  1. Is your husband a US citizen or permanent resident? Is the child your husband's child? Also, why does your profile say K-1 when you are filing I-130? I-130 are for people who are starting the process who are already married; it's not for people who came on K-1s.

    Yes, My husband is a US Citizen

    No, my child is not my husband child

    My profile shows K1 because I was under k1 before. Due some personal reason I left United States after I sent my Adjustment of Status withdrawal Letter.

  2. As your fiance daughter, she can bring her to the state under k2 visa as her derevative. Just include her name at 129f form. It's no problem with that. I myself brought my son ( k2 visa) to the state. I just paid our visa fee together ( separate fee each applicant) we went to medical together , separate fee for us too. Attend the interview together. Everything went well. Visa issued after 10 days of interview.

    As of adoption it's really good idea to do it at USA than here in philippines. Plus the fact that no father listed to her birth certificate.

  3. I'm not sure but I think he'll have more issue with the domicile thing rather than the length of stay here in the Philippines coz as you mentioned he became a permanent resident here. He has to show proof that he intends to re-establish domicile in the US.

    I kind of got confused with your post. Were you a previous K1 filer and now transitioning to CR1? Coz you mentioned you got married in California. Correct me if I'm wrong. Hopefully other VJ experts here would have better insight. :)

    Yes, we will re-establish,one of the reason why he go back there first.

    Yes, I was under k1 visa last year when i went to USA and I live there for 6 months. I applied for adjustment of status after we got married but we decided to come back here at PH so I withdrawn my AOS application 20 days before my green card interview.   4. I am here again to gather information about DCF.

    We came back here at Philippines from USA last year September 2015 and my husband follow us October 2015. We got married at California.

    Exactly 7 months this May 2016 my husband left and went to USA for 2 months visit. He thought that his 7 months of staying here is counted if we file for DCF at manila once he come back this July 2016. But someone told me that we are back to zero in Residency requirements for DCF, is it true?

    (My husband is Permanent resident here at Philippines since 2009, we thought he don't need that 6 months residency required but i guess we're wrong about that)

    I would like to have more answer and opinion about this matter. Thank you in advance. :idea::idea:

  5. Well, the thing is, just scheduling for appointment at the DFA is tight.. nothing's available until July. Oh well, I'll just try my luck at the interview and see what happens (finally got my case number, had medical and visa interview scheduled already). I'll post about it here in case anyone else runs into the same situation. :)

    Hi sis. Hopefully you can update me about the process. Me too will use my maiden name in our spousal visa petition soon. But wondering the pros and cons of having a single name in my passport. I will follow this post for future references. Thank you. ?

  6. If renewing your passport here and you'd like to use your husband's last name, you have to attend the CFO seminar first. That is one of the requirements for passport renewal

    I have CFO certificate from k1 process before. They told me that's lifetime certificate. I still have my cfo certificate. I decided not to file Report of marriage at DFA manila.seems so complicated since we got married over a year.

    Our plan is to file DCF.. but someone told me once my husband left the country, we're back to zero of residency requirements. My husband stayed here at PH for 7 months but just left the country this week and will be back here after 2 months. So if it's true that we're back to zero for residency requirements, maybe he will do the I-130 petition at USA ??

  7. Hello guys. Me and my husband is married at USA. I went there under k1 visa, got married and filed for Adjustment of status. 20 days before my green card interview I withdraw my application. Me my husband and my son move back here at Philippines. Now my question is, can we file DCF using our marriage contract from USA? I didn't do report of marriage by the way.

  8. Hello everyone who has the same case like this. How what is the process of petitioning your adopted child. The child was 17 yrs old when they start the process of adoption and just finalize recently, now she's 19 yrs old. Can they go ahead and file I-130 or there is specific rules they need to follow first after adoption before they can file the petition?

  9. I am the applicant for I-485 application for adjustment of status. my interview supposed to be was sept.24,2015 and I sent them my withdrawal sept. 3, 2015 tjen.left the USA the next day.

    I change my address so.if they responded I still get it.

    Well the uscis status doesn't always change so don't go by that. Have you called? For when was the interview scheduled?

    I did not called, coz I am back in my country. expensive to call using regular load. :)
