  1. Some lawyers give free 30minute consultations, make sure it's an immigration lawyer and he will give you good advice. He put my mind at rest for sure, he says even if my motion is denied, which he doubts very much, then I just start the whole I-485 process again. I don't think the decision changes in the website until they have reviewed your appeal or motion but at least they have it and are looking at it, according to the lawyer this puts you back to the "awaiting adjustment of status" stage. It's worth seeing a lawyer MariaAndreas and good luck to you and your husband.

  2. So latest update, I had a consultation today with an immigration lawyer and he recommends filing for motion to reopen and reconsider, including a statement from me supporting the motion and of course the missing documents, in my case, the sealed I-693 correctly filled in by the civil surgeon. Hopefully I can send this off tomorrow with my check. Another plus point is that once I have applied for the motion, my status reverts back to having an open Adjustment of status so therefore I can work whilst I am awaiting the decision of my motion. I am keeping my fingers crossed and hoping for the best, thanks everyone for all your advice so far

Just some extra information on my case, apparently, I can file a motion to reopen and/or reconsider but not appeal, these motions cannot be filed in person at a field office (info pass appt) Anyway, I had my medical today, I have hypertension but she said that is no big deal and I'm going back Friday to get my blood results, so then I should get my sealed envelope and I'm not leaving the office until I check every line! I had a telephone consultation with a lawyer yesterday and she said that the denial was plain nonsense, I am also seeing a lawyer face to face tomorrow for more advice.

So, finally got my denial letter today.....reason for denial...not providing a fully completed I-693, this was requested as the doctor in the UK suggested a follow up medical 6 moths after my arrival in the USA..I had no idea what was in my UK medical and I arrived here in March 2014!!!!!! Second point of denial was that the civil surgeon who completed my vaccines, which was the only thing I needed according to the USCIS when I queried my RFE, filled out the i693 incorrectly, so how do I know what is in a sealed envelope..the letter says I cannot appeal but I can file a motion to reopen or a motion to reconsider, it also attaches 3 pages of legal jargon which I do not understand in the slightest. So I am having my medical on Wednesday, I have already told them of their serious error and I have a telephone consultation with a lawyer tomorrow, however I will more than likely retain a lawyer to sort out this fiasco.

  5. I have posted previously on this, I had an rfe to have a medical, I contacted us is for clarification and I was told I need vaccines and not a medical so I was declined. I fully accept that an appeal is not an option but I would like to either re-open the case of reapply from scratch. I am having the medical carried out next week but I just wish the letter would hurry up so I know for sure

  6. I came in to the USA on a K1 visa. I was married within the 90 day time frame and applied for my AOS, EAD and AP. MY EAD and AP were approved and has just been renewed. My AOS has been denied and I would like to re-apply, do I have to leave the country to do this and wait until I get a notice to say that my AOS is now pending? Also, as my EAD and AP depend on a pending AOS, would my current authorisation be re-instated ?

Yes, I shall post on here as soon as I have spoken to a lawyer, I am swaying toward a re-opening or a re-application to be honest , an appeal isn't appropriate for my case, I only hope that they can reinstate my work authorisation quickly, a previous poster suggested that I keep working but I don't want to do anything illegal, again I shall ask the lawyer about this. I am also tempted to hire a lawyer to carry out the re-application procedure on my behalf however I have made an appointment with info pass for July 29th.will keep you all posted

I accept the fact that i made a mistake based on bad information, I am considering hiring a lawyer to process any appeals/re-applications from here, however I will book an infopass appointment to cover my bases. I have already filled out the appeal form, and new I-485, EAD and AP forms just incase.

  9. Does anyone know how long it takes to receive a denial letter? The decision was Monday, I thought I would have had it in the mail by today, i'm concerned because I believe that you have 33 days to appeal from the date of decision not from receiving the letter. The email I received informing me of the decline also stated that if I hadn't had the letter by July 28th then to contact them, that would be 15 days wasted and not leave much time for me to respond, can anyone help with this please

  10. Thanks for your advice Damara. One other question if may? Do the offices have records of telephone conversations that a lawyer can request . I ask this as whilst I understand completely that I have not complies with the RFE, I did ask for clarification and wrong information was given to me therefore I acted upon wrong information, I would have been more than happy to have the medical done if the office had verified that I needed a new medical but they said I did not and all that was required was the vaccines

  11. Thanks for the words of encouragement chsim, I feel really bad because I trusted what the USCIS office was telling me, little did I know that it was their interpretation and not fact. I'm hoping for leniency as I have supplied all information required well before due date and I have complied 100% until this lastest issue. I have access to an immigration lawyer consultation through my spouses work so as soon as I get the letter I will be getting legal advice as to how best to proceed, either request to reopen or start the process again

Wow, I wasn't aware of this new law, I would have thought that the lady at Ucis would have been aware of it and told me the correct information...Can anyone tell me if the letter I am being sent is a denial or a notice of intention to deny? The email just said that my AOS has been denied.Tricky question I know but I'm wondering if they send the notice first. As I had received wrong information and did I fact need a new medical and I had just had my vaccines updated, would they give me a mother opportunity to get the medical done? The date that I had to provide the details on the RFE was August 22nd, they had the vaccines back around July 25th, does this date allow for missed items to be gathered and sent?
