    Can I travel if my name has changed due to marriage, divorce, etc., and my documents are in my old name?

    US Citizens: US Citizens who change their name due to marriage, divorce, or because of any other circumstance may travel using your US passport or other WHTI approved document in your prior name provided you bring proof of your name progression such as; a marriage certificate, a divorce decree or court documents showing a legal name change.

    Lawful Permanent Residents (LPR): LPR's who change their name due to marriage or because of any other circumstance may travel using your LPR Card (US Green Card; I551) in your prior name provided you bring proof of your name progression such as; a marriage certificate, a divorce decree or court documents showing a legal name change.

     

    It doesn't really cover our situation, as the greencard has her new married last name, it's the passport that is in her maiden name still. But it would make sense that their requirement for the proof of name progression (marraige certificate) should suffice and link the documents.

     

    Does anyone else have recent experiences they could share?

    We filed my wife's I-751 a few months ago. We have received the letter extending her green card for work/travel for one year.

     

    She wants to travel home to Ireland for a couple weeks to visit.

     

    I know if she travels she needs to bring her greencard and the extension letter. Her greencard has her new last name (married name). However, her passport is still in her maiden name. Can she travel with her passport in her maiden name if she brings a copy of our marriage certificate? And we just need to book her ticket using her maiden name which is on her passport?

     

    We traveled internationally soon after our marriage and had no issues, but I just wanted to double check with the community here, as it seems things are constantly changing.

  3. Hi. My wife came over on k-1 and now has her 2 year conditional greencard. She got her New York driver license after she received her EAD but before she received her greencard. The driver license says "temporary visitor expiration xx/xx/2016" but it also has an expiration date dated 2019. From what I can figure out the temporary visitor expiration is just the date the EAD expires and really has no meaning other than to alert law enforcement what the immigrants status may be. The other expiration date is the date the actual driver license is good till. So do we need to go to dmv with the greencard to get the driver license "temporary visitor expiration" updated or can she continue to drive without any issues? Thanks!

  4. For the individual annual income on the i864 is it just base salary or do you include bonuses? My joint sponsor makes base plus bonuses but the bonuses are given to him every year because hes been with the company so long. Each of the past three tax returns show him getting these bonuses. Should the individual annual income I put on the i864 match a certain number on his tax returns?

    I have not posted since I was in the K-1 process. My wife (fiance at the time) has since arrived and we got married in october and are living very happily! We filed for Adjustment of Status and for her I-765 early November. I just got an RFE today stating that they cannot process her I-485 until we submit the required evidence. They said that I do not meet the 125% of the poverty line so I need to provide my assets or get a joint sponsor. Luckily I've had a joint sponsor lined up as a backup all along because I am on the border of 125%. I had my joint sponsor fill out a I-864. I just want to double check that when they ask for individual annual income on the I-864 that they want total income from line 22 on IRS 1040 and not adjusted gross income. I put his total income but just want to be sure this is correct because there is about a $5,000 difference between his total income and adjusted gross income. He has a household size of 7 but makes over 100,000 a year so he makes nearly double what is required as per poverty guidelines. Do I need to include anything else with the copy of his most recent tax return as far as proof of income? I want to send it out tomorrow and dont really want to waste time getting a letter from his work if it isn't necessary since its obvious he makes enough. I am going to include the RFE they sent with the package when I send it. Should I label the package I-485 Request For Initial Evidence Response or something? Thanks!

    Im about to send in aos. I am the primary sponsor for my k-1 wife. I have only filed one tax return last year as it was not necessary previously because I was a full time student. On that tax return i made 14,500. So far this year I have made about $16,500 and have a letter from work stating I will make around 20,000 this current year. This information was used on my affadavit at the k-1 interview and they asked no questions and I didnt need a joint sponsor. I have a joint sponsor but would rather not use them If i dont need to. In the case my I-864 and earnings is deemed insufficient on my wifes aos package, will they deny the application or ask me to get a cosponsor? Should I include a joint sponsors i-864 or should I wait to see if they ask for it? Thanks

  7. Hello. I am the USC petitioner. We just got married and were about to send our I-485 as soon as we got our marriage certificate in the mail. Here is the story.

    My fiancee is from Lithuania and her birth certificate is in Russian/Lithuanian. The birth certificate lists her first and last name but also lists her patronymic name which is her fathers first name. She does not have a middle name and has never used one. Her Lithuanian passport, all the K-1 visa documents/application, and the K-1 visa itself lists her name as it should be- just her first and last name with no middle name. We got the marriage cert in the mail yesterday and what happened is they used her patronymic name as a middle name. So now she has a first name, middle name (patronymic - her dads first name) and last name (which has been changed to my last name). We went to the town office where we got the marriage license and they didn't really understand what a patronymic name was and that my fiancee has no middle name- even though no middle name appears on her passport of visa. After some time explaining they gave us a form to send to New York state to request a change on the marriage cert. There was a section to explain the reason for the change and I wrote that the middle name put on our marriage license is not a middle name and that it is a patronymic name not used by my fiance. We asked that it be removed and also included a copy of her passport for proof. The lady did say it is up to them wether or not they allow it because it lists her patronymic name on the birth certificate. She also told us it would take about a month to hear back from them.

    My question is now that we have to send the I-485 with a copy of the marriage cert will it matter that they put her patronymic name as her middle name? As I said so far we have done all paperwork with only a first and last name for her. We have filled out the I-485 with only her first name and her last name, which she has taken from me so we now have the same last name. I just don't want her to get a EAD or greencard with her fathers first name as her middle name. I also dont want to wait a month to file aos when we don't even know if New York state will even agree to remove the middle name on the cert.

  8. Hi. We received noa2 and it was sent to nvc two days ago. My fiancee was just getting documents for interview ready and noticed on her birth certificate that when we filled out the g325a we put the wrong name for her mothers maiden name. Her mother left her and her father when my fiancee was young and passed away. My fiancee didnt know her maiden name or date of birth when we filled out the g325a and got that info from a family member but now that she looked at her birth certificate maiden name is wrong. Her mothers first name is correct. Im panicking that this is going to be a big problem after we have come so far. Im worried they will see the name doesnt match at the interview. What should we do?

  9. Thank you so much! Very helpful! Has your fiancé gone for his medical yet? Do they give you the medical results after your exam or are they send to the embassy? It looks like our timelines are matched up because we just got notified our petition was sent to nvc on the 18th from tsc as well! My fiancee has requested the police certs already and all I have to do is finish the i-134 for myself and my father who is cosponsoring. Im flying to dublin the second week of september so before I leave i will have my employer write a letter for my financial proof. I will be in ireland with my fiancee waiting until the interview which i am hoping will be by or before mid october so we can fly back to the US by november. Any idea how long the wait for an interview is once you send back packet 3? Will you be attending the interview with your fiance?

    In prep for our interview my fiancee ordered the police certificates. She lives in ireland but also needs one from lithuania. She went to the lithuanian embassy in dublin and they said they have two types of police certificates. Both have the same content but one is apostille which has a special stamp. The regular one takes a week the apostille takes two or three months. Obviously im praying we only need the regular one for the k1 because our petition was approved and just sent to nvc. Also they asked her if she would like it in lithuanian or english. She ended up ordering the ordinary one in english. I hope this is correct?

  11. My fiancee went to the lithuanian embassy in ireland today to order her police certificate from lithuania. They asked her if she needed the ordinary one for 30 euro or the one with the stamp for 40. They said the ordinary takes about a week and the stamp takes two to three months. Which one do we need for the k1? She ordered the ordinary one I hope its the right one.

  12. We recieved our noa2 on aug 8. I will call nvc this week to see if they have our case yet. We are trying to prep for the interview in dublin ireland. I want to know from those who have gone through dublin:

    Can you get the medical done ahead of time, before receiving packet 3? And how long is it valid for?

    Does dublin accept joint sponsor for the k1? I will make 125% of the poverty line this year but last year on my tax return made a few hundred under 100% poverty line. Will a few montths of paystubs be enouph? Do I need any other documents of proof? Or should i have a joint sponsor fill out a I-134 just in case?

    Does dublin ask for police certs for the beneficiary for all places lived more than 6 months or 12 months since 16? My fiance lived in lithuania for 6 months when she was 16. Also, she has lived in two cities in ireland so does she need a police cert from both cities?

    Any other tips for the dublin embassy interview would be greatly appreciated. We hope to get through the last leg of this journey asap so we can stop spending so much on plan tickets and finally be able to save for our future :)

  13. Got a text at 1:37 am, our petition was approved on august 8! We got noa1 on feb 27th! We are still in shock as I was a out to send my letter out to our senator today. The best part about it is that my fiance was here for the summer visiting and her 90 days are up in a week. Also I got the NOA2 on my birthday!!!! What an amazing present! What is the next step I should take? Also praying for all the rest still waiting I hope your approvals come quickly it seems like TSC finally got their together!

  14. Hello. I am approaching 5.5 months and am at TSC. Since the stated processing time at TSC is now 5.5 months (it was only 5 months when I filed) I will wait that long to send a letter to the congressman/senator. However I want to have it ready to go as soon as I hit the 5.5 mark next weekend. I wanted to know do people send a letter to their congressman or their senator? Or both? Also, does anyone have a sample letter I can look over?

    Any help is appreciated.

  15. my fiance was recently admitted to the US on the VWP. this is her second time visiting on the VWP, the first time the stamp in her passport had an "until" date. On the stamp she got this time there is no "until" date. Am I correct in assuming she is granted the full 90 days from the arrival date on the stamp?

Is current income what they want to see on the I-864 and would a few paystubs and a letter of employment stating I work full time 40 hours a week @$15 an hour making $600 a week be enouph since I only have 1 year of tax returns (2013 @ $14,000)? Also is my household size only who I am responsible for financially (2, me and my fiancee) or since I live with my father, his second wife, my brother, and grandmother do I have to include them?
