  1. I am submitting an application for Naturalization (N-400). I am having trouble with this evidence I need to provide:

    If you have legally changed your name, upload a readable image of the legal document that formally changed your name. Some examples include:

     

    • Marriage certificate
    • Divorce decree
    • Court document

     

    I came to America on an i-129f - K1 fiance visa. After we got married I submitted an i-485 to get my Greencard. My marriage certificate does not include a name change because the state I got married in did not do them there. So my marriage certificate has my maiden name. I put my new name on the i-485 and my Greencard has my new name.

     

    So I am not sure what form to submit here. Any assistance is appreciated? 

     

  2. Hello.

    My wife and I went through the K-1 fiancee visa process and she got her green card a few months ago. We just moved to a new place. The address USCIS currently has on file is my parent's house where we still can get mail as we visit it often.

    Do we need to update USCIS with the address of our new place or can we leave it as our parent's?

  3. To keep things simple I will summarize:

    • I am not a lawyer and this is just a recount of our experience. I can't be held responsible for what happens to you.
    • I am an American citizen
    • My (now) wife is an Indian citizen
    • She had a valid tourist visa from before we met
    • I submitted the I-129F on 2014-04-05
    • I wanted her to visit so we could do some house shopping
    • I contacted the immigration officers at the airport she would arrive from and explained our situation
    • They told me that as long as she had a valid tourist visa and was going to return they would let her in
    • I repeat, as it was their only concern: she had to prove that she was going to return
    • We bought plane tickets for her to arrive 2014-09-13
    • On 2014-08-26 I got her NOA2 saying her application was approved
    • I called the immigration officers at the airport again and they said she can still come
    • She came on 2014-09-13 and the immigration officer asked for evidence of her return and she showed him a copy of her return ticket (on her phone)
    • She returned a few weeks later to complete the visa process

    Long story short, it is possible to enter America on an existing tourist visa with a pending/approved I-129F as long as you can prove to the immigration officer that you will return. I think it is at the discretion of each immigration officer but I spoke to ours before I bought the ticket.

  4. She can come and go til she has the K-1 stamp. Only thing is, it's at the discretion of the officer at entry, so she should make sure she has lots of proof of ties back home, to prove she'll leave again. Return ticket, statement from job, bank accounts, owned property, other obligations, etc.

    We have a return ticket but she doesn't work as she takes care of family. I think she has property she owns so I'll ask about that.

    So you do not think there will be any issues with the interview with the fact that she came to America for a few weeks?

  5. I am an American citizen. My fiancee is Indian and has had a multiple entry tourist visa since before we met. I applied for K-1 fiancee visa a while ago. I wanted her to come here while it was processing so we could look at houses. I confirmed with the airport CBP that as long as she has return ticket to show she will return to finish the process and that she is not planning on adjusting her status while she is here that she can come in. So we bought a round trip ticket. Well, according to http://uscis.gov/ our application just got approved. I'm expecting the NOA2 in the mail in the next few days. Since we already bought the plane ticket I'm wondering if there will be any problems with her coming and returning as planned. I called the airport again and they said since she has a tourist visa she can come in.

    1. Since our application got approved, would her tourist visa be marked invalid? I understand it is up to CBP to let her in but I want to make sure other then CBP there are no other factors.
    2. Once she goes for interview at US Embassy in Mumbai/Bombay, will they have a problem with her visit to America?

    We already bought the tickets so we want to use them if we can but if the risk is too high then we won't.
