Short term plan is to make sure he has in home health care where he is and figure out survivors benefits. And send him money. I doubt we're going to talk him into moving anywhere anyway, but step one in any other decision will be to update his Canadian passport which is expired. So I'll settle, for now, getting his passport up to date. They always say not to make any big changes after a loss anyway, so we'll just keep it simple until we see how he recovers from the loss of mum. Then maybe we can talk him into a six month visit if his health improves and take it from there. If his health worsens, well, maybe we should stick to short term plans.

Thank you for the creative solutions. We are making sure he has in home health care. And planning on visiting again. And more often. Now that my husband has his green card, we can do that. I was considering moving both but seems a pointless move for us as we don't know how long he has left, unfortunately. Visiting more seems the only solution. This sucks. But thank you for the advice from more experienced of you. We were kind of blind sided by this.

Thanks for the help. Random unhelpful and unkind comments from strangers not so much. I caution comments from behind the safety of anonymous keyboards. My husband and I have just lost our mum and I was looking to help. And for help. I have no interest in engaging in discussion with strangers who don't consider the tone in which their replies might be read. Thank you to the others for the advice.

Sending money is the current plan. I'm just hurting for him all alone over there and want to bring him here. That's why I'm looking for ideas to bring him here to be with us. I'm just having throuble accepting no way as an answer when family is alone.

Thank you for all the very informative advice that has saved me asking a lawyer and going down the wrong roads. I'll have to explore other options.

Thanks for the advice.

For example, could he visit for 6 months without a visa and in 7th he meantime, we could apply for a visitor visa? I'm open to ideas.

Does anyone have any better ideas of how to bring him here now and have him cared for properly here? I outlined the situation above. If humanitarian parole won't work, any suggestions on what will?
Thanks.

My husband won't be able to get citizenship for a while.
I'd hate to wait that long as his father is pushing 80 and might not last that long.
A 6 month visa would be a good idea, if he were in better shape himself, but I don't know we could provide the medical assistance and pills he needs without him actually immigrating.
Although Immigrating seems like a waste of time at his age and in his shape.
Anyone have any better ideas? Thanks for the advice.

My husband is a Conditional Permanent Resident from Canada. He came over here on a Fiance Visa.
His mother just died back in Canada and his father is suffering severe back pain and grief, and is currently hospitalized.
We'd like to bring him to live with/near us in the United States. From what I've been reading, my husband can't sponsor him until he's a citizen, but this Humanitarian Parole seems to be an option.
I'm hoping that we can bring him over using that. Also, you may not need a Parole for him to just come and visit us, but that wouldn't cover medical expenses.
I'd appreciate any advice on how best to proceed. Some of the current concerns:
1. Humanitarian Parole best option? As a daughter-in-law, I don't think I can sponsor him, although I am a citizen.
2. Transferring his CPP and AOS to a USA pension plan. Looks like there is an agreement between Canada and US, but not sure how to transfer it.
3. Health care down here. Looks like there is an option under Obamacare now.
Any advice?
Thanks,
Lisa

My husband is almost done with IT professional school, graduating in May 2016.
We had been counting on Financial Aid, as the green card timing was, according to everything online, going to come before he started school.
As it happened, the green card was late, and we had to take a fairly hefty loan for school, which is hitting my savings account kind of hard.
I'm wondering if there's a way to get Financial aid retroactively as we finally got the green card.
I doubt it, but worth asking.
Thanks

Something I read online said you could do this by mail, so I sent copies.
Their response seems to indicate that they need to see originals, which I'm not mailing, so I guess we'll do it in person at some point.Helpful to know this isn't a necessity. I was worried he'd get a job and be turned away because of the line on his card about needing DHS approval.
Thank you both for the responses.

My husband was finally granted his Green Card.
His Social Security card, which we got with his EAD before he got his Conditional Permanent Residence, says "Valid for Work only with DHS authorization"
After we filed the I-90, we filed with SSA to get those conditions removed from his SS card. We filed the SS-5 form, with a copy of his passport, and a copy of the passport page with a temporary 551 stamp on it because his green card had his birthday wrong (also filed the I-90 to get that corrected with USCIS). We just received a letter back from SSA that said:
WE cannot issue you a social security card at this time because
you have not given us documents we need to show age
you have not given us documents we need to show identity
you have not given us documents we need to show US citizenship or lawful alien status
In order to approve your application for ss card, please provide the following
ORIGINAL VALID UNEXPIRED STATE ID, DRIVERS LICENSE, PASSPORT, OR IMMIGRATION DOCUMENTS
SS5 FiLLED IN ITS ENTIRETY
We're having a difference of option about what exactly that means. It reads to me that they want to see originals, which we're not going to mail but have to do in person. My husband thinks they're probably having an issue with the birthday being incorrect in his info, as the DMV just had that problem trying to give him a local license. The local DMV couldn't give him a license because their system has his birthday incorrect and all his documents brought in have it correct. He thinks the SSA is having the same issue, but that's not what the letter says.
Any thoughts or advise on what we should do next here?
I'm afraid if he does find a job, they won't let him work until the birthday thing is straightened out and that could take a year. Thanks!

Brian finally got his Green Card. We looked it over and it had his birthday wrong. I understand the process of filing for a replacement I-90.
We went to the local immigration office and got a 551 stamp on his passport, the temporary, which is good for a year.I'm wondering if, instead of filing for a replacement, can we just renew the 551 stamp near the end of the year it's good for?
Not any more of a pain to file another form, but wondering if it could just be easier to renew the temporary for another year. -
>>You should definitely let them know that the A# is different. Perhaps there is a mix-up. You can even call the USCIS and ask for your call to be escalated to a tier 2 immigration officer to ask about the discrepancy.
So i did some research online and figured out that the alien number on all the paperwork is the correct one. Apparently, the alien number on his Visa isn't the alien number. At that point, being K-1 Fiance, he wasn't an immigrant yet and wouldn't have had an alien number. But I did mention in the cover letter that I had mistakaenly thought that was it on some of the earlier paperwork as an FYI.

I found information on NOLO.com which was fairly helpful:
http://www.nolo.com/legal-encyclopedia/how-handle-request-evidence-rfe-from-uscis.html
We mailed it Priority as it suggested, and certified so we can track it. And also Return Receipt Requested.
I believe in multiple forms of proof for this kind of thing, but we had time so we didn't need to overnight it.

Also noticed that the A# listed in the top right corner is not Brian's Alien number?
Should I mention that in my response or just assume it's some other number and not bother? -
We just got an RFE saying that Brian's medical expired. He's got an appointment tomorrow to get the new sealed envelope to send back and I've been reading up on how they want this sent back. My question is, the letter came from an office in New York City, 26 Federal Plaza, Suite 8-800. That just seems odd to me because we live in New Jersey. I assumed our local Field Office, if we'd progressed this far, would be in Newark, NJ.
Also, any advice on how we can quickly get this back to them? Should I make an appointment and bring it in? Overnight mail it?
I want to send it return receipt requested and have them sign for it. I need to know they got it on time. -
My fiance just got here last night FINALLY! When he went through immigration in Vancouver, Canada, they opened the subtly marked Visa envelope and processed everything and let him through and come here.
I was under the impression that he would have a Visa to show. We're taking a short holiday to Florida next week, and I thought he'd have to bring it on the plane or just as proof of whatever if he needed it. Should they have given him something at the airport? And since they didn't, what do we bring as proof that he's got a K-1 visa?
Thanks,
Lisa

Hi,
Brian and I are nearing the end of being parted. His Consulate interview is Nov 18.
If he needs to go back to visit his parents in Vancouver Canada, while waiting for his green card (adjustment of status), what do we need to do?
I read somewhere it was "Advanced Parole", but I also read something that was not necessary for Canadians.Anyone have any advice?
Thanks

My Canadian fiance and I haven't started fililng yet, but have been gathering information and documents.
I've read someone's timeline saying that the whole k-1 fiance visa journey from petition to his coming here would take about 8 months. i think we'll have our ducks in a row by springtime and can have a nice visit and file the 129 fiance petition together.
If we file in the spring, then that would put his arrival in Dec,Jan,Feb, and I really don't want a winter wedding. But from what I'm reading, the getting married in 3 months part is the legal issues. So, when he gets here, we can go to town hall and file for the wedding contract and do the legal end of it, and then take our time planning a religious ceremony in the spring with friends and family and a nice place.
I don't want to mess anything up, so I thought I'd ask. Is this correct?
Thanks, the site here has been very helpful already and we haven't officially started yet.

Tax returns....I don't need to send them the entire state and federal tax return, do I?
Can I just send them the two pages with our name and address and "Filing Jointly - married" on it?
