    So the response at InfoPass was call back tomorrow, all appointments are filled.  This was at 7 AM.  Oh and the joy of driving an hour to their office.

    Lot of IR/CR-1 get delayed for a CENOMAR, the embassy has it listed in their instructions letter.

    Thanks. Ya, crazy US gov. You think someone would catch on that the CENOMAR is required for a couple to get married there. It's interesting it is required for Filipinos. No such similar thing exists on the US side. You just say your not married and they (US embassy) says good enough.

  3. So I'm filing an IR1/CR1 for my wife and her children. Just got the I-864 kicked back.

    When I paid the fee I only paid once. So I figured one form for the three of them. They kicked it back basically stating that I couldn't include the children in this form. So do I need to fill out 3 I-864's, one for her and each child or do I need to just fill it out for her and not include the children?

  4. For married filing separately you do not need an ITIN or SSN. Just write NRA in the SSN spot, print out the tax return, and mail it.

    However for married filing jointly you do need an ITIN or SSN. BUT as the OP is at the NVC stage, I think, it's best for the beneficiary to not send away their passport.

    Since the members spouse is Filipino, I found out the specifics on how this can be done, since I'm doing the same thing.

    You can file a certified copy of her passport. To do this, a copy of the passport needs to be "authenticated" by an IRS agent. The RAO in Angeles CIty has an IRS agent on board. No need to send a passport.

    It's best to include them with your application. From what I understand if they are included on your form they get a visa when you do, however, you would still have to file the I-130 when they get here. I did not go this route. It is cheaper, but did not save anything.

    I filed my wife and kids i-130 in one packet. So I filed 3 i-130, plus paid the fees for 3 I-130s. This ensures that when all three get here their status is immigrant, they get green cards and so on. I won't need to do anything else for two years, when it would be time to remove the conditional status.

    I included with their packet.

    - My divorce certificate

    - Copy of marriage certificate (photo copy is good enough)

    - Child's Birth certificate

    - Copy of my passport

    - Pictures of me with the kids

    - Completed i-130

    - Section A: 1. Child 2. No 3. No

    - Section B: is the same as for all the others it is info about your husband. He is the petitioner for all of you

    - Section C: is the info about your child

    - Section D: you need to include the names of other packets. So for my step son's, I included my wifes name and his sisters

    And that is pretty much it.

  6. How did you get this done so quick? We have almost same filing date and transfer date and more .......except my filing date is a week before yours. How did you get this done so quick?

    I didn't do anything. There is no method to this madness. We got transferred to Nebraska and then bam it was done. I was in the same situation wondering why others were get done ahead of me and then I got the notice. Rumor is they are expediting all Filipino cases because of the Typhoon. Hopefully yours will happen real soon.

  7. This question worries me. I sent with my application all the things you ask about and now have to wait wondering if some civil servant will make a judgement call, because we don't have joint property, common tenancy, etc. For a person living in the US with a spouse living in the Philippines this is difficult. The proof of marriage they ask for in the application is a much taller bar than that or a fiance visa, where the only requirement is proof you met.

    So one option is to lay your case out to your congressman and ask them to clarify what makes sense, they will file a request for information with USCIS and put them in a box to define clearly what in your situation will qualify. Your congressman has people working for them that do this. I've done something similar and it's amazing how fast the old INS would respond to a congressional inquiry. They treat you with kid gloves.
