Thanks for the replies guys. I already told her to seek help from an attorney and even gave her the list of community centers that might offer pro bono immigration help. I spoke to a law student [actually already finished but not yet passed the CA bar] who worked for an immigration attorney and he said that, due to the fact that she already got a notice that they abandoned the I-751 and that she had to respond in 30 days, she might not be able to stay in the US if he files for divorce now.

Is the motion to re-open can only be filed by the US citizen/petitioner? If she can self-petition, should she have to wait until the divorce is final?

- the couple received a letter asking if they are abandoning their I-751 because they did not respond to and RFE

- they filed the Removing Conditions in Nov 2009, did biometrics, no RFE was received

- the letter says they can file Motion to Re-open must respond in 30 days

- they have new evidence, 2009 Tax Return, Insurance info, bank records

- they have been living separately after they filed the I-751 but their relationship was amicable(she moved out because they were living with his parents. she does not get along with the parents and he does not want to move out. now his family is telling him he can be charged a felony if he helps her with the Motion to Re-open.)

- he (the US Citizen) wants to file for divorce and refuse to file Motion to Re-open

what are the Conditional Permanent Resident options? she already has a full-time job and does not want to go back but if worse case scenario she will.

There's a huge difference between the women who marry Americans to get a green card (and a credit card) & then dump him the day after they get their citizenship vs. the women who are looking for love & a better life.

I was curious, after my bride "found me" on PenPalNet.com, how many Filipino women were looking to contact American men. So, I just checked for 18 year old girls from the Philippines, and there was 18,000 profiles, compared to a few hundred for men in my age group, 41-50 at the time. That was over two years ago. Numbers don't lie and there is desperation there. That all of us on VJ found true love is either a miracle, or a testament to the determination of the ladies of the Philippines.

granted...the 18,000 profiles may have duplicates or triplicates...so we can't rely on that....but the numbers mentioned in the article has credibility...and those numbers don't lie. the increase is alarming...i agree with bullwinkle.

not one filipina here in VJ would ever admit to have married a USC for economic reason, albeit not the only reason but a major one...and not one USC will ever say that their Filipina wife married them for that.

I am not an American man but I know stories too. Well, I know one guy who went through Filipinaheart site to find a wife. He's Filipino-American and he did meet someone, the girl was much younger [10+ years] and cute...fast forward, he went home to visit her for the first time...turns out she was two-timing him. She had another American boyfriend [this time Caucasian] who answered her cell phone while she was in the shower. The Fil-Am guy was sending her about 600 bucks a month...I don't know if she asked or he just wanted to send it to her. I did not asked him why. Anyway, he's with another Filipina now whom he met while vacationing in the Philippines. Other than that, the American men [not just Fil-Am] I know who are with Filipina women are...one whom they met while visiting the Philippines or the ones they met while the Filipina was in the US [usually for work, school...I only know one who was here as a Tourist, met a guy, went back home to Philippines waiting for their K1 visa to get approved...fast forward...they have a child together she is now US citizen.]

I was in one of those Comedy clubs in the Philippines and the comedian would go to the audience to chat with them and get them in the act. The comedian went up to this White guy [he was British, older ] with his Filipina wife [not that young but younger than the guy] and talked to them and stuff...anyway, before he left them he said something in Bisaya to the woman..."you better be careful 'coz he might kill you and bury you in cement under the staircase!"...of course he said it jokingly but I hear that story a lot. The fear that the man they meet online will be abusive...and worse...will kill them. Well, it's not just a rumor really...for some it actually happens. Fortunately, for most, it's the complete opposite.

i am not including any affidavits, my understanding is...it's optional...and only if your other evidence are not strong enough. in any case, if they do request for more evidence, then we'll send them. the one evidence that i should have but i don't have at this time is our lease agreement. i verbally added him when we got married but we have not made an appointment with the property management to revise the lease agreement.

i think my evidence are pretty strong and they span the Jan 2007 to Dec 2008 period (bank statements, beneficiary info, letters, pics). so it goes...good luck to us all!

Thanks for the passport copy response. I decided to add the pictures, so it's not going out until tomorrow [we're a week later from the 90 days but oh well]. I took 1-2 pics from each vacation and events with friends and family [it spans Feb 07 to Dec 08] and it added up to 10 pages. Printed it with 2 pages per sheet and it looks alright. Thanks again! it's tough to get use to the smell. you probably will never get use to it. you have to kinda have it "ingrained" into your DNA somehow to find it good to eat. comfort foods are usually not that good to anyone else who don't think they are "comfort" foods. recently, my husband had to eat mashed potatoes for a week ( 4 wisdom teeth removed at one time)...he said he can't even swallow it anymore. he can't stand eating potatoes everyday.

i use to like it when MSG is added to food. it's very common in the Philippines. it really is good in salvaging dishes 'coz it can literally make any dish delicious....but i realize now that everything that has MSG in it tend to taste exactly the same...MSG! it has a distinct taste and i can really tell when it is present in food.

i don't know why salty foods but it's a nice balance to the white rice. you have to it all those stuff with rice...it's the only way.

know, just stating some facts about my wife because I'm married to a Filipina. It is funny though. And i forgot to include that she eats dried fish and rice ( i call it bait fish with her hands, dip it with vinegar with garlic. I just love watching the satisfaction on her face.

which is why it's considered comfort food for us Filipinos...it brings back memories when you were little and to a place where eating it was not considered weird...and you MUST it using your hands!

somewhat true...i originally had 3 middle names...now i'm only using 1. for Filipinos, it is customary to carry your Mother's maiden name as a middle name. add to that, they usually put Maria as one of the "First" names...and then your "Real First Name" plus a second one...just because. lol. my husband's friend's son is named Z (that's his real First Name, not an initial) and the couple is Filipino.

best to cancel your existing K1 and refile once you get confirmation of the cancellation. also, you might need a heart to heart talk with the fiance. an annullment is not something that you just find out like you just found out her favorite shoes or something. it's a big deal (for a lot of people). good luck anyhow! life is short...so do what makes you happy.

we're driving to tecate, mexico this weekend. the mexican visa requirements are only for Phillipine citizens that are non-GC holders. for US GC holders, the GC + Philippine passport should suffice. i'll respond back if it isn't.

you should check to see if they've responded. i highly recommend that you follow their steps. it's very helpful although you might have to wait a while for a response. Lavasoft works this way...you post your problem with a HiJackThis log...they give you the first solution..then you post your latest HiJackThis log...then the next solution and you again post the LOGS they requested...and so on and so forth...depending on your problem. i think your problem is very simple and can be easily resolved. i had more problems than you and mine only took 2 steps (downloading Combofix and other cleanup softwares). i tried starting over too and trying to delete everything but the bug is embedded in your registry and that needs to be tweaked. good luck on that though.

i did not understand the last part either...about if he has a better chance marrying his girlfriend in the Philippines than petitioning his niece/gf. is the gf and the niece/gf one and the same? i think if it's a valid relationship and they fill-out the part in the 129F application which ask if they are related...then technically they should be ok. the other concern would be if it is a valid relationship...or if it's an arrangement to bring relatives/families to the US faster. (totally possible...)

i'm not sure about the law in the Philippines...but i know that the current President Arroyo's first son married his cousin (i'm not sure if it's his first or second cousin...most likely second.)

my husband's close guy friend...let's call him E...is in relationship with his first cousin. it's been going on for years...and they have been dating behind their family's back....as they are against it. although monetarily speaking...it would have been great for their family! (they are old-money rich.)

yes Cathay Pacific is good and cheap if you purchase a round-trip ticket but their Cebu-LAX one-way is $1500+. cheapest one we got was Cebu-Manila-LAX one-way about $700 back in Oct 2006.
