  1. you have two choices. be smart: i.e. show respect and comply, or be a smart ###. in this country, where law enforcement is being shot at and the average education level of the beat cops is high school diploma. you got to make a decision which way you want to behave suits you best. You might go to your local video rental.store for a copy of Rambo in the VHS section for future reference. cheers.

  2. Not sure about Chinese culture, but there's rarely a dowry in second marriages in Thailand. They consider it damaged goods. Of course some foreginer will come along and pay it, but never a Thai.

First thing first; Women are not goods, they are human beings. If men are not damaged by a divorce nor are women. On the bride price unless she and her family are from a cave. I am hard pressed with the whole notion of paying for a woman in China. Reality check China is the second largest economy in the world and some of the most modern cities are in China. Some women there do suffer from a severe case of abandonment issue. Thus material goods are important to them. Please keep the foot binding stereotype in the closets. Thanks.

  3. My Wife now, and I were denied a Fiance visa, so after weighing options, I went to China and we were married. Now I find myself in a state of hi anxiety, When I applied for the Fiance visa, I sent USCIS all original copies of proof of everything, I am aware now that I should have sent copies. Now I find that for proof of marriage, we need joint accounts, and a history of a life together. How is this possible when we have not lived together, she is still in China, and I don't think it's possible to open accounts without a social security number.

I have the same issue when I first started it and I was approved for the I-130. A jointed account is one of the things you can show but not THE thing you need to provide. Subsequently, I managed to get her on my HSBC account, but that was a major pain in the ####### from the bank whom I have to threaten with a legal review of their policy and reach a compromise. Getting the ITIN is another major PITA too. With all that experience, I really appreciated how inefficient the fed and the whole process are.

Some quick fixes: put her on your cable bill, trash bill, magazine, newspaper subscriptions. Apply for gym, discount store membership jointly, etc.

  4. I would check:

    • marital status and history
    • relatives: parents, siblings, children
    • education and work history
    • and, criminal history

Best case, she's got cool feet and you need to go there meet the whole village and convince her you are the one. Worst case: it's a scam and/or she has mental issue then you need to do what you need to do. Or I am sensing you already are willing to cut your losses and call it a day then get a divorce and move on.

    Good luck!

  5. which province or city she resides in? You can spend some money to hire a private investigator who have Chinese operation to vet her out and get a true picture of her background. You should be able to find one in Southern California with immigrant communities. Have you met her parents? If this is a scam you were unlikely to meet her family members. The iPhone bit is not that out of norm for YCG's. Some of them are really materialistic. good Luck.

  6. I just received a reply to my inquiry to TSC on DEc 31st... ( yea DECEMBER 31st)

Based on your inquiry, we researched the status of this case. We are actively processing this case. However, we have had to perform additional review on this case and this has caused a delay in processing time. If you do not receive a decision or other notice of action from us within 6 months, please call customer service at 1-800-375-5283.

    6 MONTHS ??????? REALLY????????

That is a sad sorry ### of a reply from a government of the people, by the people, and for the people. You should get a hold of the NYT reporter for a follow up story to expose the incompetence and deception of a government agency working for you. I looked into this thread just to check on your status. Wish you best of luck

  7. i'd have to check it to be certain. i'll get back to ya soonish.

The stuff I have has that section blank. I don't remember filling it out before sending it off to the IRS.

    Sorry.

You have to file your paper 1140 (A, EZ) with the SSN blank with signed W-7 to a specific address in TX or there are authorized agents can do it for you and return the passport or whatnot to you. For that privilege I was quoted $150 to do my income taxes which I did on line every year for a $15 filing fee.

If sending out the passport for your overseas spouse via snail mail to and from a foreign country gives you that not so warm-and-fuzzy feelings. The lazy way is do a file separately and do a 1140X to amend it when an SSN is issued and take the deduction then.

Third one: I am trying to use one of the exceptions in W-7 to a tax center with Mrs. visiting for the holiday and attempt to get an ITIN issued in advance. Will find out if that works out for me next week.

  8. In the process of waiting for the NVC Case Number and Invoice Number.

I am aware that the beneficiary can file I-765 (EAD) concurrently with AOS I-485. I-131 are also filed for the beneficiaries that reside in the U.S. (advance parole) so they can leave the country while their visa adjusted.

For beneficiaries going through the consular process (outside of U.S.), can an I-131 be filed with I-485 concurrently to get the re-entry endorsement? In Form I-131, Part 1, 6, there is no option to select IR-1 or CR-1. Wife might need to leave the U.S. for six months after obtaining green card shortly to take care of her ailing father.

  9. Thanks but that is what I'm doing now. I got a prepaid debit cart to do just that was sharing what I found with others and also looking to see if anyone found any better way. Still trying to figure out how to send money from China to the US easy too.

There are some sources that can do a money exchange for the Chinese nationals. I can not vouch for the legality or trustworthiness of those. But I do seen them on some websites catered for the expatriates.

  10. I already have the letter to the IRS and my state DOR stating that we'll be electing to treat her as a resident for tax purposes ready to go, as well as a signed W-7 and signed Income Tax Forms from her. Just wanted to know what to put in the SSN box. She also signed both letters. I'll be sending it all FedEx to the courier address in the W-7 instructions, as I have read them already and we'll be sending her passport as evidence of her foreign status. Photocopies of all of the Federal forms will be going to my state DOR.

You will have your W-7 kicked back by IRS. You are to file your 1040, 1040A, or 1040EZ WITH your W-7 and a certified passport bio page or the passport itself. I am not sure your state DOR (?) has anything to do with filing for federal income taxes.

Since my wife is here visiting, I am going to take the W-7 and passport to a TAC for a walk-in and use the exception to get an ITIN issued in advance. Most of the acceptance agents want to do my taxes as a package deal. I don't feel like paying someone to do my taxes and charge me money for what I can do on line for peanuts.

  11. I'm talking about sending money to China without being there or sending money to the US without being in the US. Example, Wife here in US and friend wants her to get something and send it to her. How to cheaply have them send us the money. Or waiting for K-1 visa to be processed, need to send money to help with the cost of getting K-1 how to send money to China to help out.

In that scenario, mail the ATM card to china and send the Pin separately. She will have access to your checking acct in china. Wiring money from any major chinese bank has a limit of $50,000 in a year.

  12. I believe BOA and/or CITI's atm cards can be used to take money out in major Chinese banks atm machine. I use HSBC personally. I found that ICBC has better exchange rate than HSBC machine coincidentally in SZ. The other trick is to load your credit card with cash and use it in China without carrying any currency or declearing it.

  13. That's a typical misleading and bureaucratic double talk again. The statement passed the responsibilities to the local service centers and failed to monitor their progress and resources needed. NSC is by far the slowest one in adjudicating stand-along apps. It is the failure of the top USCIS leadership to devise a fair and equitable system to process ALL applications in the order of their receipt. Simply shuffling apps around and not ensure the apps are reviewed and adjudicated in a orderly fashion is just a smoke and mirror tactic.

  14. My main issue with this whole process is:

In the name of clearing backlog, a good number of April apps were transferred to Nebraska in mid November only to be stuck there again while later cases transferred to other centers leapfrog over them. That is incompetence of USCIS, at best, or a deliberate diversion at the expenses of these people. To add insult to injury, after clearing NVC's backlog, they are approving apps from May and June now. So the April filers got shafted twice! Those who transferred to NSC got swept under the carpet so that as a whole USCIS is making progress in moving the process time along. What a jib!
