    We sent our RFE response out early this month and it was received on September 4th. Can you share how long it normally takes to hear back from them after RFE? I've been checking the case status online every day and I'm getting really anxious! I think the end of my extension is coming up in November, based on the 18-month extension letter they sent me. But the extension stamp on my passport is until January next year. Which one do I follow? When should I start contacting them or getting another extension? Who do I contact? So many questions and uncertainties...

    Our RFE took about 2 weeks to get approved. This was sent to Nebraska office. First we received status update that new card is being produced, then a few days later status changed to case approved. Hang in there and good luck.

  2. Hi all, I believe our case got approved. 🤗 🤗 We received an email this morning with the status "New Card is being Produced". We are so happy that our ROC journey is finally over. I want to thanks the community for helping us with the process and for everyone that is still waiting to hang in there.

     

    Just fyi, we received RFE on August 3rd, and we submitted additional evidence on September 10th. We are very surprise to receive and update in 2 weeks. Now we can finally relax about and not stress out about this.

  3. Hi All, we received an RFE letter 2 days ago. 😞 They wants us to submit additional evidence to show that we entered our marriage in good faith. Below is the letter received. I would like some recommendations or suggestions based our status. Sorry for the long post.

     

    Items that they requested are below.

     

    Item#1 - Children as result of your marriage.

    - Unfortunately we are encountering difficulty from having children. We have been seeing fertility specialist since April this year, so we're planning to send available documents from the fertility clinic, such as emails between us and the clinic.

     

    Item#2 - Evidence that you and your spouse have resided together and shared responsibility for common residence.

    - We are currently living at my mother house right now and everything is under my mother's name. We can only produce copy of our driver licenses showing the same address, paycheck stubs, separate banks statements with same address.

    - Phone bill is under my name only, but my wife phone number is listed.

    - I have my work health coverage plan showing my wife as beneficiary. Same with my retirement plan.

     

    Item#3 - Evidence that your and your spouse have combined financial resources or joint ownership of assets.

    - We have joint CapitalOne saving account. We each have our own checking account that deposit money in our CapitalOne account. I guess we need to submit statements for all 3 accounts? Do you suggest every month for the last year 1/2?

    - We also have IRS transcripts for 2016 and 2017 and W-2. 2015 was submitted previously.

    - We have no utility bills. We have joint car insurance statements.

    - Health insurance documents.

    - No loan or joint credit card statement. 

     

    Item#4 - Evidence that you and your spouse made estate, health and financial arrangements.

    - We do not have anything here at the moment. Should we try to get power of attorney now? Is it too late now to get?

     

    Item#5 - Affidavits from third parties.

    - We're planning to get my mother and 2 of our friends to write a letter. Is it necessary to notarize each letter? I see ppl are doing it on VJ.

  4. Here is my status update. I am a January 2017 filer to CSC.

     

    Status Update

    03/05/2018 - Status changed to Form I-751 received at local office.

    04/04/2018 - Status changed to "Case was transferred and A New Office Has Jurisdiction".

    04/07/2018 - Received a letter in the mail stating "We have completed a preliminary review of the application or petition listed above". Case has been transferred to Nebraska Service Center.

     

    Hopefully we get approve soon.

  6. Hi all - I have been away for awhile and I need to confirm something. Based on the information below, my wife's green card with one year extension will expire on 4/15/2018. So my next step should be to setup an appointment at the local USCIS office now and get I-551 stamp on her passport. Is this correct? I'm pretty sure I'm not getting the new green card within the timeframe.

     

    Background: 

    Temporary two years green card expired on 4/15/2017.

    I-751, January 2017 filer

    February 2017, Received I-797 NOA for conditional resident status extended for 1 year.

  7. Just want to add that I also got the same status update on my case. I am a Jan 2017 filer to CSC. Still don't know what to take of this, but hopefully this mean we are moving a little quicker.

     

    "On March 5, 2018, we received your Form I-751, Petition to Remove Conditions on Residence, Receipt Number WACxxxxxxxxxxx, at your local office. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

    How to Apply to Remove the Conditions

    You and your spouse must apply together to remove the conditions on your residence by filing Form I-751. You should apply during the 90 days before your second anniversary as a conditional resident. The expiration date on your green card is also the date of your second anniversary as a conditional resident. If you do not apply to remove the conditions in time, you could lose your conditional resident status and be removed from the country.

  9. Use https://www.uscis.gov/sites/default/files/dateCalculator.html to get the earliest day you can file the I-751. Input your GC expiration date.

    Regarding the date mismatch - check the date on the visa. We also received our reminder based on the date in the visa and not the green card.

    In our case, it's only 3 weeks apart, so it doesn't really matter.

    In your case, you may want to contact USCIS and update the conditional residency date.

    Thanks - maybe I should call USCIS to confirm. I saw in the previous topics that everyone was going by the GC expiration date as well. I just don't want to mail out the package now and have it return back for filing too early.

    Anyone else had this same issue and went by the GC expiration date?

  10. It is our time to submit I-751 form and I have a question regarding Expiration of Conditional Residence date. (Question 14)

    We received a letter from Dept. of Homeland Security saying "Our records indicate that you entered the United States as a conditional permanent resident (CPR) on (2/19/2015)." And we need to file I-751 form within 90 days.

    My wife entered U.S. on April 15, 2015 and her green card shows "Card Expires: 04/15/17" and "Residence Since: 04/15/15". I'm confuse of when to send our I-751 package. I started gathering documents today and was going to send them next week but now I'm thinking that I'm maybe too early.

    I saw that this have been asked a couple of times but I wanted to make sure. What do you guys recommend I should do.

  11. You cannot MFJ with entering NRA. You'd have to apply for an ITIN to do MFJ. You can MFS with NRA but you have to print the return and mail it in. This is the easiest to get the return done now. Alternatively, as suggested, if you do not owe taxes simply file an extension then do your taxes when she arrives.

    Sorry I meant to say MFS. Anyone knows what to enter for community property tax section in TurboTax?

  12. Anyone file Married Filing Seperate using TurboTax? I am stuck on Community Property Income section.

    My wife will be here on April 17th, so she doesn't have SSN yet. I am filing MFJ and planing to enter NRA for my wife social security, then print out the form to mail it in. I don't understand and don't know what to enter in the Community Property Income section. If I answer NO to the question below, then it asks me to enter a few other items that I don't know what to enter. If anyone used TurboTax, please help.

    Do you have any community property adjustments or community income to report for 2014? - Yes/No

  13. Okay, this is a very random question. Is there anyone who has got through NVC WITH a lawyer and WITHOUT a checklist?

    Is this true that NVC gives checklists to those who have lawyers?

    Yes, lawyers are of no use, i know, but this thing has made me curious.

    We went thru USCIS without a lawyer but we hired lawyer thru NVC and we did not get a checklist. To be honest, we could have done it without a lawyer but it was a piece of mind for us and no regrets with the outcome.

  14. Hi guys..starting to fear that my file is lost or something! I got approved 9/5 and nvc still hasnt received my file! Ive seen same approval date and even after 9/5 approvals that were approved 2 weeks ago.. ??

    My I-130 was approved on 9/3 and shipped out on 9/10. I called nvc yesterday and rep said package was scanned on 10/1, but still not case number. I say yours should be received soon.

  15. Quick questions about "Certified copy of birth certificate".

    I'm debating of sending original or certified birth certificate of my wife. We went and got a copy of her birth certificate at the place where original was issued, but they just simply made a copy on regular paper and stamped it to certify. Do you thing NVC will take this?

    Another question, if we do have to send the original birth certificate which we do have, will we get it back?
