  1. Your wife's situation is completely different from an unemployed 19 years old girlfriend that lives with her parents.

    You are married with a kid, and you provided proof that you had a job in India to go to. That helped out your wife.

    I've worked in SE Asia for 10 years now and have known a few people to get tourist visa's for their girlfriends. These are the same people that told me to try for a B2 when people here told me it was impossible because of the whole intent thing.

    My point is if you have $160 to blow go ahead and try.

  2. I got told the same stuff. I applied for the tourist visa for the wife in Vietnam and got it. All you have to loose is $160 for the application fee. Just tell her to be completely truthful at the interview and it might help if you go to the interview. You won't be allowed into the embassy for a B2 but if the staff wants to speak to you they can send your girl out with an invite for you to come in and speak on him behalf. That's what happened in my case.

  3. I've been reading a lot of stories on this forum about visa scammers men/women. Some of these stories are quite sad and horrific. But I've also noticed that most of the ppl complaining about their scammer spouses/fiancees don't have photos on their avatar. Why not change their avatar to a photo of the scamming spouse/fiancee and OUT these evil scammers so future potential mates will know who to be wary of?

    Didn't California just create a law against revenge photo posting.

  4. Is the Philippines different with scheduling the CRBA interview at the US citizens services section than other countries? In Vietnam the entire CRBA process was 14 days from the time I requested the appointment online to the time I got my son's passport in the mail. It wasn't a big deal.

  5. The airline reported your departure to CPB but didn't update there system after you cancelled the flight. I've read a few of these now but they were from people who never cancelled the return. The fact that you cancelled the return puts you in a good space.

    Give them a call on Monday and send in a copies of all your passport pages and flight cancelation with a short and to the point letter explaining your actions. That should clear the RFE.

  6. I went to the consulate for a CRBA and they took all the translations, they did want them. In Vietnam you can get a document translated for $5 or less. It's a cheap piece of mind plus I won't hand over any document I can't read; that's just me.

    I think you'll be fine with the divorce certificate. Vietnam is a pain in the a-- with the single status record. If she has had more than one house book (residence) you need to go to each town for a record from that time period. It was the only thorn I had in getting married in Vietnam. Her first residence wouldn't provide the record without coffee money; tiny farming village. For the purposes of the K-1 I'm sure they would only require the last residence but the divorce certificate should be enough.

    If you have further questions shoot the embassy in HCMC an e-mail. They have always answered my questions in one business day.

  7. I can't figure out why they would stop him, my best guess is that it is Texas and "walking" is strange behavior (which sickens me), or that it was an area known to be a place where drug deals happen.

    Either way, whatever they were thinking, it is not illegal to walk, and it was improper for them to ask for ID just because they wanted it. This is a federal law, recently upheld in the supreme court.

    It seems Hypnos is following up on the matter, he mentions getting "redress," and it is very good he is doing so. I also hope he got the officers names and ID numbers. I know officers have quotas, but they should be looking for real crime instead bothering people on a walk. If they thought he was loitering or something (which isn't illegal on public property), they could have told him leave the area. There was no need to check his ID.

    Half wrong information!

    The Supreme Court knocked down NYC's stop and frisk policy and requirement to carry ID but not stop and identify. Two times the Supreme Court has denied hearing cases for stop and identify. Federal district courts have ruled that identifying yourself is not unreasonable search and seizure. In NYC if you don't identify when asked your under arrest; simple as that.

    Your all giving dangerous advice to newly arrived immigrants. Just produce your ID and be done. Why are you telling these people to escalate the situation when your immigration status could be on the line.

    There are 24 states that require you to identify or you'll be arrested called Terry Stops. There is no law that requires you carry ID but you are required to identify yourself. If a cop asks just give him your ID. Playing the civil rights card is going to piss off the cop and he is going to see it anyway.

    Only guilty people refuse to identify. Hence the officer already has reasonable suspicion and the officer is not required to tell you what it is until your under arrest. It's a catch-22 by design.

    Doing the right thing is not always doing the right thing. Anyone with a little street smarts knows this. Also this advice only works if your white and I mean really white. If your a darker immigrant and act like this it won't end the same way and the lawyers, media won't care. You're a darker immigrant with no money. It's the reason a missing white child is national news while a missing black child is not.

    Go on and be a civics' hero; I'll surrender my ID and be on my way.

    I'm familiar with Terry Stops. That's a battle you won't win. The one thing I've learned in my travels is you are never smarter than a cop. Be a d!ck and they will find a way to screw you.

    I was a d!ck to a cop in Angola asking for ID. When I finally gave him my passport he ripped out my biometrics page and handed it back saying your free to go with a laugh. Luckily I gave him my secondary passport.

  10. OP this depends a lot on what you want to do. If your heart is set on marriage before coming to the US than get married. The CR1/IR1 is currently taking 7-8 months for approval if you apply now and seems to be getting faster. You'll have another 2-8 weeks to get threw the NVC. Some people on the ball can get threw the NVC in 2 weeks; the NVC depends on how quick you can get a case # and if you've done your research. The consular interview will take 1-3 months to schedule. So it will be about 1 year before you can travel.

    It is important to note that not all K-1 visa's are approved. The approval rates are higher for the CR1/IR1 especially in high fraud countries.

    You can travel to the US married with a B2 visa with an I-130 filed. Many will tell you it's impossible to get the B2 in this case but I ignored them applied for it and got it so a B2 is possible but there is no guarantee you will get the B2 if you do apply.
