  1. Nick-Nick has asked me to lend a hand and I will try and answer best I can.....

    Firstly go to the top of the United Kingdom and read the 'INSTRUCTION MANUAL' that has been put together. I have followed it religiously and it has been a great help. It's there for a reason................

    If the embassy did not receive payment electronically and if you paid cash then you need to check your bank account. If payment left your bank account electronically, I would email the embassy and request the necessary process to send in supporting evidence for a refund.

    You CANNOT send any information to the embassy without using the DX courier. If you log on to THEDX.CO.UK there is a contact page and give them a call. I am 100% sure they will help you. I have had a very recent similar experience and all went well if a little delayed.

    In summary, if at your interview you were given instructions to follow then follow them. Get the necessary paperwork to the embassy via DX and then wait for updates on the CEAC website.

  2. Brilliant! Hope it doesn't take too long to get to you now. I'm still on issued.

    Do you know if the London Embassy only sends out their couriers on certain days of the week?

    I have no idea.

    DX Couriers calls in everyday from what I can gather so it doesn't make sense if the embassy is hanging on to your visa??? Once it's issued, there is no further processing and it's just matter of DX collecting the visa from the embassy and delivering it back to you.

    Have you spoken to DX or the embassy?

  3. Since my interview I have been checking my status every day and it's being going like this (if it's any help):

    15th Oct (interview day): Ready

    16th Oct: Ready

    17th Oct: Ready

    20th Oct: Administrative Processing

    Today: Administrative Processing this morning and when I checked again at 1pm it had changed to issued.

    But from all the date changes on CEAC it seems they looked at/handled my case in some way every day.

    I hope you get some good news soon. It must be horrible when you think you're so close and something else happens to keep you waiting.

    My interview was on the 6th but didn't get approved until the 9th and had to resubmit my passport which the embassy received on the 14th. I am currently still on 'Ready' although I was in Administrative Processing from the 6th until the 9th inclusive and just waiting for it to be issued.

    I had my interview last wednesday and today my CEAC status changed from AP to Issued. I was wondering if anyone knew how long from being issued are you sent an email from the courier?

    I am waiting for my status to change from Tuesday last week. When did you notice the CEAC website change?

    Frustration is getting the better of me and thought I'd throw this out for best guesses. LOL

    Timeline so far is -

    6th October - Interviewed and put in administrative processing plus given passport back.

    9th October - Called by embassy and informed of approval and asked to return passport.

    14th October - Passport received back at embassy. (6 days ago)

  6. We just received our Visa/passport back today, took 10 days from the interview! We were very surprised it took that long but are very glad, we booked the flight for him to come tomorrow!!!

    I'm hoping for some progress tomorrow or early next week. Using your timeline as a guide, I should only be a few days behind you.

  7. 6th October - Interview and placed into AP (Given a 221g form with someone else's name on it!!!!! and given my passport back)

    9th October - Called by a Mr McClanahan from the Embassy and told I was approved and needed to send back my passport.

    10th October - Sent my passport by DX

    13th October - Embassy closed for national holiday

    14th October - DX confirms passport was delivered to Embassy and CEAC updates from AP to READY.

    15th October - Called Mr McClanahan at the embassy and he confirms receipt of passport and says it's on an officers desk.....

    All I am waiting for is for my visa to be issued and sent back to me........................

  8. Trying to guess what the updates are will simply just drive you mad...........................and you are wrong with your guesses as to the updates.

    Go onto the Embassy website and raise the question by emailing them. They state it takes 4 days to reply but I have had replies within 48 hours. Tell them your concerns and they will come back to you.

  9. I've not seen this situation before at London though I'm sure some of the VJ veterans have. Fingers crossed for you. Maybe they'll slap you with a misrep for working (it's their view of the situation that counts) then you'll be able to file for a waiver?

    My attorney is hot on it but the other issue is that they gave me an AP document with someone else's details on it. I don't want to go all the way through the account of the interview but there is some suggestion that the interviewer had the wrong case file in front of her hence the wrong details.

    What a mess.............

  10. Ok had based on your previous statements which indicated the working was linked to the January entry refusal due to messages on the phone.

    Did they say which visa you needed? The one suggested might aid in deciding if it was the emails about work or the fiance that led to the turn around.

    I went to the US when visiting my fiancé and went for almost the full amount of the vwp allowance whilst my k1 was in process. Only had extra questions when I said friend instead of fiancé, bad habit formed from talking to new people and the judgement I used to get when saying we had dated 11 years. Once I said that i was funding the trip myself in an obviously surprised and affronted tone they got super nice and wished me a good holiday. I was actually genuinely surprised by the question about who was paying for my trip as it hadn't occurred to me that they thought the us citizen would pay for it.

    Misrep is nothing to do with your relationship with your fiancee, it is short for misrepresentation. Misrepresentation can be both lying or omitting the truth.

    Boiler Thank you I wasn't aware that misreps could have waivers.

    The CBP office said that as I intended to marry a US citizen then I was no longer covered by the VWP. His concern was that I was not going to return home and stay in the USA. He did not indicate which visa I needed to apply for. The CBP officer was clear about the fact that I could return and said that his actions were in some part a #######-for-tat response to the number of USA citizens getting sent home from the UK.

    I had already been in the USA for 180 days last year (two trips) and I guess (and stress that it's only a guess) that he thought I was living there already. PLUS my turn around was 6 days after returning back from the USA to the UK. I flew back on 2nd January and flew back on the 8th January only to get sent home.

  11. Having said what I said - yeah, since you were consulting for a UK business - hmmm. I take it back, the legality is not so clear.

    That's what I have been trying to clarify.

    As I was a consultant, I was not hired as an employee by the US company but remained an employee in the UK. There was certainly no position that I filled that could have been taken by a US citizen. These are reasons why I thought it would not breach the VWP as it was all UK based.

    Needless to say, I did not go looking for a job as part of my visit to the USA.

Well he tried to get in on a vwp when actually intending to work, this in itself is misrepresentation (banned or not it is still misrepresentation) and whilst he does not appear to have been given a ban at poe the embassy may consider that to be the correct action and deny any visa that comes through.

    Your statement is false.......

    I did NOT try to return in January to go to work as there was no work to go too plus I have a job in the UK anyway.

    I was told by the CBP at POE in January that I would be allowed to return with the correct visa.
