Thanks again everyone.
We (I) have tried all approaches to break through. She has resisted every effort. Paper tickets for int'l flights had to be issued and delivered. These 3 days were too much for her, but unavoidable. There is no negotiation on her part.
She flies home and that it that.

I just wanted to make sure that there would be no INS issues on her way home.
Way to use the timeline function everandel! I can only think that the relationship link was too thin (obviously), and that the 5 extra IMBRA months got in the way. I could allocate her response to fear of the changes in her life, or someone else in the wings...
As she describes it, it is everyone and everything she knew and loved that are "in the wings." No linear, rational, Mr Fix-it Guy thinking can take that on. And where there is no faith.......

So, my fiancee wants to go home. Cannot envision a successful transition and has demanded to return home.
Yes, I am heart broken, but no need to try and push this rope any further.
Question:
Other than buying a return trip ticket, is there any immigration associated steps to take.
She is K-1, Ukraine, still within 90 days.

I filed the I-129f April 3rd.
I answered "no" to all the anti-social characteristics they were interested in.
I have no idea what they found during their security checks.

Well it looks like I am one of the first to make it thru... I feel kind of like survivor of sorts, not really sure what to add...
1st, based on the data table (so far)..

As for the experience:
Once the petition was sent from NVC there was no acknowledgement from Kiev for like 2 weeks. Then out of the blue my fiancee gets a phone call with the interview scheduled for 9/18 @ 9:00 am. No packet 3, and no packet 4 sent out! Fortunately, we had all the elements for packet 3, and the Embassy folk helped fill out the actual DS 156 forms. Very Nice.
There were no questions about IMBRA other than my fiancee's complete responses to how we met. (Thru an agency). There were no questions about my past. It was like IMBRA never took place, except for the time loss....
Nov 1st I go to kiev to fly with her.

I answered "yes" to the Agency question. Had no additional inquiry into the case at VSC, NVC, or Kiev Embassy.
My Fiancee had her interview 9/18. She passed. (of the 8 who were there with scheduled interviews, only 2 passed because their packets were complete! Go VJ!!!)
There were no Agency specific discussions other than when she responded as to how we met. There was no line of questioning about my (presumably sordid) past.
Perhaps the true thumb-screwing and iron-madening will begin after the purchase requests have been authorized with FY2007 money.
In all IMBRA ate up 6 months of our life together and denied us the Summer of (love) 2006. Far worse than thumb screws....

I have a what if for you all...
What if my fiancee, who does not yet have the notarized document from the father, gets her K-1 and comes to the US? I know there will be no K-2 issued.
Say on a return trip, perhaps on advanced parole, we entice the father to create one of these documents. Would the child (3 yrs old) be eligible for follow-on? Would it take my then wife getting her AOS complete and then filing a I-130 ?
Clearly it is best to get these documents before hand.

My application was touched 1 time from VSC receiving the RFE and the application approval.

Based on my 1st time thru the NVC (Our application was sent back to square 1), and assuming there will be no additional security checks (no new information to check), it took about 8 days to leave the VSC, process thru the NVC, and arrive in Kiev.
Good luck waiting. I hope you are plesantly surprised...soon.

My Fiance would like to bring her 3 yr old son over after we have been married for a while. A visit to an immigration lawyer gave me the following scenario.
Has anyone lived thru this or anything like it? I also have a few questions...
K-1 visa request process.
Fiancee gets here, we marry.
Request AOS.
Petition for I-130 immigration request for follow-on-rights.
Son's visa issued.
Family whole once again.
(Assume all custody paperwork is complete and acceptable for UA and USA govts.)
Questions:
1. Does the son's information go on the I-129f (as if he were arriving with her?), or can we generate "his" package separately?
2. Can we petition for the I-130 right after marriage, or do we wait for a specific piece of paper before applying?
3. Any time duration guetimates for this approach would be appreciated.

Found out answer.
Went to local airport with connection thru Dulles (IAD). The ticket agent (for United) took the i-94 from the passport and stapled it to the IAD - VIE boarding pass. The ticketing agent in IAD, the one who gives you the little boarding pass stub, will pass the i-94 onto immigration.
I will now "sit in the ashes...."
