    On 11-17 I got the email stating we were being sent the the welcome letter etc.

    Today I got the EXACT same email above with the ADIT line etc... perhaps, hopefully, it is just a new standard form letter.

    I went looking for what ADIT means: Alien Documentation, Identification and Telecommunication System (ADIT)

    I got the same email today... soooo... not sure yet!

  2. Could you please explain to me what is the meaning of this email? My case never been touched until yesterday when i checked my status online and said that last update was on 08/31/06, but i saw the changes on my status yesterday. I did my biometric on 08/30/06. Thank you!

    That just says when they got your application. Your "last touched" date can change but the status of the appliction might not. It's not uncommon for several touches, or the last touched updated to change, prior to the case status changing, which will change what it says about your case.

    When your "last touched" date changes it just means someone is working on your case. It doesn't mean that status will change.

  3. We went to the AOS interview yesterday and were approved.

    This morning we received the "Welcome Notice Sent" email about our case.

    My question is this, does that mean they are done and 100% they are sending us the green card? Or could we still be held up by a FBI name check or something else?

    Sorry for the question, little confused at this point. My wife really wants to travel back home for Xmas and I want to look for plane tickets, trying to make sure we are really done.

  4. Not like it matters, our AOS was approved today and we should have our greencard in 2 weeks, but her EAD card showed up today.

    I found it interesting we got the email yesterday say we were approved, when I went and looked at the USCIS site yesterday morning nothing, last night it showed approved on the 14, so the system took a day to update and email us.

    Then today, 2 days after approval my wifes new shiny EAD showed up in the mailbox.

    The approval letter says we were approved 11-14. The cards says valid 11-01-06 to 10-31-07.

    Do they always back date them to the first of the month?

    Not like it really matters.. AOS was approved today and we should have our GC in 2 weeks...

  5. We had our interview this morning in down town cincinnati. After spending 30 minutes finding somewhere to park my over sized truck we were one minute late to the AOS interview. (Note to self: drive wifes car not F-350 Crew Cab long bed down town. I was refused parking at 4 lots!)

    10:00 AM interview time.

    9:55 Arrive and clear security, luckily no line.

    10:01 Waiting room, we are literally the only people inside, go to the window and check in.

    10:10 called back by a very nice woman, Mrs Bennett (Maybe her name??)

    Raised our right hand and we were sworn in.

    Checked our ID (passport both me and my wife).

    She asked my wife about 10 to 15 questions, nothing besides what was already on the I-485.

    Asked my wife how we met.

    Asked if I still had the same employment but didn't ask for verification.

    Asked me what proof we had of a real marriage. I explained this was hard for us because our bank wouldn't allow my wife to join my accounts until she has a SS#. She said she hears that alot. We had our health insurance card with both of our names on it and I had several pictures of us together which she didn't even look at. She kept a copy of the insurance card for her records and then said we were approved.

    My wifes EAD card was approved yesterday and she told us to shred that the day we get the green card. She told us if we can wait to get our SS# with the GC so we wouldn't get the restriction (already knew that).

    She explain about the 2 year GC condition and told us to bring a lot of proof to that interview. (knew that!)

    We should have our green card in 2 to 3 weeks (so she says!).

    I asked about getting a stamp so my wife would visit home and was denied. We were told we were approved and everything was in order, we'd have the GC in a couple weeks, if we don't have it in 30 days we can infopass and they will stamp us at that time.

    All in all like everything else besides the waiting it was really a breeze, we left the office at 10:22.

    Now just waiting on the email updates, welcome to Amercia letter, and the white/green card.

  6. I was in this exact situation back in 2004. She was here, we weren't married, and it wasn't working out between us.

    I told her we couldn't marry and I gave her the choices.

    I'll buy you a plain ticket home.

    Or you can move out and do everything for your self without my help, you will be an illegal alien, deportable, and on top of all that you will get a 3 or 10 year travel band to the USA once they catch you (assuming they caught her more than 6 months past her visa expire date).

    I was very civil to her, I made sure I never touched her in any way that could be perceived as domestic violence. I didn't even tell her she had to be out that day or the next, I would give her a month to find a new place to live before I would take legal actions to have her removed 'legally' (evicted) from my house.

    She was a decent person and thought about it for a day. Then she got *really* nice to me for a couple days trying to get me to change my mind, then she finally gave up and asked for the ticket home.

    10 days later I took her to the airport and watched her get on a plane goodbye.

    The best thing that can happen to you is A, she goes home, or B, she moves in with someone else. At that point you're 100% done with her, the rest is her problem. If she stays in the states but moves out GET IT DOCUMENTED! Pay to have the locks changed, that way she can't produce a key to the door.

    Protect yourself... be nice, always be calm and don't lose your cool. Check into your states law about evicting a non relative from your place or residence (in most states you can evict someone even if you don't own the building, you're the one leasing and you have rights.) Google 'evict roommate' and your state. In OHIO I would have had to take on formal eviction proceedings ($100 and 15 days to complete), in NY all you have to do is deliver it in writing 30 days prior to wanting the roommate out. It all depends on your state.

    The hardest thing to do is to remember your apt and the things in it are just that, things. They aren't worth getting in trouble for, so worst case be prepared to walk away and live someone else while the eviction moves forward. You can always strike first if you know it's going to be bad. Move everything out while she is gone one day and live with a friend for a month or 2.

    I prepared for the worst once I made the decision she had to go... but it really turned out to be an easy thing.

  7. You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2( b )(10)(ii) until (90) days after the missing intitial evidence is received.

    And this is for an RFE on your AOS, not EAD.

    Just because one part of the law says they must do it within 90 days, doesn't mean another part of the law doesn't give them exceptions. Case in point: I can show you where it's illegal to kill someone under US law, but I can also show you were it's legal if you're under threat of serious harm or death. For every law there is an exception somewhere...

  8. An RFE for the I485 slows down processing for all the interim benefits that are concurrently filed. All of your petitions 'stopped' with your RFE. So the 90 day time-frame in which they are supposed to issue the EAD gets thrown out the window with the RFE.

    Nowhere in the CFR does it say this. The language in the CFR is:

    The district director shall adjudicate the application within 90 days from the date of receipt of the application by the INS. Failure to complete the adjudication within 90 days will result in the grant of an employment authorization document for a period not to exceed 240 days.

    It does not say "...unless an RFE is issued for a concurrently filed benefit."

    It says it somewhere else.... I'll find the verbage for you and post it, but you're reading one little part....

    If your EAD is based on your AOS, which if your married it is, then your EAD can't be processed until they have all your paperwork for the AOS. You have no leg to stand on until day 91 after the RFE shows returned in the USCIS system.

Even if your RFE doesn't mention anything about your EAD, your EAD authorization is based on your AOS application, and since your AOS application had an RFE, the clock on the EAD 90 day time limit starts OVER the day they receive your returned RFE. (And it's the day they put it in the computer, not the day they actually received it!)

    We were in the same boat as you, except we at least have an AOS appt tomorrow. We had an RFE for tax returns, which like you I sent the first time.

    I just got the email, our EAD was approved today. AOS appt tomorrow, so that about makes since. We're at day 67 since our RFE was show processed back by MSC. I was told I had ZERO recourse to do anything about the EAD until Dec 8th, the 91st day after they show the RFE returned. Period, end of story if your AOS has an RFE.

    Like you I couldn't see our AP online for months, on top of that our EAD didn't show online for over 3 months, actually it was day 106 before they ever showed up online. That's because on day 92 I sent a snail male letter to the 'status inquiry' address asking for an answer to our EAD and AP, I also mentioned I was going to write every 14 days until an answer was given or at least the internet was updated. I had called the misinformation line 3 times and was told they would fix our AP and EAD and get them online, never happened. Our AOS only showed up the day they sent us the RFE. 2 weeks after sending the snail mail both my AP and EAD showed online.

    So on day 123 we have EAD approval via email.

    Day 124 (tomorrow) we go for our AOS.

    AP, still nothing...

    The adventure continues tomorrow at 10am...

    Hang in there, you will get your EAD, probably about 70 days after the date they say you returned the RFE

  10. Hi everybody....here's a little update of our busy 2 months. My husband's AOS was filed September 27, 2006 in Chicago. We e-filed for his EAD October 10. His biometrics for his AOS was October 17, so when he was there, he asked if he would be receiving a biometrics appointment for his EAD and would need to return for that. The man there looked at his NOA for his EAD and went ahead and made a second photo and prints and stamped his letter, but we were sure he would still get a biometrics appointment, which he did. :blink: So, to make sure everything was done to PLEASE, we went the second time also, and he told them what they did the first time, so they didn't take his photo or prints. We kind of figured he'd be getting approved fast because by the time we went for his EAD biometrics, his AOS had already been transferred to CSC on October 25. Like someone else posted before, these days paying the $180 for the EAD can be considered by some to be a waste of money, or you can look at it like an insurance policy for "just in case." ANYHOW, last Thursday, November 9, he got his WELCOME letter and we spent the entire day in AWE of this letter. I joked with him and said, "Wouldn't it be great if you got your green card tomorrow?" He thought nooooo, it would be 3 weeks at least like the letter said, BUT...guess what?! The next day, November 10, this beautiful card with this more beautiful photo arrived~! Today, we went to apply for a new SS card without the DHS authorization only stuff on it. He'll be working soon WE HOPE.

    Also, for the record, the online status changed for his AOS but stays the same for his EAD which I suspect will remain that way because that doesn't really apply anymore.

    We applied for all 3 121 days ago. Still don't have AP or EAD. AOS interview in 3 days, maybe we'll finally get some where.

    Seems some people get through in 5 weeks, others are lucky to get anything done in 5 months.

    What really irks me is my RFE was for something that was clearly marked in the first package, I sent the exact same info in the second time and they took it, go figure.

    If we don't have our green card or EAD in hand by Dec 8th I'm going to go to the local office and raise holy cain for at least our EAD.

    I finally can see our EAD/AP online as of Saturday. I called NBC/MSC 2 times in the first month trying to find out why we had NOA's for our EAD/AP/AOS and couldn't see anything online about them. I was told they'd fix it and was given the run around.

    Our AOS came online with an RFE, still couldn't see the AP/EAD.

    Finally we resorted to writing to NBC using the "status inquiry" PO box. 10 days later the EAD/AP showed up online, they aren't done but at least they are online now, day 106 and they are online.. WOOOHOOO... way to go NBC/MSC (lots of sarcasm!) We were so excited just to see our unapproved applications online!

    I did state in the "status inquiry" I was going to write to them every 2 weeks until they fixed the issue or we had the EAD and AP in our hands. Maybe they finally took me seriously?

    Sigh... ok USCIS, now that I can see them online do you think you could approve them please? I think I'm getting paid back for getting my I-129F completed in 13 days at Nebraska. That one set a speed record…

  12. Hi All..it's been a while and missed everyone.

    ANYWAYS, here's the deal:

    - We sent out the entire AOS packet (including the I-765) mid September.

    - About 4 weeks ago we received a letter from DHS saying our application has been received and biometrics are to be done on Oct 4.

    - On Oct 4 we went and had the biometrics done... no problem.

    - This week we received a letter saying our "case" has been forwarded to the California Service Center for "expediting" Mind you, I live in Jersey and Vermont is my service center (I had great success with the VSC in getting a super fast K1 processed)

    - The question is... where is the EAD? My wife is going crazy sitting at home with nothing to do but look up jobs on monster.com that she can't apply to yet.

    I thought the EAD was supposed to come in about 1 month after sending in the AOS app.

    Any thoughts?

    Btw, Vermont was only your service center for the I-129F ... And of course you would say Vermont was good for you ... You were approved in a measly 13 days ...

    Once you applied for AOS then you would normally go through your local office which wouldn't have been Vermont ... Your AOS being transfered to CSC is about the best thing that could have happened to you ... It is kinda like how lucky you were to go through Vermont for your I-129F instead of California ...

    Still waiting since Mid July for our EAD... can't even see it online yet.

    Waiting for our AP, can't see that online yet.

    Didn't get transfered to CSC either.. (sigh)

    You'll most likely have the green card from CSC before you have the EAD from MSC.

  13. Thanks everyone for your replies. We will wait (patiently) until our case shows up online and in the meantime try the tel # just in case they have up to date information.

    We have 3 MSC case numbers, 2 of our 3 cases still aren't online. We are approaching 90 days tick tock tick tock. Our AOS showed up online the day our RFE was sent out, but the AP/EAD are in no mans land.

    You have to be persistent to get information if you call, the first "group" that answers the phone only has the information on the internet, and they will tell you they can't find the cases. They have to transfer you to someone with more access.

  14. I know I'm going to get flamed for this, but I'm going to go against the grain on this one. I don’t find the PDF they send you at all out of line, if you look at it from their side it’s completely understandable.

    I distinctly remember after 9-11 how several of the high jackers received either visa's or resident paper work that was APPROVED. Would you have liked the INS to have done their homework more on the 19 high jackers that were in the USA? I sure would have.

    I know you know your husband isn't a terrorist, but if his name matches closely to a name on a list somewhere, then they are going to investigate until they are satisfied. They have to balance granting permission vs national security, surely not an easy thing to do. You must realize that Northern Ireland is considered a potential terrorist location, not directed at the USA (yet) but alas we are Britain’s closest ally.

    You are together, so enjoy your life together and don't let the USCIS get you down. I know spending $180 dollars sucks, but if 1% of AOS adjusters have to spend an extra $180 dollars to allow our government more time to research each application in detail then that's what's going to have to happen. Every poster on this board would be pissed as hell if the USCIS approved another high jacker. We'd all be calling for heads to roll and looking for someone to blame for letting them in.

    I get really steamed at the airport when people complain about having to take their shoes off. Last time I flew to Europe some lady was giving the officer lots of grief because they required the woman's elderly mother to remove her shoes. While I felt for the old woman I looked directly at the officer and thanked him. "Thank you for taking your job seriously, if you'll hold the rules to a nice elderly lady then I can rest assured no ones getting on my plane with their shoes unchecked.”

    I'm sorry your application is being held up, but everyone has been affected one way or another since 9/11. Some of us just our shoes. Some have had trouble even getting on board an airplane including a US Senator that was on the "Do Not Fly List", to those of us going through immigration.

    Cherish being together with your loved one, ignore the problems you can't control. Hope and pray our government is doing the best they can each day to check on each person entering or in the USA.

  15. Bly - where did you get that information? We did make an Infopass Appt. for my husband's EAD after the 90 days since filing had expired. We were told local offices were no longer issueing the EAD's and we would have to wait until a decision was made. I have contacted my senator and they are doing an inquiry so I'll keep everyone posted if I find out anything.

    I should have been a little more clear, local offices are still required to process an interim EAD, they don't issue it. Your local field office is still required to deal with your interim EAD, it is the law. They should have called the service center and had your EAD approved or an interim issued to you. Pay attention to: "Upon receipt of Form I-765 requesting an interim EAD, local field offices are required to perform the following tasks."

    Local Offices will no longer accept and adjudicate Form I-765 for an Interim EAD. The Service Centers or

    o Underlying application remains pending

Since the affected alien will be in the field office at the time the inquiry is made, the NBC and Service Centers will attempt to respond to any inquiry within 30 minutes of receipt. Inquiries made to a Service Center or the NBC after their normal business hours should be sent to the email addresses listed below, with the response from the Service Centers or NBC provided to the local office by 10:00 the next business day.

    Once contacted by a local office, it will be the responsibility of the Service Center or NBC to either adjudicate the pending Form I-765 or issue an interim EAD.

    This is about the orginal form I-765. I want to get a temp EAD based on the fact they haven't processed our EAD within 90 days. You don't have to file a form I-765 to get a temp EAD, all you have to do is show your I-765 NOA1 that's 91 plus days old.

    I just wanted to clarify that you do fill out a new I-765 right at the DO when requesting an interim EAD. So the policies quoted seem to apply to interims.

    You are right, I miss spoke. You do have to fill out another I-765 but the DO is required to take it and follow the steps listed. She was turned away and told they can't do anything, which isn't the case. My quesiton is how to I get an infopass appt to have them follow the steps they are required to take.

    This is about the orginal form I-765. I want to get a temp EAD based on the fact they haven't processed our EAD within 90 days. You don't have to file a form I-765 to get a temp EAD, all you have to do is show your I-765 NOA1 that's 91 plus days old. They are changing the rules to make all EADs go to the drop box in the hope they can elimnate Temp EADs at the offices, but that will only happen if the process all EADs within 90 days.

    Local offices will still have to issue temp EADs after 91 days, but without being able to get an infopass appt I can't get a temp EAD based upon the 90 day rule. ERRRR!

    Try to make an Infopass Appointment and print it out and bring it when u visit the office for your Infopass. In my case i make an Infopass yesterday eventhough im still 24 days in advance for my 90 days processing of EAD. When i talked to the Officer, he told me that it shows my EAD approved Sept. 20 and it should be in mail anyday, i just hope the mailman won't failed me :lol:

    Noted: I read that memo, at the Office front counter in Atlanta, but at the end of the note they put a reference email address for you to used for follow-up your EAD card. So if and when my EAD card didnt arrived in our house thats my last hope, bugging them thru email since they don't give interim EAD anymore.

    They are still required to give out temp EAD if the orginal EAD isn't done within 90 days. The memo change only affects them taking the orginal I-765.

  17. I may have missed this detail somewhere but I'm trying to determine what language will be spoken/expected at the embassy interview. Natalia will be going to the embassy in Kiev and speaks only Russian. Will she need an interpreter?

    Kiev has Russian, Ukrainian, and English speaking people so it's no problem. Now what they will ask her is how you communicate with each other if she doesn't speak English. My now wife spoke some English and I know some Russian (she even said it with a straight face), she told the woman we “Manage fine”.

    Kiev is a really easy embassy to work with, I’ve had 2 K1s in the past 3 years from Kiev, the last one early this year. Everyone was always really nice and helpful. Remind your fiancée at least 5 times to not open the brown package they send her with her Visa, or she’ll be making a trip back to the Embassy. After 3 reminders my wife still made the trip back to reseal the envelope. Excitement seems to prevail when the visa arrives!

    I’ve never talked to anyone that has been denied at Kiev, I’m sure it’s happened, it’s just really rare. Even on my second K1 in less than 3 years they were easy to deal with.

  18. Yeah, go to embassy directly and ask them. May we know what's inside that envelope?

    Yea I know whats in the envelope. Yea instruction from the immigration that how you can file for immigration after cheatign your US spouse :lol:

    My lovely wife opened her K1 brown package that she's not supposed to open. Embassy sealed it back up the next day no questions asked. The officer who helped her said it happens all the time and that she would most likely be refused entry at the POE if she had gone with it open.

    Luckily my wife lives 20 miles from the embassy so it was easy to go back.

    I will be glad when i have this medical sorted. Supplemental form 1 - 693 . Is what i need to get filled out. Will the doctors take the information from my Vaccines Record Card. Which i submitted to the doctors in Knightsbridge in London for the Medical for my K1 Visa. That is all i have. Thats where they got the imformation for the Immigration in London.

    Our doctor took a signed letter (In Russian) from Lana's home town hospital/doctor that was then translated to English.

    No questions asked. I would think a vaccines record card would be more offical than a hand written letter on plain white paper.

  20. We're 14 days out from our 91th day so I thought I'd see what infopass appts are available. When I try the infopass scheduler at uscis.gov I get this:

    "At this time, there are no information appointments available for the office in your area. Please try back again later."

    It only does this if I choose "It's been more than 90 days since you filed an EAD blah blah blah".

    What a F'ed up system. Can't see our EAD and AP applications online. Got RFEd on the I-485 for something I included in the orginal. Might not even be able to get a temp EAD cause of that, and now I can't even TRY!

    UUUUUGGGGGGHHHHHHHHHHHHHHHHHHHHH! Banging head against keyboard.

    Ok, I feel better... anyone ever see the above error?

  21. They do not take your AP, it is valid for its duration, once you adjust you then use your GC.

    My office does not stamp, sounds like in due course none will, for some reason its taking them a long time to change.

    SO they take your EAD but not AP? Ohh.. this would be really good....

    Anyone one else kept thier AP post AOS interview?

    I still have my EAD, you need it until you get your GC. In my case it came within a week, some take months.

    My understanding is they generally take your EAD with an approved AOS interview. Maybe your FBI check wasn't done???

  22. Hello All...

    I have some questions. Lana I weren't lucky enough to get transfered to CSC, I got our interview appointment letter a day or 2 ago. We are to be at the INS in Cincinnati Nov 16th at 10:00AM.

    Here is my dilemma, once we get her AP (if we ever do!), I was going to buy her a ticket to go home and visit her family in Ukraine from November 18th to Dec 27. Her dads 50th birthday is Dec 26 and she really wants to be home for that!

    Let’s say we go Nov 16th and she's approved. She should get a 551 temp stamp, but I have heard some people saying they haven't been given one. Most seem to get one, some don't. My understanding from reading other AOS posts is that if she is approved, and I see no reason for her not to be, that they will take her AP and EAD at that time. What if she doesn't get a 551 stamp, are we basically screwed and she can't leave. She's going to be unhappy and so am I, $1000 ticket down the drain. I have also read that some stamps have expired in 30 days, not 1 year. This won't work because she's planning on being gone about 40 days.

    If I wait until after our appt Nov 16th to try to get her a ticket home, that's going to cost an arm and a leg.

    Do they take your AP if your AOS is approved?

    Do I try to get her appt rescheduled after the first of the year? (not my first choice.)

    I also have the option of not getting her ticket until Nov 24th. If we go to the interview and don't come away with a way for her to travel, I would have enough time to send her ticket back to Expedia and pay the $200 to move her ticket forward whatever time is needed. Not the best solution either, but at least this is only a $200 risk, not a $1000.

    Any ideas, comments, experiences or suggestions are welcome. Anyone having an AOS recently at Cincy please contact me, I'd really like to know if you got a 551 temp stamp.
