    Did anyone ask for a name change on their N-400 form? I'm curious to find out if those individuals that have requested a name change on the N-400 will have to wait longer to take the oath ceremony after they pass the interview? I read somewhere online that a judge needs to give the oath ceremony for those that have requested a name change, not an immigration officer.

  2. Hi Erinandahmet! We were at the CSC, but have now be transferred to the NSC. We didn't apply for the N-400 yet because we don't want any confusion. I do know that you can apply if you'd like before your I-751 is approved, but we're choosing not to until we get the 10 year green card first. Don't want to confuse anyone in immigration. 

     

    You might want to make an InfoPass appointment for an I-551 stamp in your passport if you haven't already done so. I think that is what pushed ours along. Hope that helps out.

  3. Hi all! We're February 2017 filers and went for an InfoPass appointment the beginning of last month and received the I-551 stamp. We just received a letter in the mail  yesterday stating that our case has been transferred to the Nebraska Service Center. Hopefully, we'll hear something soon!

     

    It sounds like quite a few of our cases are being transferred to Nebraska. Best of luck to everyone! 

  4. A big congratulations to those of you that have received your green cards!!! It's awesome to finally hear that they are rolling in slowly but surely.

    We're still waiting here. I'm going to place another call this week to USCIS to check on status. The last time I was told by an officer here in our local office that they were going to have our case transferred to the local office, which would take 30 days. It's been past that 30 day mark so, I figured I might as well call again. We're also a potential waiver case so, that's probably why it's taking so long.

    In the meanwhile, I did mail in the EAD combo card renewal this week after a USCIS employee told me it wouldn't be a bad idea just in case.

I just posted a similar question in the Potential Interview Waiver forum since we received the waiver letter, but thought I'd post here too since we filed in July of last year and I'm getting ready to renew my husband's EAD/AP combo card. I'm curious to as to what to put for current status? AOS pending?

    I do know that we're supposed to still use the C 9 as we did before on the original documentation.

  6. Hi everyone,

    I'm getting ready to fill out the form I-765 to renew my husband's EAD card. We're also a potential waiver case and was told by USCIS that it would be in our best interest to renew the combo card so, I'm working on the documents and thought I'd ask to see if anyone knows what I should put under "Current Immigration Status"? On the original EAD it was "K-1 Visa Holder". Would that still be the same or should I put "Pending AOS"?

  7. I thought I'd share something interesting.

    We went for our biometrics back in August of 2014 and received a Potential Waiver letter in November 2014. Haven't heard a word since so, we contacted USCIS two weeks ago and was told that our case was at our local USCIS office.

    So, I waited about another week and called USCIS to see if they can request an update on our case so that we didn't have to make an InfoPass appointment and take time off of work to find out the status.

    So, I get this call from the local USCIS office that tells me that our case is still at the Nebraska Service Center. That left me totally confused since the USCIS main number told me it was here locally. Unfortunately, my husband and I were both at work when the Officer called otherwise I would have questioned it. Their message basically stated that they were going to request our case from the Nebraska Service Center and that it would take 30-60 days for them to make a decision.

    Also, I did find out that you can renew the combo card 120 days prior to it expiring. The main USCIS office suggested that I do so since they are behind.

    So, then I find out that the USCIS main number cannot tell where the case is at. Whether it's at a Service Center or your local USCIS office. At least that's what I was told when I contacted them again to ask why I was told it was at my local USCIS Office.

    Hopefully, me calling sparked our case to get moving again.

    It's basically a general question not related to any particular type of visa, but just someone who is here on a visa and not within their country to vote.

  9. Good morning everyone,

    My husband and I are in the process of waiting on his green card and it just hit me yesterday that he missed the elections in Peru since he is here.

    I do know that in Peru you are forced to vote and if not, you get fined. How will this work if we go to or move to Peru someday and they see that he hasn't voted in years? Will he be fined for all of those years that he missed?

    Also, if the two of us end up being dual citizens for both countries do we have to go to Peru just to vote?

    Wasn't sure how all of this works so, I thought I'd post it on here before I call the Consulate.

  10. I wanted to post my own reply to this thread just in case it's of any help to anyone in the future . I called the USCIS this morning and talked to a gentleman about my situation. He was going to change it on the AOS paperwork, but said that it might cause some problems with my husband traveling in the future so, we left it as is. He suggested that I wait until after he fills out the N-400 to become a citizen and at that time they will ask him what name he would like to go by. Unfortunately, that means we're going to have to update and change his name on a bunch of stuff, but I guess there's no really easy way to go about it. Hope this helps out others in the same situation. You may want to change it on the AOS paperwork prior to sending it in as Diana suggested above. Unfortunately, I asked the question too late in the process.

    You're right, it's best to do it now then wait until you have to change literally everything.

    In that case I recommend you make an Infopass appointment so you can talk to someone in person and see if they can update your husband's information in their system. Hopefully with them updating his name in the system, they will issue his green card with his first, middle and father's last name.

    As for his SS record, they won't update his name in their system until the USCIS makes the update in theirs. So, once he gets his green card with the correct names, you can go back to the SSA office to update his records and get a new card.

    It's best to do it now because otherwise he will have to wait three years before he can apply for citizenship and in three years his incorrect name will be used by everybody like the DMV, your bank, leasing office or mortgage companies, credit card companies, IRS, W2's, school records, etc.

    Hey there:

    My husband received his biometrics appointment letter for both his EAD and AOS applications (the receipt #s were both on there), and he completed biometrics yesterday. That said, on the USCIS case status, our EAD receipt # is in initial review, which is fine, but AOS hasn't moved from "Acceptance" to initial review ever--even though we received our NOA1 confirmation, receipt #, and biometrics listed it on there as well. Is anyone else having this problem?

    Below on the USCIS case status, it said the "Acceptance" stage is usually completed in 2 business days after receiving an application.....but it's been a few weeks. If the file was to be returned because it was incomplete or misfiled, we would never have received a receipt number with proof that we paid all the fees (we DID receive all that), would we?

  13. Did he apply to adjust status yet? If not, that is the place where he can request what his name should be on his permanent residency. By writing his name on the I-485, he's telling the USCIS what his first, middle and last names should be. Since the maternal last name means absolutely nothing here in the US, nobody uses it, he doesn't have to include it in his application, unless he really wants to for sentimental reasons, but in all honesty, adding it just complicates things from here on out. He also needs to do this when he applies for his SS#, fill out the application the way he wants his names to show on his card.

    If he already filed for AOS, then he will have to send a separate form to have the names on his permanent residency/green card changed.

    Also, there is no need to wait until he's a citizen because he's not making a "legal" change to his name, he's just telling the USCIS the order of how his names should be recorded and filed.

    Thanks Diana for all of your help. Yes, we already applied for his adjustment of status. I wish I would have posted this question earlier. lol He's already applied and received his social security card too. :(

    Do you think now that his social security card and his AOS paperwork along with everything else reads the name that is wrong according to US standards that I should just wait and do the legal name change thing after he applies for citizenship?

  14. Hi everyone,

    My fiance arrived here in the states from Peru and of course the immigration officer entered his name into our system here with his father and his mother's last name and totally took out his middle name (the one that he actually goes by). We need to take off his mother's last name and get his middle name back.

    I've been reading that it's best to wait until he applies for citizenship here and that he can change his name for free at that time, which is great, but I can't change my name since I'm married to him until after he changes his. So, I'm patiently waiting. Any suggestions on what would be the most economical thing to do?

    Thanks a bunch for all of your help. I'm sure there has to be someone on this forum from a country where they use the mother and father's maiden names together that might have gone thru the same experience. Any advice or suggestions would greatly be appreciated.
