Hello!

My wife's mother has her IR-5 interview next week and we have a few last minute questions we were hoping those with experience could help with.

1. Does she need to pay a visa fee at the US Consulate in Ho Chi Minh City or have all of the fee's been taken care of through the NVC process?

2. The interview appointment letter from the NVC indicated that all original documents requested had been received by NVC and meet post requirements. Are there any other documents, original or copy, that her mother should bring to her interview? I've read on here that some suggest taking photo's showing my wife and her mother together. Anything else besides the normal of passport, medical exam results, required photos, etc.?

3. Our I-864 and I-864A were submitted to NVC and indicated that financial evidence was received as accepted as meeting post requirements. Anything else needed here for the interview?

4. From what I've found in the posts on here interview questions seemed to be pretty focused on the relationship link between mother and petitioner. Any insight on common interview questions would be appreciated. I'm searching the forums as well.

We've already sent the I-130 in for her mother and received the NOA1. If we file for her father this week will the applications sync up at USCIS before being forwarded to the US Consulate in HCMC? I guess at worst her mother could answer in the interview that a petition for her husband is pending and was filed after hers.

Yes. Ultimately, it is better to apply for both at the same time for any number of reasons chief among them is that (1) you get it all out of the way at once and don't have to go through the whole routine a second time, and (2) you eliminate any potential "perception" problems at the USEMB. If given the option, I would do both now. If the father doesn't like it then he can always go back and decline LPR.

Thanks icolbowca. Honesty always in this process. We're certainly not trying to do anything illegal or cheat the system.

I'm just wondering if it is better to apply for her father in addition to her mother and then let her father decide after coming here if this is the place he wants to live permanently. If he doesn't he can always decide to move back to Vietnam and just abandon the green card - correct? Without being able to obtain a visitors visa there really isn't any other way for him to experience living here to make that decision.

Has anyone had success with only one parent being approved for an immigrant visa?

Does anyone else have any feedback regarding potential roadblocks at the US Consulate interview? Anyone with similar experience?

I have a question about something that just dawned on me. My wife, US Citizen and petitioner, has petitioned/filed an I-130 for her mother. Her father (still married to her mother) does not have interest in immigrating at this time. Assuming all approvals through USCIS/NVC and the case is forwarded to Ho Chi Minh City for interview, will the issue of petitioning her mother only raise any road blocks at the US Consulate interview? Should my wife go ahead and file another I-130 to petition for her father and have him at least come and see if he likes it? If he doesn't he can always go back to Vietnam - correct?

Still new to the I-130 relative part! Thanks in advance for feedback!

My wife recently became a naturalized US Citizen and will be filing for both of her parents.

My question is in regards to the I-864 affidavit of support.

Is this paperwork sent in with the I-130 to NVC or does the I-864 come later in the paperwork her parents will take to the US Consulate in Vietnam when they are granted an interview?

Is an I-864 required for each I-130 filed (1 for her mother; 1 for her father)?

I read through 10 pages of posts on here and couldn't seem to find an answer. The guide didn't indicate when the I-864 was to be filed.

Any updates? I have not got any update from the senator's as well.They said they are also waiting for an answer from the Immigration office.

We did hear back from the senator's office and they told us the case was in line for an interview appointment at the local office in Ft. Smith. We have not yet received an interview appointment from the Ft. Smith office. We continue to wait. I did file another e-service request with the USCIS to inquire further.

The senator's office got back to us today and let us know that the case is in line for an initial interview. They checked with the National Benefits Center and were told that everything is in line and where it is supposed to be at this point, and that there was a slight back log right now for initial interview. Hopefully you will have good luck in contacting his office. They are very nice and quick in getting back with us.

How did you contact the local senator? The new senator's website says they will not be doing any of the queries relating to government agencies in December. did you contact the outgoing one? Did you get any reply from them?

We contacted Senator Mark Pryor's office. Below is a link to his website and the online form we filled out and submitted. We also had to print a privacy consent form, complete and faxed it into his Little Rock office. Somebody contacted us the next day to gather additional info and said they would touch base after inquiring on our behalf. Be sure to include the receipt number from the NOA1 and the A# somewhere on the privacy consent form when you fax it in (this is the additional info they called to get from us).

Senator Mark Pryor Casework Form

Another possible action is to contact your local Senator or Congressman and ask them to investigate on your behalf. They have staff who do this type of work and they have dedicated contact numbers at USCIS to get information. Either official will probably be quite happy to assist a potential voter . You can generally find their contact information on line. You will have to complete an authorization document that will allow them to investigate on your behalf. This can often be done through fax machines if their office is not a convenient distance to drive.

Great advice. We contacted the local senator via their website this evening.

The number for the FBI to inquire about the name check is 304-625-5590. Make sure that you have her receipt number, date of birth info and so forth. I can't remember all that they need to make sure that they can give you the info. Also, I have heard of people calling the USCIS number and speaking to a Tier 2 supervisor. You may want to search the topics and get some additional info.

are you saying you got a notification letter for biomatrics, the did you have your appointment letter, you had your prints and photo taken,if you had it done and never heard thing,call the FBI in va the visa deptartment,give them your case number,ask if it wes sent to uscis, or is it still being adjudicating,call the 800 number ask to talk to tier 2 supervisor, sorry you are having this problem seems like a long time, good luck,

Playing devils advocate here: Did your wife spend any significant time out of the US since arriving?

Also, are you a naturalized US Citizen? If yes when did you naturalize?

Have you moved recently or since you filed the N-400?

Not significant time out of the US. Her longest trip was a 3 week vacation back to Vietnam.

I am not a naturalized US Citizen.

Have not moved recently.

We sent in my wife's N-400 application on March 27th and completed biometrics on April 28th. She has still not received an interview notice. We've called the 1-800 number and filed to e-service requests, only to be told each time to wait 60-90 days for the interview notice as the application is currently pending an interview date with the local USCIS office in Ft. Smith, AR. The last service request reply was received on October 21st.

When checking the status of the application online it still shows the last touch date of 4/16/2010 and a request for evidence status, which at the time we determined to be the biometrics notification. We never received anything in the mail other than the biometrics notification, so to this day still believe that is what the request for notification was. The 1-800 representative and the e-service requests never mentioned anything about additional evidence being needed.

Any advice? Anything additional we can do at this point? Continue to patiently wait? The local office is over an hour away, so we're hesitant to drive all the way down for an infopass appointment that may produce little result.

We filed N-400 for my wife 3/27, NOA received on 4/7 and biometrics was completed on 4/28.

It is now 6/22 and no interview notice yet.

In looking at the March filers post, it looks like most are receiving interview notices within a month after biometrics.

Any thoughts on hold up? Others experiencing the same delay through Lewisville? Online case status still shows RFE from the notice that was sent for biometrics, but those have been completed.

I did notice that my wife's completed conditions removal petition was touched on 5/15/2010 and then her completed petition to adjust status was touched on 5/22/2010. Each say that they are now in post decision activity. Not sure what this means since these were approved quite a while ago.

Wanted to seek advice here before driving an hour for an Infopass appointment. Thanks in advance for any feedback.

No visa needed. Thuy has gone back twice and both times entered with only her VN passport.

The following are items I sent to my MIL:

• Invitation Package Cover Letter
• Invitation Letter asking Consulate to grand my MIL visa to visit us and list several reasons.
• Completed form I-134 signed by me the USC.
• Tax Return
• Pay stubs
• Bank Statements
• Copy of my Passport (Picture and signature pages)
• Form DS-156 filled for my MIL and signed by me (preparer)

The complete package is sent to her via USPS Express Mail (5days to reach her). She took the form to Citibank to pay the $131 fee and was asked to schedule the interview herself online or use the service company (Long Hai?). She called us while she was still in HCM and we were able to find the web site to schedule online https://evisaforms.state.gov/default.asp?po...M&appcode=3 here. You will need her DS-156 barcode in order to schedule and lucky for me, I saved a copy before I sent the package to her. She will be interviewed next week.
