  1. Administrative Processing is mostly terrorism checks. Whether you believe it or not, that's what it is.

    If you search Administrative Processing on these forums you will find scores of people who have been affected, most of them from the regions I mentioned. Most AP is cleared in a few weeks; in some cases it can take a few months; and very rarely it can take years. I have read of a couple of cases here where the wait due to AP was 5+ years; I believe in both of those cases the beneficiary was from Pakistan.

    I got my EAD in a normal timeline and got approved for the green card right after the interview and received my green card yesterday. I just wanted to let you know there is no terrorism check (!!!!) whatsoever for anyone from any part of this world. So next time, don NOT say anything if you don't have information about it or if you only follow FoxNews' craps!

  2. If you're earning your wages legally in the U.S. then yes you can fill out the affidavit of support yourself. You'll have to show proof of such though with copies of your EAD or valid form I-20 together with your affidavit.

    Thank you for your respond! I will include a copy of my I-20 with CPT authorization which shows and proves my legal work authorization.

    So should I fill out a separate I-864 by myself and my wife fill out another one? or should we fill out just one form?

    By the way, we are going to ask her stepfather to be our joint sponsor to make sure AOS goes well. :)

  3. I found my answer from USCIS website and I can do use my salary as an sponsorship which as what I want :)

    USCIS:

    • You may count the income and assets of members of your household who are related to you by birth, marriage, or adoption. To use their income you must have listed them as dependents on your most recent federal tax return or they must have lived with you for the last 6 months. They must also complete a Form I-864A, Contract between Sponsor and Household Member. If the relative you are sponsoring meets these criteria you may include the value of their income and assets, but the immigrant does not need to complete Form I-864A unless he or she has accompanying family members.

    But when my husband file I-485 what kind of proof does he attach to the application? Approved I-130 petition (it is written there that it is "Approval Notice Section: husband or wife of permanent resident) or a copy of my naturalization certificate or both?

    P.S. I don't know if it is important, but he is here with B visa, not K or anything based on our marriage.

    Try to include a copy of anything you think it would be helpful. By the way, calling USCIS prior to the documet submission could be helpful too. They usually answer quickly and you can ask every question you have in your mind. If you calk them tomorrow, you can make sure what documents have to be submitted.

    I have a kind of similar question, I've filed I-130 in April 2014 while I was LPR and it was approved and I became a US citizen while my husband has been waiting for PD to become current. We received this welcome e-mail from NVC how to proceed with the Embassy. I've sent all papers to NVC telling them that I am US citizen now and that we are both in the US, but I know it takes up to 60 days to get an answer.

    Can my husband file for the AoS without any answer from the NVC?

    You dont need to wait for NVC to answer you. You can immediatly fill out forms I-485 and i-131 and I-765 to USCIS.

    They will contact NVC aand ask to return your documents from NVC to USCIS

    I have successfully completed my interview on 10 June in Islamabad Embassy, Pakistan. They told me that my documents are completed and now wait for 10 days, they will call me in 10 days to pickup my passport.

    I just want to know if anyone, who has completed the interview process in June, received the call about passport pickup.

    Please help me. tell me why they are not contacting for passport pickup. how long will it take them to call for passport pickup?

    you had your interview 7 days ago so 10 days has not passed yet. So be patient and don't easily freak out. They will contact you even if it takes more than 10 days. Be cool!

    I have a question.

    I am going to fill out the from I-484 to adjust my status. I have applied for green card through my wife who is permanent resident and we both live in the US. ( I have f-1 visa)

    so I am wondering if I fill out the forms I-131 and I-765 at the same time of filling adjustment of status do I need to pay their fees to or I just need to pay $1,070 for three of them? The reason I asked it because I found the following sentence in USCIS website:

    "if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. "

  8. Thanks Franklin, one more question, what is a tax return?, I got transcripts and w2, but where am I gonna get a tax return?

    Tax return is the form that you get when you finish your tax return process. Since for this year, many of us recently submitted our tax form, tax transcripts through IRS is not available yet. So you need to have your tax return form for this year if you don't have it's transcript via IRS.

  9. You just have to keep trying again and again. Time is 5pm right now in my time zone GMT +1. I usually CALL exactly 12pm GMT+1. It's goes easily. Just that you'll have to wait on the queue for about 30mins.

    So you usually call at the first hours of their operation times. To me it is a little bit challenging waking up at 6 am (Central america time) and call them, though seems like I have to do it. :D

  10. Write D/S or Duration of Status.

    F-1 students stay based on I-20. If you look at your I-94, it also says D/S or Duration of Status.

    So write D/S or Duration of Status.

    I forget, is there a place where they ask for visa expiration date and another where they ask for I-94 expiration? Technically, the I-94 is D/S, the visa is - whenever it says on the visa.

    My I-94 was actually expiring before my visa (long story) when I applied XD

    I could dig up my forms, but I'm too lazy ATM. I will if I REALLY have to.

    As I know there is no place asking about I-94 expiration. I think as RnZ said I need to put D/S on visa expiration date.

    I am preparing form I-485 to do adjustment of status and I have a question.

    I am f-1 (student) visa holder and I have been studying in the US for almost three years and I got marries here. As some of you know, student visas are expired in few months or in a couple of years after their issuance, although it doesn't mean staying in the US is illegal as long as students enroll as full time student in their universities. So, I am totally ok to stay in US legally. Now that I want to fill the form I-485, what should I enter as the date of my visa expiration. My student visa expired on Summer 2012 (3 months after I got my visa) and my I-20 from the university is valid until May 2017. now, I am wondering if I put the date my visa expired, it confused the USCIS counselors about me staying legal here or do they know about student visa situation?

  12. is your spouse a uscitizen?

    if yes, get the I-485 in now.

    if no, wait until yer PD is current, then file the I-485. Before then, you must maintain yer current visa status. Can't do it? You must leave USA, then proceed with further NVC Processing.

    as to NVC, you can ignore them for now, up to 6 months or so.

    When the I-485 hits USCIS, the casefile will be moved from NVC into USCIS.

    My wife is permanent resident, but she will apply for citizenship next year. I can stay in the US for at least two years (by the time I finish my PhD) and then I will be here for work, however, I think I can get my green card in less than a year (if everything goes normal).

    As you said I will wait until my Pd gets current (most probably in less than 6 months) and then I will let NVC know that I am doing adjustment of status by USCIS.

    Administrative Processing was introduced by the PATRIOT Act, and is basically terrorism checks. It is predominantly performed on people holding citizenship from Middle Eastern countries, India, Pakistan, and countries such as Iran, a regime hostile to the US.

    Not saying that will happen to you, but it might. If you got your F-1 without issue then that's a good indicator, but it's certainly no guarantee.

    No one can say terrorism check to any other country. So this has never been the case neither for Iran nor any other country in middle east. Though, USA has FBI police clearance check which basicaly is for all people. There might be a chance that for some countries this process would take some time but dont get confused by terrorism check which has never exist. This is totally againts the human right and accusing People of some countries(!!!!) to be terrorism and American government knows that. So dont listen everything that medias say!

    Many of my Iranian friends get their Visa in their interview right away and many of them here got their green card through adjustment of status in just 3,4 months. Even they got their citizenship (when eligible) in less than 6 months. My wife who is also Iranian got her visa at the same day of her interview in us embassy at turkey.

    Anyway, thank you for your help.
