  3. I want to share my personal experience with everyone, in case it could help anybody that is/has been in the same situation as I was.

    Short story:

In February 2014 I travelled from Spain to NJ. When I arrived I was stopped and questionned at the POE so the CBP took my phone and read that I had worked, and I admitted to this, so then they denied my entry into the US. They took my fingerprints and photo and put me on the next flight back to Spain.

The CBP gave me a copy of my statement (Form I-877) which says: "You are inadmissible under the section 212 (a)(7)(A)(i)(I)... because you engaged in the unauthorized employment..." And " You are being refused under 8CFR217.4(a)(1) Visa Waiver Refusal..."

He stamped the following in my passport: "VWPP Refusal 8CFR217.4"

My statement doesn't anything about an Expedited Removal or Misrep.

When I went to my interview the Consul asked me what happened at the POE and after telling him what happened he told me: "Aah ok, no problem! I'm thinking about approving your Visa ." So I told him; "What!?" I was puzzled and asked him: " So, how come there's no problem with this? Because I've been very worried about this." Then he told me; "Don't worry, what you did is not important , it's something very common and happens on a frequent basis."

I was in shock, I couldn't talk ( he, he). The Consul just smiled at me and congratulated me.

He was very kind to me.

I'm SO SO SO HAPPY because I don't need a waiver.

Thank you all and good luck to you future apllicants!

  4. Purpose of Form i212

An alien who is inadmissible under section 212(a)(9)(A) or © of the Immigration and Nationality Act (INA) files Form I-212 to obtain "consent to reapply for admission" that is required before the alien can lawfully return to the United States. "Consent to reapply" is also called "permission to reapply."

I think that not need this form because apply only for section 212(a)(9)(A) or © and my section is 212(a)(7)(i)(I)

    Im right??
