  1. So what do you suggest I should do at this point? To let you know a bit about my case background:

    Our case was received by NVC only July 24th then we received a letter from NVC (same as yours) on August 3rd (dated:July 30). Since then, we haven't heard anything from NVC.

    Should we wait for I-130 Welcome Letter?

    Can we choose between CR1 and K-3 at this point?

    Also, when did you submit DS-160 (the non-immigrant visa application)? That needs to be submitted once we hear from Islamabad US Consulate, right?

    I am not aware of following situation so can not comment:

    "More than one petition was filed for this beneficiary. The NVC has combined the petitions under the case number listed below" with the case number, petitioner and applicants name, visa category, priority date, U.S. Embassy listed below.

    As per my experience, i got two case numbers, one for I-129f and other I-130. Both cases processed separately due to the fact my i-129f received 14 days before i-130 by NVC and next day that file was sent to ISL embassy and it received there in few days not later than a week.

    Even after i landed USA, my I-130 case was alive and i got interview letter which i didn't attend as i was already in US. But in your as and that above text received by NVC i recommend you to call NVC and ask about both case numbers, that will clear any confusion.

  2. What makes you say that? Can you please elaborate more? Actually I don't have my passport in my hand at this time, will get it in about a week though.

    What if NVC assigns a case number to my I-130 by then? Will I still be able to opt for K3 at that time?

    I want to go with the immigration visa as well but my husband wants me in US ASAP. I want to give some solid reasons to him to allow me to go for my I-130 as it is a slow but steady and straight forward process.

    If you go K3 route:

    You land with temp visa.

    You can not work, get drivers license, open bank account, in short no identity you will have untill you get your employment authorization and social security.

    You apply for adjustment of status to get green card, you apply for employment authorization

    You apply for reentry permit to US as you can not leave or re-enter US after applying ajdustment of status

    You pay $1000 fee

    you wait 3-4 months to get your employment authorization

    You apply social security after you get your employment authorization

    You apply driver license after you get your employment authorization and social security.

    You wait 7 to 10 months for your Adjustment of status interview and you both (husband wife) attend interview and present current supporting documents to prove that your relationship is genuine and if its less than 2 year after your marriage then you get conditional green card...the card you will get in Pakistan if you opt for IR1 route.

    If you go IR1 Route:

    You land with one year IR1 permanent visa.

    In 2 week your green card and social security will be at your home. no paper work

    You can get your driver license and open bank account and continue your life ... your have your identity...SIMPLE

    Chosing between K3 and IR1 in most cases is not your choice...NVC will do it for your and i am sure they will dump the K3...even if K3 skid through just like iin my case. i would recommend dont follow it and wait for IR1.

  4. So both our K3 and I-130 were approved on July 13 and yesterday (August 3) my husband received the case number and invoiced number letter stating:

    "More than one petition was filed for this beneficiary. The NVC has combined the petitions under the case number listed below" with the case number, petitioner and applicants name, visa category, priority date, U.S. Embassy listed below.

    BUT the visa category mentioned is only K3 - SPOUSE OF US CITIZEN (No mention of I-130)

    What does that mean? Should we be expecting another letter in a few days for I-130?

    Also, when I went onto the NVC site and put my case and ID number, it asked me to fill out DS-160 first which is a non-immigrant visa form.

    So I have following qustions:

    1. Should we be expecting another letter from NVC for I-130?

    2. Is there anyway to close K3 application as I want to go through the normal immigration process now?

    3. Should I fill out DS - 160 or wait for the availability of DS - 261 and forget about DS - 160 completely?

    Please HELP!

    As per my understanding, you will get only IR1 call as both cases were approved same time and they know that 2 petitions were filed. My case was different. I didnt file I-130 and I-129f same time. I took 3 months to file I-129f after filing 130.

  5. Thanks for the Link. I didnt mean to be rude, I'm just very upset at the moment. Since, it is only 4 weeks to go until flu season ends, would it be advisable to take the risk and go ahead without? Expecting the adjudicator will pick up the case after march? and even there will be a ref, it actually doesn't really matter, right? I mean by then itll be past march and you are good to go? I mean no hurry with that one, it's more that I want to have the working permit, that I need to file with the i-485

    was in same boat few weeks ago. sent without vaccination. i also need EAD ASAP. Lets see ...

  8. if a spouse arrives on a K-3, into the USA - they are given a 2 year duration I-94 .

    and that's it.

    What happened prior?

    1. K-3 visa interview was successful at the IV Unit but prior

    2. DS-160 was allowed by the IV Unit for a K-3 visa but prior

    3. I-129F arrive at NVC by itself but prior

    4. The I-130 and I-129F were not joined up at USCIS after the I-129F was sent in by the USC Petitioner

    Yes and all those conditions met in my case and i have got K3 Visa :)

    USUALLY - if an I-129F is filed after the I-130, in the hopes to chase a K-3 visa,

    the I-129F is sent on to where the I-130 is,

    the I-130 being pulled out of it's place in the queue,

    and the I-130 and I-129F placed TOGETHER at the end of the queue.

    There's been times last year and in 2012 where the I-129F was sent to a different office for adjudication, adjudicated, and sent on to NVC without the I-130 ever being touched by the same adjudicator.

    If a I-129F arrives at NVC without an I-130 , it's sent on to the IV Unit,

    as

    the basis for a K-3, an unapproved I-130, still exists.

    This basis is quite rare since 2009. USCIS got really efficient with casefile movements, except for a spot in 2012 and 2013 where the @#@ing DACA influx shifted all other processing to the local offices. Instead of 2 or 3 service centers with trained staff, I-130s were sent out to over 40 local offices, with mixed results on adjudication as there were a tonne of Donkey Knobbers assigned to the local offices and did not know the Service Center Adjudication Rules.

    But I digress.

    The topic title - I answered it in my prior post. Since you have new questions about it, you might want to rethink the efficacy of chasing a K-3 and the uselessness of chasing the K-3 and how much more money you'll spend to get yer spouse an actual green card after the K-3 is granted.

    Or not. Yer Choice. I hates the K-3, in toto. Sometimes it shows...

    I have a question for those of you dealing with the US embassy in Islamabad. How long did it take for them to contact you after NVC has sent them your file? It has been about 2 weeks and i have not heard a thing... Just curious to see how long it took for others.

    For my k3 i got email within a week for packet 3.5. After sending packet 3.5 its around month and no interview date yet.

    OP is talking about k1 visa and your are talking about CR1 visa. In K1/K3 we have to send documents (Packet 3.0/3.5) to embassy instead of NVC and then embassy schedule an interview.

    For CR1 we send documents IV packet to NVC and NVC schedule interview.

    I am right now collecting documents to send IV Packet to NVC. I was under the impression that we need to submit original birth and marriage (civil) documents otherwise NVC will send you a checklist. But now i can see at multiple forums and on VJ also that NVC no longer requires Original Civil documents.

    Can anybody confirm it...and please provide the NVC website link where it is stated, i was unable to find it on http://travel.state.gov/.

  11. Sugheil is correct. AP can last as per embassy will. I read your interview experience from your timeline. Your major problem is your age difference. And its not small difference (no offence). People do crazy things to get immigration. So VO were so much into it.

    Right now you are in AP and they will do different things to verify if your marriage is bonafide and not for sole purpose of immigration. So hang on and wait patiently.
