I think the 12 month extension is from GC expiration date. The letter states your residency is extended for 1 year.
Regarding Driv. License which state issues 2 yr driver license. I think NY issues 10 YR License.
VA will only extend it as long as the green card is good, so she got a one year license.

Congrats!!!!
Lot of IR/CR-1 get delayed for a CENOMAR, the embassy has it listed in their instructions letter.
Thanks. Ya, crazy US gov. You think someone would catch on that the CENOMAR is required for a couple to get married there. It's interesting it is required for Filipinos. No such similar thing exists on the US side. You just say your not married and they (US embassy) says good enough.
Silly me trying to make sense of the ways of our government. T

What's the normal ....if there is such a thing ........time that it takes to receive visa after interview ?
Depends. Ours went into AP cause of no CENOMAR. Ours is 44 days.
-
We went because of the passport requirements. My wife goes back Thursday to get her sticker.
-
Ready is the state before and after the interview. It will change to ISSUED, then start checking 2GO. My wife's is in the issued state. Been 3 days since changing and still no 2Go status.
-
Our interview was 13 August and put on ap for CENOMAR. Called the embassy last week to ask status and Thursday status changed to issued. 36 days.

We were the same and did both the kids visa at the same time as my wife's. No problems with getting the kids approved.

So I'm filing an IR1/CR1 for my wife and her children. Just got the I-864 kicked back.
When I paid the fee I only paid once. So I figured one form for the three of them. They kicked it back basically stating that I couldn't include the children in this form. So do I need to fill out 3 I-864's, one for her and each child or do I need to just fill it out for her and not include the children?
Thanks!

So quick question here. I already paid the IV Application Fee. It is in the processing state. Now I need the DS-260 filled out and have a couple of questions.
1. DS-260 is filled out online? If so when does it become available? After the Fee is in the Paid State.
2. Do I need a copy of that to send to the NVC or just the cover page?
Thanks all.

So I just got my emails to pay the Affidavit of Support. It's a little confusing. When I pay for my wife it says one payment for 3 related cases. Do I pay this fee for the kids too or is it once for all three.
Thanks!

For married filing separately you do not need an ITIN or SSN. Just write NRA in the SSN spot, print out the tax return, and mail it.
However for married filing jointly you do need an ITIN or SSN. BUT as the OP is at the NVC stage, I think, it's best for the beneficiary to not send away their passport.
Since the members spouse is Filipino, I found out the specifics on how this can be done, since I'm doing the same thing.
You can file a certified copy of her passport. To do this, a copy of the passport needs to be "authenticated" by an IRS agent. The RAO in Angeles CIty has an IRS agent on board. No need to send a passport.

She can get a Tax ID and you can file as married. http://manila.usembassy.gov/wwwha010.html
I did a little research there is a rep of the SSA in Clark or Subic that can help her file for it. She'll need a passport and marriage certificate. We're waiting on my wifes passport.
Good luck.

Wow, you were correct......I just received my USCIS approval today !!!!!!!!!
Excellent! Now lets see how long the next part takes.
Congrats!

Hi darnb can u pls write it down all document and step by step u did so my husband have pattern to follow so my kids are here now too in U.S
Ty so much
It's best to include them with your application. From what I understand if they are included on your form they get a visa when you do, however, you would still have to file the I-130 when they get here. I did not go this route. It is cheaper, but did not save anything.
I filed my wife and kids i-130 in one packet. So I filed 3 i-130, plus paid the fees for 3 I-130s. This ensures that when all three get here their status is immigrant, they get green cards and so on. I won't need to do anything else for two years, when it would be time to remove the conditional status.
I included with their packet.
- My divorce certificate
- Copy of marriage certificate (photo copy is good enough)
- Child's Birth certificate
- Copy of my passport
- Pictures of me with the kids
- Completed i-130
- Section A: 1. Child 2. No 3. No
- Section B: is the same as for all the others it is info about your husband. He is the petitioner for all of you
- Section C: is the info about your child
- Section D: you need to include the names of other packets. So for my step son's, I included my wifes name and his sisters
And that is pretty much it.
Good Luck!

I did an i-130 for my wife and did a separate I-130 for the kids, filing as their stepfather. All 3 were approved in 70 days. They are expediting Filipino I-130s, so you need to do this soon before USCIS stops this.
-
How did you get this done so quick? We have almost same filing date and transfer date and more .......except my filing date is a week before yours. How did you get this done so quick?
I didn't do anything. There is no method to this madness. We got transferred to Nebraska and then bam it was done. I was in the same situation wondering why others were get done ahead of me and then I got the notice. Rumor is they are expediting all Filipino cases because of the Typhoon. Hopefully yours will happen real soon.
-
Filed 18 Oct 2013, approved 30 Dec 2013. Transferred to Nebraska on 21 Nov. That's good, but I'm not ready. My wife and kids will be here faster than I expected.
-
Got transferred to Nebraska 21 Nov. Approved today 30 Dec. Total time from submission to approval 70 days.

I believe she would also need to get a Judicial Recognition of Foriegn Divorce.
Not necessary. It's part of the Family Code. If the foreigner files the divorce, it's recognized by the Filipino Gov. I know been here done that.

Overwhelm them with material. Having done this before. My ex for her interview walked in with two binders of chats, letters, phone bills, etc. They didn't ask any questions and didn't even look through them.
If I were today asked for evidence, I'd provide our chat logs. Right now that would work out to about 4,000 pages of chat.

This happened to my ex after she got here and we got married. We had to go to our congressman. They got the Advance Parole turned around in a day, They had to walk her through the processing at INS. We started at 9AM and she was on a plane by noon.

This question worries me. I sent with my application all the things you ask about and now have to wait wondering if some civil servant will make a judgement call, because we don't have joint property, common tenancy, etc. For a person living in the US with a spouse living in the Philippines this is difficult. The proof of marriage they ask for in the application is a much taller bar than that or a fiance visa, where the only requirement is proof you met.
So one option is to lay your case out to your congressman and ask them to clarify what makes sense, they will file a request for information with USCIS and put them in a box to define clearly what in your situation will qualify. Your congressman has people working for them that do this. I've done something similar and it's amazing how fast the old INS would respond to a congressional inquiry. They treat you with kid gloves.
Good Luck!

So the response at InfoPass was call back tomorrow, all appointments are filled. This was at 7 AM. Oh and the joy of driving an hour to their office.
