  1. I'll throw my $.02.

    LPRs can be deported for certain crimes including theft, minor drug offenses, crimes of moral turpitude, etc. Citizens cant, unless the crime happened before you were a citizen or your citizenship was based on fraud.

    I know most people feel they are 100% law abiding so this isn't an issue, but you don't have to do something wrong to be accused of a crime. Furthermore, even if you are innocent your status as an LPR can be used against you. I know a LPR who was falsely accused of committing a theft crime, and the prosecutor threw potential deportation on top of the criminal penalties to force the LPR into a plea she would not have taken if she was a citizen. She probably would have won at trial but being deported was too big a chance to take, so she plead guilty to a reduced charge that she can't be deported for, but she had to plead guilty and that's on her record for life.

    Approx 200,000 LPRs have been deported in the last 10 years.

    Mistakes happen, I think most police and prosecutors treat immigrants and LPRs different than citizens. Just my $.02

  2. The end of our journey, my reflections on the Oath Ceremony and our journey.

    My then fiancée arrived in the USA 4 years and 14 days ago...

    Flash Forward to today: I witnessed my wife become a US Citizen. It was a nice ceremony held in Mason Ohio. We arrived at 8am, 2 hours of paperwork time. The Ceremony started promptly at 10am. It was personal, funny at times, and beautiful from start to finish. The local Boy Scout troop presented and removed colors, we had representatives for our state Senators speak briefly. The federal judge in charge kept everything light but yet serious at the same time, he seemed to have nack for telling a good short joke at the right time and being as serious as the situation deserves at other times. At 10:50 it was over, certificate in hand, we left.

    The 77 people sworn in today represented people from all corners of the earth, ranging in places I have been to, to countries I’ve never heard of. Eritrea is a country? Yes it is, but I had no idea until I googled it this afternoon. We had 3 former soviet countries represented, Korea, China, Vietnam, our neighbors to the north and south Canada and Mexico, Brazil, South Africa, in all 5 of the 7 continents were represented. (Sorry Antarctica and Australia!)

    I spent some of my day reflecting how life has changed in the last 5 years.

    When I was waiting for my K1 to be approved, I checked the USCIS site twice (ok maybe 15 times) a day for any update. It’s a difficult wait, waiting for your new life to start. Then her arrival, a mild yet sunny day in April of 06, followed closely by a wedding attending by friends and family alike. So many forms; K1, AOS, Work and Travel documents, removing conditions and citizenship. By the end of the journey we didn’t bother to look online anymore for a status updates. We were busy living our lives, snail mail updates were fine. Sometimes the USCIS mail would even sit unopened for a couple hours on the kitchen table, oh the travesty that would have been 4 years before.

    Of course many other things have changed, 4 years of marriage will do that. We are talking about starting a family. We’re going to apply for her American passport this week, oh, that will be a bonus, easy international travel! No more odd stares at the Cancun or Ontario airports having to fill out extra paperwork traveling on a Ukrainian passport. We’ll be able to visit some friends in Europe without having to obtain visas. We are both playing on the same level starting today, we are both Americans.

    This journey for us is over… I wish everyone else peace and god’s speed on their journey. I bid you all Adieu!

    Congratulations!

    I just got approval notice on 1/7, card is on the production, 3 months.

    My timeline: 10/8: I-751 mail out to CSC

    10/9: CSC received

    10/14: NOA 1

    10/22: Extension letter

    11/6: Biometers appointment

    1/7: Card production order

    It seems CSC really fast to process I-751.

    Wish all applicants receive approval soon, good luck to everyone.

    I think you may have too much! My wife's I-765 was approved in less than 10 weeks with about half of that info. The key is include something from every 3 or 4 months. I did 2 affidavants, 2 sets of airline tickets, 2 pictures, 2 different amex bills from different years, out federal tax returns, and finally a copy of our medical inurance card listing both of us. I spread the info out over the entire time picking something about every 4 months and was approved without issue.

  5. We filed out I-751 10 or so days ago, got the notice with our WAC09014xxxxx number yesterday and whenever I do a case status online I get:

    Case Status Retrieval Failed

    This Receipt Number cannot be found at this time in this automated system. Please check your case receipt number to see if it is correct. If you have questions or concerns about your case status, please contact the National Customer Service Center.

    From what I remember back from the K1 and AOS days generally by the time you get the first notice your case status should show online. Should I be concerned?

    Nevermind... I just did a search (after posting, Bad Me!)

    And found this: The number on the NOA is not the same as the number on the biometrics letter. It is the reciept number from the biometrics that will show your case on-line not the NOA.

    The 90 day window on our I-751 expires in about 2 months, but my wife's mother is very ill back home and my wife is there helping take care of her.

    If she stays out of the country past her green card expiration will we have any way to remove conditions? I'm at a loss here, can we do an I-751 with my wife out of the country? I'm wondering about getting the biometrics taken care of, can that even be done at a US embassy if she's out of the country?

    If we fail to file the I-751, once her family situation clears up how to we go about getting her back in the USA.

    I know that the best route is for her to return to the USA so we can process the I-751 but I can't ask her to leave her mother in that condition....

    Any thoughts???

    Thanks for the responses to my last questions. Here are a few more:

    1. I went to college in Pennsylvania for one semester (4 months) and then later on lived with my fiance in Canada for just under 6 months. I never considered either of those two residences my home, and there were always plans to return to my home in Massachusetts. No utility bills were under my name in Canada, if that helps. Do I need to list those under the former residences section?

    2. No matter how hard I press, I just can't seem to get the information all the way through to the 4th page (it's very very faint). How critical is it that I find a way to do that? Any suggestions?

    1: I would list them if you got mail there etc. It's better to list and explain them upfront then to not list them and the USCIS to find out after the fact. I assume you're the US citizen so you won't need police records for each place, so no point in not listing them.

    2: Download the PDF and fill that out, print 4 copies or hand fill out 4 copies, don't try to use the carbon paper copies.

  8. I received 3 emails from the automated USCIS system yesterday for our already approved AOS.

    We interviewed on the 16th, approved.

    17th our status changed, had the welcome letter sent.

    About a week ago we got the welcome letter, been looking for the GC every day since.

    Last night our status was updated to say we were approved on the 27th and a welcome notice would be sent and once again they were ordering our GC.

    Anyone seen this before????

  9. Brother or family need to apply for ( B ) tourist visa, they need to demonstrate strong ties back home.

    But now I understand why these are so hard to get. The rule is the consular officer must assume the applicant intends not to visit but to immigrate. The burden of proof is on the applicant. And it says they must demonstrate social, family and economic ties strong enough to "compel" the person to return after a short visit.

    Well, maybe it will work if just the mom and son comes, leaving dad at home for this trip. Guess we will just have to wait and see.

    If your wife is a LPR it's actually pretty easy to get a visa for her mom and dad, brother is another story. If memory serves me correctly any LPR can apply for his or her parents to immigrate to the USA and there isn't a wait beyond the typical I-130 filing. Because they have an easy way to legally immigrate it's not hard to prove there intent isn't to immigrate, that they only want to visit. It's a logical conclusion that mom and dad don't want to immigrate and to grant a tourist visa in this situation, so it's pretty easy to get.

    Brother is another story, he isn't allowed to automatically immigrate based on LPR of a brother or sister, so he has to prove why he will return to the his home country and doesn't intend to immigrate, this can be really hard to prove and visa are handed out sparingly from Russia and Ukraine in these situations.

    This is what I've heard (read) from other people, how true it is I don't know first hand, just throwing in my $.02.

  10. Our interview was a couple days ago.

    Simple questions, mostly the stuff on the forms. How we met. Nothing hard at all. Our interviewer was really nice, pleasent, well spoken lady perhaps in her mid 30s. She was even understanding when I told her it was difficult for us to prove our relationship because the banks wouldn't allow my wife on my accounts until I had her SS#, no bank accounts so I couldn't get any utlility bills in our name etc. She didn't even mind when I helped my wife understand a question or 2 that she was asking. (I know how to phrase a question so my wife understands) She kept one copy of our health insurance card that was issued to both of us and told us we were approved. The entire interview was about 10 minutes.

    It was a huge none event, if dealing with everyone was that easy life would be great.

    No, I have not filed the I-130, do I need to file that along with I-485 also? I ran across that in rereading the I485 instructions. My wife is here, entered legally, still on unexpired I94, and married here (she wasn't my wife before she came obviously) SO should that be filed with the I485 as well to Chicago?

    If your wife came here on a K1 fiancée visa to marry you then you don't need an I-130. If she was already here for a different visa type then you're going to need an I-130. A little more information is needed.

    Also, when you do your I-864 ignore the instructions for 1 year’s worth of tax returns and W2s. Send 3 year’s worth or you're likely to get a RFE. So many of us have, seems the USCIS is stuck in their old ways for the I-864 which required 3 years of tax returns. Including extra years won’t hurt you unless the extra years were below the 125% poverty line. I could have saved myself 2 months on the whole process if I had just sent all 3 years (including the W2s).

    The other thing is read all of the instructions and then follow them exactly. Then have someone you trust read over every form and make sure all the answers and items needed are included. Getting it right the frist time saves months of processing time.

    The newest I-864 is NOT notirized!

    However, include 3 years works of tax returns AND W2s even though it says 1 year. There have been a TON of RFEs for only 1 year of tax returns and W2s. (or lack there of tax returns and W2s.)

    If you request your tax transcripts from the IRS you only need those, but I would still do 3 years worth.

    Trust me, I know! I had the RFE for only send 1 years worth!

  13. I would say that by the time you actually have received the card it's probably OK to go apply. Do you not have an SSN or just applying for the unrestricted card? If applying for the unrestricted card, giving it a month or more before applying wouldn't be a big deal.

    We didn't bother to get the SSN yet... We were mega busy putting the wedding together prior to and it just slipped passed us.

  14. I know it's a good idea to wait 2 or so weeks after arriving in the USA on a k1 before going to get a SS#.

    But what about if we didn't get the SS# card then, once we get the GC is it still a good idea to wait 2 weeks for the save system to be updated, or does it happen faster? The SS# website says it takes about 10 business days for newly arrived people to make it in the SAVE system but it doesn't say anything about AOS.

    I was thinking the save system may get updated faster because we should already be in the system with the K1 entry.

    Anyone know?

    Try searching and reading before posting!

    Someone else posted the same thread elsewhere yesterday, and my answer to him would be the same: try googling the phrase you are looking for and voila....

    It does help that I know that the old photo poses were called 'ADIT photos' so I had a clue, but ADIT + Immigration will give you a lot of replies.

    Everyone can save themselves some worry/panic/curiosity by doing some simple searches.

    Perhaps you're out in left field. The "ADIT photo", I did google it's the old 3/4 pose photo that hasn't been used in 1 plus years, so why all of the sudden have several people been getting emails with approved AOS and mentioning ADIT photo.

    ADIT hasn't been mentioned on this (or any other board) I could find since mid 2005, then all of a sudden three people I can find got the same email or status update on the same day.

    Simple searches don't answer the question, so obviously you haven't done your google work.

    And it's not ADIT photo's, it's ADIT processing that our NEW emails state.

    Something is very new here, not very old and not on the searches.

  17. I think it's hard to say what the new notices mean until we see a pattern.

    I don't see how all these cases could be getting transferred without at least some going into namecheck.....

    Mine wasn't transferred to CSC. We had an interview Thursday morning and we were specifically told at the interview we had already cleared the FBI name check. Done, complete, she was putting in to order our green card that day. That was the morning of the 16th.

    Yesterday 11/17 we got the normal email:

    Application Type: I485 , Application to Register Permanent Residence or to Adjust Status

    Current Status:

    On November 17, 2006, a welcome notice was mailed for this case. If 30 days have passed and you have not received this notice. Please call the National Customer Service Center at (800) 375-5283 during business hours.

    Combine that with the other thread about the finger print new notice, and I think it's pretty clear the system was changed.

    We need a couple other recent approvals to check the system to see if their status changed.

  18. it seems as though they have some new notices. We did not gt touched but, the language of the notice changed.

    I'm thinking that the above statement is true. It seems they have new notices as I've found 3 people who got a different new notice today. So this is the 4th new email that I've been able to find today.

    Yesterday we were done and they were sending us our welcome notice. Today our I-485 shows this:
