  1. That's odd. Tax returns and paystubs should sort the 5 year physical presence. Check if you really uploaded them under the Documents tab online. I did the same thing my kids got their passports before the Cert of citizenship. The certificate will be picked next week. Use the documents tab to upload. You can throw in your lease too it states on the website that you may upload additional evidence that you believe may assist USCIS. They will consider the timelines and relevance when making a decision. Good luck

  2. Some updates:

    My wife is waiting for the DMV raod test, All the SSNs arrived for her and the kids. On Friday last week the Green card finally arrived in the mail from the Texas Service Center. The curtain for the last of these long episodes is close to the floor. All the best for those who are in the journey. It shall come to pass. Stay tuned.

FiThe I-94 in her passport indicates that she is a non-immigrant in other words she violated the terms of her status so how do you prove nonimmigrant intent if in the first place you violated rules that are visa specific. I think she can go ahead give it a shot and complete the I-539 (Part 4 question 3 c,e and g - Red flag) because time is running out and she does not have a green card if she is not careful she will overstay which will be worse. Yet again the extension is actually not guaranteed. She can always consult a lawyer.

  4. You did mention earlier: "A fairly common misconception with people from many countries." that they are not aware that marriages in their countries are recognised. You would think if one is aware that their marriage was recognised one would not take chances with a tourist visa right?. One would actually go for the IR. Would her argument hold any water if she states that she was not aware that her initial marriage was recognised? If the info was known before, a reasonable CO would have advised her that she qualifies for a different visa. What does she need to do now with the current situation if she actually lied whether deliberate or not initially?

  5. Caryh Exactly my point! She did not disclose the first marriage so it is not a factor otherwise she would have taken the IR route. Infact if maryame had not mentioned the first marriage to the same guy, the argument would have taken a different direction that she came on a tourist visa and married that in itself attracts flies. So the bottom line is she lied to the CO from the get go (wether she divorces in Morocco or not).

    Get this he states up there that "we don't need to tell them" in other words wether she divorces him in Morocco or not there is no effect as long as they (CO) don't have knowledge of that info. Still its not a factor because the first lie is under wraps. I am not condoning it but it is a situation where one thinks the end justifies the means if and only if one does not hurt him/herself in the process.

    Can you conclude that she had an immigrating intent if in the first place she was actually married to the same guy? I don't think so. It appears she had an immigrating intent looking at it from the tourist visa angle and that might be the CO's perspective.

  6. Her prior marriage in Morocco is a non entity in US and that is why they managed to marry in US. In fact that implies that during the consular processing she did not mention the marriage becaue instead she would have been advised to take the IR visa route. Having said that, she can therefore divorce in the US. That means that in her country she is still married because there exists a marriage certificate (In her country). The questions is: What are the chances of getting the tourist visa once the officer realises that she initially came on a tourist visa then married? There will be some prying eyes on this one. It will be even worse if:

    1. She actually divorces in her country and

    2. While applying for her second tourist visa the officer gets wind of the initial lie that she was married but did not disclose this information in her first tourist visa interview.

  8. My wife went for the interview today (July 10th) and was approved. She was given the Immigration fee ($165) handout with the A-number on it. They will mail the passports through DHL. It has been an interesting journey from my N-400 to the oath, I-130 through several USCIS field offices to the NVC and the phone calls and wait times, finally to the Consulate.

    It takes people like you VJ members to be able to soldier on even when things seem to ground to a halt. People from all walks of life tied to this journey. So my good people I pray that you will also reap the benefits of this tough race a race that is not for the swift but for those who can endure. Keep the faith, so long......

  9. So as naswagi, Aren and edna said in previous posts, the cost is not more than $250 unless there is something out of the ordinary. I will let you know how the interview goes. I am trusting that everything will be flawless! This journey has been long from the first time I submitted the N400. This race is not for the swift.....time and chance happens to them all.

  10. I asked for a step by step of the two days below is a summary which might be a guideline. Remember the cost will vary depending on your vaccination records

    Day 1.

    1. Check in with the Interview letter from NVC and the the clock-in sheet from IOM (they sent this sheet when they responded to our medical exam booking email). Report to the security guy, go with a driver who can sweet talk them so as to tentatively park along the road otherwise they do not allow parking. There is another security guy at the next gate.
    2. Pick a number that will be pinned on the clock-in sheet
    3. Present papers to the receptionist, they will take one of your passport photos at the reception.
    4. Take a seat and wait to be called for counseling this is basically info on the tests to be done....syphilis and X-ray etc. This can be done for more than 1 family...(I was in with a young lady intending to immigrate to Canada)
    5. Proceed to the X-ray place, hand in the clock-in sheet and another passport photo..., if you have kids let them wait at the cafeteria. Wait for your name to be called then take the X-ray
    6. Proceed to the lab with your clock-in sheet , you will hand in a passport photo – (kids get the tuberculin test - Mantoux)
    7. Go back to the reception to get the costing plus a deposit slip, go to immunization with your immunization records...(My KEPI card and my AAR one were recognized). They will give you the immunization cost, so the TOTAL figure from reception and immunization is what you'll pay.
    8. Exit IOM after getting the appointment time (For day two) from reception.
    9. Go and make payments at the Village market CBA bank using the deposit slips given.

    Day 2.

    1. Same entry process - you need the clock-in sheet and another number clipped.
    2. Check in at reception; wait to go to the nurse. While waiting go to cashier with deposit slips in order to get a receipt.
    3. Proceed to the nurse for BP, height, weight, visual charts, kids’ weight, height …..
    4. Give all past medical history.
    5. Go to the doctor ....history, head to toe exam, (I don't know when people collect the CD...I will collect mine on Thursday), after the Doctor, you go for immunization, and then collect the immunization certificate.

    Note: All stages require your passport.

  11. First I wrote an email to IOM and booked the medical exam which was at least two weeks before the interview. The interview is tomorrow - July 10th. The police certificate is good for six months so its is good to get it immediately your case moves from USCIS to NVC. It took my wife two weeks to get it in Nairobi. They took her fingerprints and ID photocopy and she collected the cert the following week. She paid Ksh. 1000 (They issued a receipt)

  12. IOM responded to my email saying that the cost is usually estimated which might be less because of certain vaccinations as determined by the doctor. For instance if one had chickenpox before their first birth-day and got the first dose of varicella then that vaccine is not necessary. That got me thinking... now who will start verifying all these stuff. They also said that all the medical procedures are done at their facility because I had asked if there is need to do the X-ray and other vaccinations elsewhere before the medical exams.

  13. That is a real bummer! my goodness they made him take them again?? I just wrote an email to IOM asking them the same questions. I will let you know what they say. From USCIS to NVC and all the phone calls, tracking on-line, on-line forums, forms and applications you would think there would be no bump in this road besides the interview itself. Thanks for letting me know we were going to take chances with doing some of the vaccines outside in order to eat into the overal cost of the medical exam. Wow!

    on July 10, 2014 at 07:30 am. It is a four page PDF.I need to see what feedback we have on the country portal.

    So there you have it my people. I was planning to call tomorrow first thing in the morning. I called on Tuesday and was told we are still waiting for the embassy.

  15. Looking at the replies, I noted that today many members decided to call just for the heck of it and it is Friday after all. so I called again ( I had called in the morning) and had to wait for like 27 minuts as I worked, before I was told that they are waiting for the embassy before they schedule. I asked if the scheduling is done on a particular week of the month. She said that right now they are scheduling for the month of July. Crossing fingers....
