My wifes niece (12yrs old) is not wanted by her mother and her father is not physically capable (disabled due to seizures and brain injurys from a car accident) of taking care of this girl.
From what I can read, the only way to bring her here would be as an orphan (student visa is out of the question due to the cost of a private school and related expenses). If we obtained medical records that show he cannot care for her and we adopted her, would that work? Poor kid really has no where to turn

Surprising news!!! We recieved her Welcome Notice in the mail today along with her EAD!!
From what I can tell, she should have her Green Card in less than 3 weeks... This is really odd in that she did not get interviewed. We went straight from Biometrics to AP to EAD to Welcome Notice....

wow...
I never expected so many replies. I sincerely thank you all for your input. I guess I will have to break to the news to her that she will have to wait just a little bit longer. We were all excited because airfares to Rio are down to $663 and figured we could make a trip for her sisters wedding.
Thanks again and I welcome any additional news or input!

We received my wife's AP documents today. We received 2 AP documents (identical). I assume this means that she can leave the country twice?
My major concern is that we took quite a bit of time to file for AOS. This was due to financial and medical reasons (she got pregnant but had some complications), so we were really hurting money wise trying to pay all the medical bills etc.
We filed for AOS 1 year after we got married. I am terrified that if she travels they wont let her back in because of this 1 year "lag"... Do you think she is safe to go home to visit????

Thanks for the info!
She's going to learn the whole thing from shampoo's to manicure, pedicure, cutting, coloring, chemicals, facials, etc, etc.
It's about $6000, but it will give her something to do all day when I am at work and once she gets her EAD, she can start earning her own money (important to her).
Thanks again!
Hi, may I know what's that $6000.... is that her tuition fee for cosmetology?
Yes, the $6000 covers everything. 1600 hours of training & education and all necessary materials for the course (wigs to practice on, blow dryer, curlers, 2 electric clippers, uniform, etc etc ). It does not cover the cost to take the test to become licensed in my state but I think that is only like $15 or so...

My wife came up on a K1, we got married and are doing the AOS "thing". However, she is bored to tears at home all day. We are thinking of Cosmetology as a way of giving her something to do and keep her mind busy. It is a private school and they require minimal documentation (SS card which she has) etc.
As long as she doesn't work until her EAD arrives, there should be no problems, correct??
Thank in advance!

You have satisfied the conditions of the K1 by marrying within the 90 day limit of the visa. You can take your time and gather all your paperwork and file when you are ready. We just suggest on here that sooner rather than later as it all takes time and the sooner this lot is over the better.
Thanks so much!!!!! I, we, appreciate it greatly

Thanks to VJ, I was able to get my fiancee here and we are now happily married (within the first month of the K1 being issued). We have been enjoying our time together so much that we just realized that the Visa expires tomorrow! After poking around I've seen some posts that you can file AOS pretty much any reasonable time after getting married?
This kind of makes sense to me in that the K1 Visa is for entrance to the U.S.
I'd rather take a week or two and do all the AOS papers with the same care and attention to detail that I did for our K1. Do we need to file anything else if we are past the 90 day mark? Or do I need to freak out and pull an all nighter like in my college days???
Thanks!

It seems like some people have better luck than others. Our petition flew through NVC.
WE MADE IT!!!!! Cristiane had her interview yesterday. We were the first in line and the 2nd to be interviewed. We were VERY nervouse, but the lady was very pleasant and talked to me almost more than she did to Cristiane. We were celebrating back at the hotel by 11:30am!!
One bad thing is they no longer allow you to come and pick up your passport at the Embassy anymore. You must wait for the courrier service to deliver it to you

I believe you are still well within the norm so contacting an elected representative probably won't do much good.
Depending on who your Congressman is, they may help you or not. My Congresswoman was totally worthless. I was able to obtain results from going to my senator (who sent the inquiry via the congressional channels). Just google for who they are and write them a paper letter. You may have to make a follow up phone call, but they will at least talk to you and try and help if possible.
Good Luck!

Great news! I was worried because of what the embassy was saying on the forms.
Thank you very much Jer&Cau and Luis& Larua!!

My finacee already has her police certificates. They were issued by both the Federal and SECRETARIA DE SEGURANÇA PÚBLICA. They both told her that she had to go to the Cartório and have them stamp it.
She says that the certificates are official and not xeroxed. Why would she have to go to the Cartório? I am VERY nervous because the instructions specifically state "The certificates issued by “Cartório” or “Fórum” are NOT, repeat, NOT acceptable, in any circumstances".
She *just* recieved Package 4 today and our interview is on the 27th. I doubt there is time to have the certificates re-issued if they gave us the wrong ones...
Anybody have any knowledge on this????
Thanks!
Eric
(Sorry this is a cross post, but nobody has answered my other post and this is definately a time sensitive issue!)

I am not sure how long they are valid, but my girl needed both certificates and it took 1 week to get them both. She said the Federal Police in RJ was ok, but the other one was located next to a very bad jail and she was rather scared to be there
Does the embassy have these forms? The DS-156 is a form for the embassy so you might look at their web site. Some embassies have you file the form(s) electronically
Here should be all the forms you need;
http://www.embaixada-americana.org.br/inde...amp;itemmenu=58
Brasil requires a few extra than most I believe...
Some of them you can download and print but you cannot save them to your computer. The DS-156 (I believe) requires you do it online.

Hmmm I had planned on not using my father unless they said I needed him. You are probably right, why cause delays and more headaches? Just get it out of the way at the begining...
Oh.... When he completes the form, is he sponsoring me who is sponsoring her or is he sponsoring her?

Last year I moved to Brazil to spend time with my fiancee before we starting the K1 process. While that was a good "meet within 2 years" bullet point, I shot myself in the foot because I am now $1000 shy of the min poverty guideline for last year (Normally I make approx 50k a year)
Anyway... I have the last 5 years of Tax returns and W2s. Hopefully, they will let that $1000 slide. My father (retired) agreed to cosponsor as a "Plan B" if they want to be picky about the $1000. What will I need from him? I-134 and supporting docs or are there any special cosponsor forums he needs to do? I searched but really didn't fine a "what is needed for cosponsor thread"...
Thanks!
-
Ok, I should have the 1040's and W-2's so I guess I should be safe.
Thanks for the replies!

I just happened to see a post about Tax Transcripts. I had never heard of this and I started to freak out!
My fiancee is coming from Rio de Janeiro. Looking at the RJ Site http://www.embaixada-americana.org.br/inde...amp;itemmenu=58 and reading the Application instructions, they state;
You may present your own means of support or the petitioner may fill out an Affidavit of Support, form I-134. The sponsor must attach proof of his/her income such as: copy of last U.S. Federal Income Tax (form 1040), proof of current employment, job offer, pay-slip, etc.
Nothing is mentioned about transcripts...
Do I still need to obtain one (or more) transcripts???

Ugh. The Brazil Embassy sent Package 3 to my girl's old address. Today they are sending out a new one. But apparently the mail service is ok strike! We're not having good luck here
Would it be better for her to just go to the Embassy and pick up the packet herself?
-
Just called NVC again today. Our paperwork left for Brasil on 8/29!!
-
Called NVC early this morning and they received our petition from CSC yesterday!! So if you're a April filer, give 'em a ring!

Yes, what skyblue said. Ive also read that K!'s dont stay there long enough to get put into the system. To check the status you have to call and speak to someone.

Thank you for the replies. Of course it's not what we wanted to hear but we'll figure something out. Have to...
