  1. Hi Eveyone. My friends stepdaughters have interview scheduled this coming Feb 4 in Manila. One of the daughter got a notification that her papers are in order and the other one said affidavit of support is incomplete I-864A original signatures. Part 5 should be signed by the petitioner.

    So my friend and his wife filed I-864. My friends sister sponsored his kids since he doesn't have enough income. My friends sister filed I-864A with her husband. My friends sister and husband lives in a different home. Does my friend need to file I-864A also or just his sister with her husband

  2. Hi Everyone, Im helping my friend with the petition he filed for his step children. We already got the notice from the NVC. He assigned the agent and paid AOS fee of $120 three weeks after it issued since the invoice was not available online. Now its been one week today and he checked the site and it said paid.

    Now he is trying to submit the Visa application form, When he tries to fill up the form at CEAC it takes him to IV payment but it does not show any amount due so he cant pay for it and cannot apply for the Visa

    Please help what we are missing or if we are doing things wrong

  3. HI Everyone Posting this for a friend

    My friend who lives in the Philippines, single with no kids was petitioned by his US Citizen dad in June of 2008. In 2012, his dad got really sick and doctor said he doesn’t have that much time. The doctor gave him a certificate in order to obtain a tourist visa but was denied twice. His dad passed away a year ago. Does he have any options or is his pending petition is now dead?

  4. you cannot do anything right now since your wife's priority date isn't current. she cannot adjust her status until priority date became current.

    Yes I know my wife cannot adjust her status, my question is how do I get the kids over here. Do I file a separate petition for them or do I need to wait for the wife to get her green card then I can have the kids follow to join

  5. Im a greencard holder and petitioned my new wife. Our priority date is on Feb 18 2014. Today I got the approval. How do I apply for immigrant visa/greencard for the her two minor children. I understand that I only need one petition since Im a greencard holder. Do i just fill out I-824 then apply for a immigrant visa? Right now for F2A in Philippines is Sept 8 2013. Thank you in advance

  6. The question comes down to whether she is still married to the first husband and thus the second marriage is not valid. Due to PI law it gets very complicated as to whether a citizen of the PI can be granted a divorce. So the question becomes if a citizen of the PI gets married in the PI, but later files for divorce in the US, is that person still married until they get a divorce in the PI. I know that if they want to get married and have the PI recognize the second marriage then the first marriage must be annulled in the PI. The US considers her divorced, but as a citizen of the PI is it okay for her to get remarried without filing the proper paperwork in the PI? I leave that up to those that are up on PI marriage laws.

    OP: wait for the 5 year mark so the marriage has no bearing on your citizenship, plus you are so close it really does not matter and the amount of paperwork required is much less. All you have to do is show that you have been a LPR for the past 5 years which a copy of the GC will do, the number of days outside the US which a copy of your entire PI passport will do, tax transcripts, and residency in the USCIS district.

  7. Posting for a friend of mine.

    Was married in the Philippines with kids. She moved to the US and filed for divorce. She got married in 2009 and petitioned her two children. She now has a greencard. was able to bring her kids in the US. He 5 years is up to apply for US citizenship, but someone told her she cant apply for US citizenship since she was married in the Philippines. Is this true? She can get a greencard but cant apply for US Citizeship?

  8. Ok ive been doing alot of reading. Some people said as long as she is divorced here in the US she can remarry because in US she is divorce. Her spouse also lives in CA, but their children lives in the Philippines. Her two daughter are being taker care of by her sister.

    Let me know if im wrong. After we get married. I need to file for I-130 and I-485. And also file I-130 for the children? Do I need a I-130 for each kid?
