    Yes, the letter says I used an outdated form. I'm 100% sure it's their mistake and I'm upset. 

     

    The most current edition is "Form G-1145 09/15/14" which expires(d) 09/30/2016.

    So I submitted my application using the expired (but current) G-1145 and got a rejection letter, stating that "the application/petition was filed on an outdated version of this form" (#######!!??). Was this an error?

    Here's some more information about this petition:

    Visa laws must be changed to allow for family unity and tourism in the U. S

    Current U. S immigration laws states that for a person to qualify for a visit visa to the U. S such a person must have strong ties that will compel them to return back to their home country after the duration of their stay. Such a requirement is a little bit hard to meet for majority of the visa applicants and in return they are refused visas. Also, with the immigrant visa applicants, they are made to undertake medicals, get police clearances all without any assurance of being issued with a visa. Immigrant visa applicants pay huge sums of money to undertake these medicals and police clearances and in the long run can't be promised if the visa will be issued or not. Also, consular officers should not be given the sole power of issuing U. S visas. Most at times that power is abused.

    Make sure you have someone who can write more professionally for you. "Such a requirement is a little bit hard to meet for..." This is a no-no in professional writing, dear.

When you take the oath of citizenship the USCIS will take and not return your foreign passport because as a condition of becoming naturalized you have renounced all other loyalties to other countries which means you have also renounced your citizenship and the USCIS will return your old passport to the country of issue (the way I understand how it works). If you want to leave the US soon after naturalizing, then you need to get an expedited passport.

    I highly doubt the U.S. government has the authority to confiscate foreign passports...

  10. Due to the possibility of my future job placement, I started thinking about me becoming a U.S. citizen before I lose my physical presence requirement.

    Here's the scenario.

    I've been a LPR since July, 2014. I'm removing conditions in less than two months (April). I'm eligible to apply for citizenship next April (2017).

    If I apply in April, 2017 and leave the U.S. immediately but come back for finger-printing, does that affect my eligibility to naturalize? I'll have met my physical presence requirement because I haven't left the U.S. longer than 2 or 3 weeks in the past, totaling maybe 1 or 2 months out of 12 months.

    April, 2017 --> N-400

    April, 2017 --> after submitting N-400, leave the U.S. temporarily

    XXXX, 2017 --> finger print

    XXXX, 2017 --> NOA and interview.

    Will I be asked why I left the U.S. after I submitted? I'll be able to fly back to the U.S. maybe every 1 or 2 months. Will that suffice? Again, I'll be able to come back for finger-printing and interview. I'll have a U.S. address in the U.S. with my partner. So that's not a problem.

    Could somebody identify red flags? If no red flag, has somebody gone in this route?

  11. Japan doesn't allow dual citizenship. You lose Japanese citizenship by becoming a naturalized citizen of another country unless it happens involuntarily.

    Even if you fit certain criteria, Japan will require you to choose one nationality or the other within two years of getting citizenship somewhere else.

    Japan and American both require you to use their respective passports for entry and exit if you possess them. An immigration official at the airport can figure out you have dual citizenship by using the entry/exit stamps, length of your absence, and lack of a visa stamp (or card). America permits dual citizenship but Japan doesn't. Outside Japan for over 90 days? Where's your visa??

    I think there are two things to consider:

    1. Is there any chance you will ever move back to Japan or stay there for an extended period? (take care of family, retire, whatever)

    2. Does the possibility of losing Japanese citizenship bother you more than the hassle of reapplying for the green card after an extended stay in Japan?

    I would get US citizenship and assume I will lose the Japanese one by the time my current passport expires. If you are thinking about the long term or a worst-case scenario, Japan is not a forgiving place for starting over. Especially for women.

    I do not consider losing my Japanese citizenship a big deal at all. I live in the States and this my home. If I ever move back to Japan, it's super easy as a 'former' Japanese national to get an appropriate visa through my parents.

    Anyway, I was curious to know if anyone left the U.S. immediately after naturalization and applied for a U.S. passport. Several days after I posted this, I went to the Consulate General of the U.S. in Tokyo, and it states that a certificate of naturalization is all it takes to get a first U.S. passport. So...the upshot is... it is possible to apply for a first U.S. passport abroad. I answered my own question!

    I'm a Japanese man married to a U.S citizen man. We're sort of in the same boat. I got my GC last year, and I also discussed with my US spouse about moving to Japan possibly. Unlike Canada, same-sex marriage is not legal (but not illegal) in Japan. So that's the only reason we live in the States for now. I know how you feel about living in the South as two married women. At the same time you're lucky you can choose which country to live in, an option that we do not have.

    I think you have a good reason to move to Canada. You can apply for a re-entry permit, which is good for two years. So you both can move to Canada and see how things go. If you'd prefer to live in the States, you can safely come back to the States without having to start over your GC process.

    I'm relatively happy living in the States. I say happy because living in the States is the only way for me to live a happy life with my partner. I really wish I could live in Japan, but he'll be treated, from a legal and immigration perspective, as a total stranger to me (or BFF). Canada and the States are like sisters/brothers. The fact you're married to a U.S. citizen gives you more freedom.

    Hey everyone,

    I was just wondering if there are any couples here that ended up moving back to Canada, or are thinking about it either for the immediate future or long-term.

    I ask because after going throught he US immigration process, and discussing about moving up to the west coast, we are questioning if whether we would be happier in Canada overall.

    We don't have strong ties in the US, or many friends here since we are always working and trying to save money, and all my friends/family in Canada are really the reason we'd like to be back in Vancouver.

    We are just so stressed, and both severly depressed living down in the south, especially as two married women. We live in a small town, and I come from a big city. I don't have my license, so it's hard for me to get around (no transit system/cab system) without constantly relying on my wife. It makes me feel really dependant on her, and she has to do most of the running around/errands etc. I would just like to be back in a functioning, beautiful city again.

    I also haven't had any health care since I've been here, being that we are just barely getting by financially, and that's scary to me.

    One issue is that my wife had a DUI when she was 18, which essentially makes her inadmissible to Canada, and we'd have to go through something called "Rehabillitation" before getting her permnanet residency in Canada. A huge pain, but we'd probably move up to Seattle and just do it all from there.

    I'm just really curious if any other couples are in the same boat, and are really not happy living in the US?

  13. My two cents from someone from a VWP country. Once your B visa was denied, he cannot use VW again ever (and you mentioned this). The only option he has is B (and he did apply). ESTA will not be approved because he's been denied at least once. There are several ways to get the situation changed. One of which being that he gets a job and he can have his supervisor/employer write a letter indicating he's coming back after a certain period of time. This is one way to show he has strong ties to the UK. I cannot think of anything else. A letter from a family member isn't good enough.

    Now that the U.S. consulate is suspicious of his visa application activities, he needs to be honest. He really needs something to show that shows his life situation (got a job) has changed, and that he can prove to the CO that it's plausible. Just to be realistic, a trip to the States doesn't like like a doable plan. But it might happen. Who knows.

    I never thought it would happen to me but it did, so i try to deal with it as best as possible.

    I just received a letter from USCIS that I need send in proofs in order to remove my wife's 2-year conditional status on her greencard.

    The problem is as soon as my wife got her green card two years ago when she came to the US, i've rarely seen her. She told me to go find someone else. She went back to her country Vietnam twice. The first time, she went back for 1 month and bought a piece of land in her hometown for $35K. The second time, she goes back for 5 months. She hired an architect to draw up her house and hired contractors to build her a nice 3-bedroom house for $50K. The cash she saved by working under the table while in the US as a cosmetologist. She doesn't want to pay taxes. She told me that once she got her 10-year green card, she will stay in the US for 6 months working for cash only, then go back to her country and stay there for 6 months.

    She even sold the wedding ring I bought her to pay for her house. she's only been in the US for 1.5 years, and she's already gone for almost 1 year. She has friends in Texas, so she goes there twice already one-month each time to visit them.

    So i've been used. I've been used by someone to get a greencard. I know, I thought I was bulletproof and now it happens to me.

    We pretty much live separate ways. I NEVER put her name on bank accounts, utility bills, rental apartment, health insurance, car, nothing nada. When I file taxes, i even claim as single, not putting her name on tax returns.

    Now USCIS wants me to send in proofs that we have a bonafide marriage. The irony right?

    She is in vietnam now since January and she won't be back in the US until Jun 15. Her greencard expires on Jun 16.

    So what are my options? Write a letter to USCIS and explain everything or be a nice guy and help her get her 10-year greencard? I feel like she's a complete stranger to me now.

    "If an LPR is employed abroad or has to travel overseas for a considerable length of time, it is preferable for his/her immediate family members, including any spouse, children, and parents, to remain in the U.S. Documentation of strong family ties to the U.S. shows the LPR's intention to keep his permanent resident status."

  16. Hello everyone -

    I received my conditional GC last year. I may be accepting a job offer in my home country starting this August .This is not a permanent job, and I plan to live there for one year until I find a different job in the U.S. I'll be coming back to the States in time for removing conditions. During that one year, my partner and I will make frequent trips back to the States. Will I still need to get a re-entry permit? Thanks in advance!
