone maybe give me any info on this?
