  1. Hi folks,

    I am getting ready for my AOS interview (in about 2 weeks time!), I have gathered a lot of documents that they have asked for but I have a couple of questions below:

    It states that "unless already submitted" I need to bring documents which I earlier had submitted for the green card (I-864, , etc). Do I need to bring these again?

    It asks to bring the medical report, including vaccination document again unless already submitted. I did my medical back in the UK when I was applying for the K1 visa - do I have to get another medical for the AOS interview now? ...I do still have the vaccination report which I thought would suffice.

  2. Hello there,

    I sent off my AOS packet which was received in Chicago on July 28. The packet also contained my AP and EAD applications.

    However USCIS haven't deposited my check yet (9 days later). Needless to say I'm a bit concerned about it as most folks here say it should only take a few days to see the check go through - does anyone know what the best way to reach USCIS would be to ask them about it?

    So I received my K1 visa:-)

    Now I am just making the final preparations before my flight to the US to marry my fiancé.

    I'm a bit confused by the requirements in order to get a marriage license in California - can anyone point me in the right direction as to what is needed on our end to get one?

    One site says you need to show your green card if not a US citizen - obviously I wont have one of those until after we are married.

  4. Hi folks,

    A question on the EAD...

    I know that after the foreign K1 holder marries the US citizen, he/she can apply for AOS and EAD.

    Can the K1 visa holder apply for the EAD before the wedding while in the US, and apply right after the wedding when doing the AOS?

    What I am hoping for is that if both of these EAD cards are processed, it would allow for a seamless transition, allowing one to work before (albeit for a short period) and after the wedding.

  5. Hi folks,

    I am going to be using a co-sponsor as well as my American fiancee for the affidavit of support. I have the interview coming up at the embassy in London in 2 weeks.

    Apart from the affidavit of support and associated supporting financial proof such as employer letter and tax docs what else do I need to provide for my co-sponsor?

    Just wondering if I'll need to being a copy of his passport or something else?

    I have my K1 interview coming up at the embassy in London next month. I have two questions;

    1. I was previously in the US a few years ago on a J1 visa, would they be likely to ask about that? E.g. dates, what I did etc? - Just want to know so I can prepare.

    2. How much proof of relationship do I need to bring to my interview? - I've heard that some embassies such as London don't even ask for proof of relationship at the interview stage.

  7. There's no tax issue here as I wouldn't be receiving payment during the wait time for my EAD after I'm married. The company isn't interested in hiring a US citizen. They want me to act as an agent/independent contractor for them in the US. They are trying to facilitate me here so I'm not sure what that has to to with the whole "taking a job away from a US citizen".

    Also what if I apply for an EAD card as soon as I arrive on the K1 before the wedding and just apply for the EAD again after the wedding? I think the fist EAD expires either after I'm married or after K1 expiration date. Just some ideas, let me know what you think guys.

  8. Novedsac, to answer your question, it wouldn't be a deferred payment.

    The company are suggesting me being an independent contractor for them in the US rather than an employee. I would simply not be paid anything while the EAD is in the process. It's a strange thing they have suggested for sure, but their thinking is that it would allow me to hit the ground running when my EAD comes though and not have to go through what can be a lengthy process finding employment at that stage. They would be making up this role for me simply because they have valued my contribution to the company while an employee here in the UK. Hopefully this sheds more light on my scenario.

  9. Thanks, I don't think the scenario you suggest would work for me Yang-Ja as I am not a Canadian citizen but an Irish one.

    I'm not sure if this is the best place to post this but I have a particular question regarding EAD once married on the K1 visa.

    The company that I currently work for (Canadian based) has offered me a position in the US after I get married on the K1 visa. This role would be one where I would work remotely - ie, I would be reporting to the office in Toronto but would be working out of the US. Because of the restrictions around working while waiting for the EAD, they have suggested me doing the role but not actually getting paid until after my EAD comes through. They see it as a way to keep me connected to the company but not breaking the law. I wan't to abide by the law so I'm just wondering if this would be illegal.

  11. If there is only a two day overstay, that should not affect the K1 visa, as the ban only kicks in at 180 days.A few more questions at the interview maybe, but that should be it. The problem arises if there is something else attached to the overstay, such as deportation, missrepresentation or similar. Did they give her any paper or write anything in her passport when she overstayed or was refused entry?

    Penguin, would a k1 beneficiary get asked about an overstay of a few days at an embassy interview... or would it come up in the NVC background checks?
