  1. Just an update with info received from service center via congressman's office: as soon as orders are in, filing straight for N-400 only.

    Really? You get to skip removal of conditions? If so, that is awesome.

    However, since the instructions don't seem to mention any of this, I'd advise you to double check that. I know the advice was from a congressman and all, but I'm kinda curious that they let you skip the removal of conditions.

    Stefanie, you're actually behind the CSC processing dates now, you should get in touch with them. It might be tough doing it from overseas (if you are still overseas), but probably good to inquire.

    I can't thank you enough for the reply and advice. Yes, I did read the information on removing conditions, which is what alarmed me. I found a good cross border tax accountant and he has recommended a good lawyer for us. We'll see how it goes.

    This is not directed at anyone. I need to vent. - it is so disappointing when you put your trust in people that you pay good money to, you ask questions from people who are supposed to know the answers (including border personnel), you do you very best to play by the rules and comply, you sacrifice and endure cost, stress, and so forth to play by the rules and then WOMP. - So when I hear other "immigrants" who knowingly enter illegally, whining and DEMANDING that they get this, that and the other thing from "America" because it is their right(?) I want to scream. What's good for the goose should be good for the gander. And by the way, doesn't the fact that I was born and raised in the US, that my entire family is there, that they have paid taxes there since they turned of age, have any bearing? Should I not have a leg up?

    Another case in point, when I moved with my daughter to New York State (this was supposed to help speed up the green card process for my husband, per the lawyer we used), I worked and kept a bank account. After TWO years I could not get a credit card for $500 and last year (give or take six months) some bonehead at the Bank of America decided is would be a great idea to give all the Mexican immigrants $500 worth of credit!?! Well, it never went ahead, but what hypocracy.

    Here in Canada, many immigrants get so much stuff for free and get all the help in the world navigating bureacracy. I can't afford the eyeglasses that I need and an immigrant, here in Toronto, plops down a government voucher for $750 at the opticians and then gets into an ESCALADE!!!!! - Why is it that the people who seem to need it least know how to work the systems best? - I feel like a second class citizen no matter where I go. Get to the back of the line. Hey, I know life isn't always fair. But I just want a shot at working for an honest wage, having a reasonable middle class lifestyle and raising my child in the good old US of A.

    Try not to let it get to you too much. I understand your pain. As I've said in a couple of other posts, unfortunately, large bureaucratic systems tend to respond in ways that penalise those who least deserve it.

    For example, to prevent illegal immigration by marriage fraud, they've got the conditional residency thing. Who does it end up frustrating? Actual married couples. Those who want to defraud the system will end up finding ways around it. Those of us in real relationships end up having to fit our lives to fit in with the needs of the system (for example, I've found that filing taxes seperately may have allowed us to save a couple of thousand dollars, but unfortunately this is one useful piece of evidence in the I751 process).

    The system, as it is currently set up, needs a big overhaul. Everyone knows it, everyone thinks it should be updated, but current political ideologies are offering up impractical solutions. Hence, 20 million illegal immigrants being able to walk over the Southern border, while we end up having to jump through multiple, randomly appearing, and inconsistently applied hoops.

    To finish my rant, first we need a good general immigration intake system (Australia and Canada actually have a reasonable system set up for this based on a points system), with reasonable straightforward rules that are applied consistently. Of course, then I wake up from this dream every day :)

  4. I just sent my ppwk off, did color printouts of photos because it was cheaper and really the same quality. I sorted my evidence by trip. For example, for our trip back to Colombia I attached boarding pass, email flight confirmation and pictures of our Colombia trip with little handwritten explanations where I fent necessary. I did that for all the trips we have taken, then at the end I just added a bunch of random misc pictures not really relating to any particular trip, also included little notes and dates when possible. I'll let you know how it ends up.

    Sorry you got an RFE. Do you mind me asking what all evidence did you include the first time around?

    I didn't send nearly half of what I should have. I sent the I-715 in before I found Visa Journey, so that says it all.

    I had sent copies of bank statements, copies of drivers licenses, car titles, car insurance, lease agreements, copies of my green card, copies of passports, and some other stuff I can't remember right now.

    My big mistake was that I did not have everything organized and made easy for USCIS, so I fully understand why they sent me a RFE. This was all my own fault for not paying attention. On the bright side, they gave me a second chance to do it right this time :)

    Make sure your evidence covers the whole of the last two years. It might be that you sent in a bank statement, but you may have only sent in the most recent. You didn't mention tax returns, don't forget those if you haven't done so already.

    i called the state police here in town and they told me that they can do the fingerprints, but i need to bring the card that i need, as in i should bring whatever card the immigration services wants me to use. so, where do i get this?

    Read the I751 instructions carefully. You don't send in fingerprints unless you're currently outside the US (ie pursuant to a govt job etc)

    Actually, they will take your prints (and photo), but they will do this themselves at a biometrics appointment. Once you send your package, they will send a couple of letters in the first month or so. One to acknowledge your application, and another asking you to come to an application support center for them to take your prints and photo.

  8. I think you mean the I751 (not I175).

    Anyhow, I'd strongly recommend that you file in the US (in fact, I don't think you can file from outside). You're filing for residency (to be more exact, removal of conditions on your husband's residency), and applying for US residency means you intend to reside in the US. If USCIS believes that you don't intend to be a resident, they may deny your application.

    I know that you are intending to be a resident, but filing with a Canadian address may give the wrong impression. In fact, I'm curious as to how you resided outside for all this time. Are you going to be able to show evidence of joining your lives in the US? (eg joint bank accounts in the US, joint utility bills from the US, joint residence/lease/rental in US etc or similar). You might have plenty of evidence of joining your lives, but if they're in Canada, I don't know how USCIS will view that.

    As to where to file, check the instructions for the I751, I think North Carolina probably falls under the Vermont Service Center for I751.

  9. OP, the number on the NOA1 is an internal number. It will not appear on the case status online system. It has no bearing on whether your case is accepted or not, so if that's your concern, don't worry.

    The second notice, the biometrics notice, will have a trackable case number, but for some people, it doesn't activate until after you've done the biometrics.

    If you've just got your NOA1 in the last week or two, you'll get your biometrics appointment notice in the next week or two. Don't be too worried about it.

    Agree with everything else you say, but last time I came in from overseas, permanent residents went in the same lines as US citizens. That at least, is one privilege that we get to enjoy (at least for now!)

    I know a lot of people may think that somebody who is eligible to be a citizen should do so, but it does have other implications. For example, some countries do not recognize dual citizenship and picking up US citizenship may mean loss of their previous citizenship, and may have implications for their family inheritance etc depending on the laws of where they are coming from.

    Anyone who is thinking of doing so, make sure you research the implications.

  12. You can call me whatever. The fact remains that there is a growing number of marriages that are breaking up prior to the removal conditions. With the anti immigration environment prevailing the country, very soon people will start complaining and USCIS will tighten their rules.

    A growing number of marriages are breaking up full stop. I don't mind that USCIS wants to make sure that people aren't getting into bogus marriages for immigration fraud.

    But USCIS or anyone in the US govt has no right to tell people what is and isn't a good marriage, which is what you're doing. The purpose of conditional residency is to make sure that the marriage is legitimate, not whether its viable.

  13. By the way, Mrs Scott said your husband has to do AOS in 2 years, I believe she meant he has to do a removal of conditions. Adjustment of Status is what happens if the intending immigrant is already here under a different (usually non-immigrant/worker visa/student etc) category.

    One thing you might want to start doing is looking at the different types of evidence you'll need for your removal of conditions, and start a folder/box to collect them.

    Yes, sorry, my mistake there, its an unincorporated territorial possession. Although I believe there's some move to try and resolve that in the near future to finally decide what is going on.

Yes, she can divorce, the only thing is when she asks for citizenship it could come up why she divorced so soon after the green card, in which case she would have to bring wiht her to the interview things that support that her marriage was bona fide or why she divorced. But this is the only thing that could remotely turn into an issue, otherwise she is free to go at any time.... I would probably wait at least three - six months before making the divorce final though, if she can stand that much....

    Looks like a marriage for getting the green card. Oh well. Pretty soon they will start giving out 5 yr GC. Looks like most of the posts on this forum are from people who immediately fell out of love or had bad spouses after their 2 yr GC arrives.

    Usually I try to stick with the dealing with immigration stuff and not get involved in the emotional arguments that happen on the board but your comment is rather presumptive.

    Some of these things arise due to shortcomings in the US immigration system. There are those who are in a relationship but the only way they can live together in the same country is to get married, they are unable to continue the relationship in another way to see if it will work out etc etc. This is one reason why some get married, but find out that after living together that perhaps they shouldn't be in a relationship. It doesn't mean the non-USC was married 'just to get a green card'.

    In Australia for example, the fiancee visa allows you up to 9 months to get married, and you are allowed to work once in the country, none of this adjusting status stuff. There is also a general immigration intake system based on a point score system. The only general immigration intake system in the US is the green card lottery.

    The response of bureaucratic systems such as the INS/USCIS to those who want to circumvent the system is to put in checks to ensure that immigrants are legitimate, hence the conditional GC etc etc. That all sounds good in theory, except that it ends up disproportionately penalising those of us in legitimate relationships. Those who want to circumvent the system will do a much better job of getting through than those who just want to get on with their lives.

    Information for US citizens will apply to you when you become a US citizen.

    I think the OP is asking whether the travel conditions are applicable to a legal resident as they do to a citizen.

    OP, Puerto Rico is a part of the US, its a district to be exact, no different than Washington DC. If you're flying there on a domestic flight, the only reason you would need ID is to actually board the flight, there is no immigration check.

    One positive thing you have is that you were married for a good year and a half before you seperated. The thing is, a lot of conditionals who have come here after they were married (through DCF for example) and later became seperated probably were married no more than you were.

    Do you have evidence for a joint life from 2003 and 2004?

    Its puzzling that she said conditional was granted too quickly as you had already been married for a year when it came through. (I'm not too familiar with the AOS process so I can't really comment on that)
