    Working as a subcontractor he would have had to show contractor's liability insurance. I doubt he knew of this so the employer still is in trouble

    Giving him a statement to enable him to collect unemplyment taxes means he thought of him as employee not subcontractor.

    Did the worker have a SS card?

    and what happened to all the taxes the emplyoyer withheld for over a year?

    He was suppose to quarterly send them in along with umemployment and insurance payments, medicare withhoulding< etc. This should have been caught and noticed in the first quarter of his work.

    You need to look at pay stubs to see if he withheld taxes ? Get a lawyer if he did as he probably did not pay them in for you. Did you claim this income on 2014 returns? So much here you need help with

    I do have SS, and I was paid by checks and also receiving paystubs, where it was showing the taxes.

    Hello! I arrived in USA in September 2014, (k1 visa) I got married within 90 days. I applied for AOS after 6 months of my arrival, and here is the problem.

    I started a job as Landscaper with a company that knew I don't have a Work Permit, they paid me by checks every week ( I paid taxes). I worked without any problem until the past December when he gave us "the pink slip" ( lack of work) document so I can apply for unemployment. Meanwhile I got my Work permit and Green card. I applied for Unemployment on 9th of January this year, they approved my file but I never got paid. I called them, and they told me the homeland security its involved and thats why they are helding my payments. Can my boss and I get into trouble because I didnt had the right to work? Or its something bad going to happen?

    Hello VJ !!!

    I will ask again same question because first time I dind't understand so much so there's the question : " Can I apply for AOS after my I-94 expires? "

    My I-94 expires on 11 December, we will get married next week, but for the moment we don't have money for AOS ( $1070) ... so I want to know if I will have problems if I will apply late.

    Hello VJ !!! we got approved last week, my binder is ready to go I just wait the NVC to arrive , the bank statement for my fiancee and also the letter from shes employee.

    (SHE IS THE AMERICAN PART, I am the beneficiary)

    Ok, my question is :"she want to change she's work place, now do I need the paper for the new employee or from the old one ??

    :cry: 60 days.

    at least you got something , and at least you could put a service request. we are 6 months from noa 1 and we still can not make a service request ...
