    O.M.G thats crazy! I guess i can just apply for citizenship in Feb then! 

     

     

  2. Does anyone know if the first letter stating that the i-751 package was received and i have been extended for 1 year is the first NOA

    I went and did Biometrics but haven't heard anything since. 

     

    I just checked the processing times and its pretty much 1 year backlog. I am so sick of immigration. I just want this to come through so i can throw out all the paper ####### I've had to collect for the last 5 years.

    You can use your expired green card (if it's expired) and the letter extending your status to show proof of legal status. If your employer participated in E-Verify you will show up as eligible.

    I wanted to avoid having to explain the letter, so I used my DL and unrestricted SSC instead, per I-9 rules.

    Awesome! Its with Apple, so I'm assuming they use E-Verfy.

    I submitted my application last week to the CA service center. They have cashed my cheque. 

     

    I have been planning on staying at home so i have never bothered to look into what happens in this interim period before I get my new GC. 

     

    I have been offered my dream job out of nowhere and will need to provide employment verification next week. 

     

    Does anyone know how I can get this sorted? 

  5. I think this is normal! I had my AOD interview on Wednesday and I could hear 3 other interviews going on around us. Not one of them got approved on the spot but were told they would get informed of an update soon. Noone seemed unhappy.

    We DID get approved on the spot but our circumstances are very different to most cases. We have not spent a day apart for the 6 years we have been together so there is just no way you can argue the legitimacy of our marriage.

    Im sure you can celebrate now!!! You will be fine!

  6. Its unlikely that you will get a copy nor would you need one really. The medical report will become part of the case file. The medical is hand carried by you until it is turned in at the POE when you enter the USA. That info is forwarded to whatever office you will have the AOS meeting in later.

    They will take it at POE and then at AOS they will already have it.

    I had my AOS interview 2 days ago and they just stated that they had it so its all done (even though i paid DOUBLE the cost of the medical to ensure I had an extra copy!!!) (I am stupidly over prepared)

    My interview is next week and I'm just wanting to get some feedback on my evidence.
    I've used an attorney the whole way so this is the first section we have had to do!

    A little back ground: My wife and I have been together for 6 years now. We met in Australia and she stayed! We got her perm residency there and never thought about moving to the US until DOMA was shut down.
    because we are BOTH starting again we don't have a lot of evidence. We live rent and bill free with her Grandma and live off our savings so have no income coming in.
    I don't drive (have literally never sat behind the wheel of a car) so am not on our joint car payments, etc.
    This is what we have:
    PASSPORTS
    BIRTH CERTS
    DRIVERS LICENSES
    12 letters from different gov orgs proving same address
    SSN IN MARRIED NAME for both
    WEDDING CERT
    2x JOINT CREDIT CARD (statements for both)
    JOINT BANK ACCOUNT INFO FROM BOTH AUS AND USA
    INFO RE OUR DOGS FLIGHT OVER SHOWING BOTH NAME

  10. If you've already legally changed it (which having it on your SS card would indicate), no need to involve the court. Hopefully it will be no big deal at the interview. Otherwise, maybe just hold off until ROC in two years and do it then. Or fill out form I-90 and pay the fee.

    Fingers crossed for the easy way, but there are plenty of other ways to do it. And yes, your lawyer is an idiot.

  11. Reading around VJ (you can do an advanced search with the toolbar at the top of the site), it sounds like you should be able to do it at the interview. As with everything, it's at the discretion of the interviewing officer, but should be feasible.

    Bring proof of name change and maybe new AOS forms to be safe (probably overkill). Definitely ask at the interview before they issue the green card. You can do it after submitted with form I-90, but it's super expensive!

    I'm please it doesn't seem like a big deal! I was freaking out id need to change it at court or something outrageous!!!

    Hoping a senior member can give me some clear info regarding my situation.

    I have came over from Australia on a K1 in Oct. I have my GC interviewing a couple of weeks.

    Our whole application has been done through attorney. He is a top immigration attorney and has been excellent. At the time of negotiating our contract we opted for not having assistance with arranging the AOS interview. Stupid, since now is when i have all the questions but i refuse to pay $375 for an email convo.

    SO....

    ALL of my applications, including my AOS have been in my maiden name. My SSN is in my married name and I wish to get my green card in my married name but now I think its to late?

    Will I have issues because I have changed my name and still applied for the application in my maiden name?

    I do not know why my attorney did it, he knew we changed names but said that it would be changed after...? (I just went with it)

    Can anyone give me advice on how this will move forward? Oh and i don't think it will or should matter but its a same sex wedding.

  13. That's part of the reason some of us choose the CR1 route even though it's longer to visa.

    God I wish we did that! At the time getting here quicker was more important. Oh hindsight!! My wife came with me from Australia so she hasn't got work either. We're going crazy!! There is only so much hiking this lady can do and 5 times a week for a month is MY LIMIT!! Lol

  14. I was there today. I was in a small town in SoCal and there were at LEAST 100 people in the line. There are no separate lines for legal/undocumented, everyone goes in the same line.

    It took me a month to get an appointment. I got there and can't even get my drivers license as in only in AOS stage. Cannot be more annoyed.

    These people were waiting HOURS to get seen and most were getting turned away. It was CRAZY in there!!

  15. Has anyone been denied the AOS for lack of proof? My wife does not work and we haven't and don't plan on going through the hassle of adding her name to any of the utility bills etc. Really no point in the big scheme of things. I provide and take care of her, she is a housewife and helps me with my businesses.

    So, with her drawing no income, the joint bank account would simply be me depositing funds from my businesses, again seeming pointless.

    Our marriage is as real as it gets, but how do you prove that without the trivial proof that everyone says they look for?.....which would be of no benefit to our marriage......and that can so easily be fabricated anyway.

    We are in a similar situation.

    My wife has been living with me in Australia for 7 years so we have no ties to the USA. We are staying with her Grandma, we have been given a car, were still using our AUS bank accounts due to bad exchange rates, etc.

    We have NO evidence.

    It worries me but I'm just trying to join things like costco to get 'joint' accounts

  16. Our wedding is on the 16th may and my visa expires on the 24th may so we'll be submitting the AOS immediately after the wedding. When is the best time for me to apply for the ead?? I know to wait 10 days after my arrival before I apply for SSN so that's covered. Just wondered like I said when is the best time to apply for the EAD? Thank you guys

    I just arrived a couple of months ago and have just gone through all of this.

    You can get your SNN as soon as 10ish days. If your changing your name after the wedding its really easy to do after, just a basic form.

    You have to apply for AOS/EAD/AP all together after the wedding once you have marriage license, etc. Its aprox 90 days after biometric that your EAD will be approved, for me, that added another month on top of the wait.

    TIP: As soon as you get here start getting stuff in both your names and piggy back off your husband/wifes credit cards to try to get credit and evidence for AOS.

    I have AMAZING credit in Aus but i can't even get a bloody phone plan here.
