  1. AP can also be used by a CO as a paternalistic method of "protecting" the USA citizen sponsor. They are responsible for all USA citizens, sometimes they want to save the USA fiancee or spouse form themselves....perhaps they feel they know something but just cant prove it....since CO's are immune to legal responsibility, they can take it upon themselves to be paternalistic.

    The problem with it is that they don't tell people what is going on...its as if its a national security secret or something.....they should tell you....your case is being reviewed.....expect to wait X months..something like that...telling people nothing is the worst.

  2. stop acting like this, its not depending pf country but case, if u are from england and big difference age, and u are from asia and same age and good real relation ship, so its clear, so please stop acting weird, ppl here are so wrong each case is specific, and of couse if the us citizen is 50 and the beneficiary is 25, its call fraud NO LOVE AT ALL

    I think you are acting weird…that was a totally reasonable question that was posted.

    And of course Im 47 and my fiancee is 21….and no its not fraud and yes we are absolutely in love! What are you talking about, its incredibly common for foreign women to marry older men!

    I just got an email from the IV unit asking this exact question about what they do if they get packet 3 before they get physical file.

    They are really nice and quick to reply and they just answered me that they do in fact have our packet 3, and they are holding it while they await our file to arrive from NVC.

    No matter what you read about this policy of them throwing it away, either my lawyer has an in and they hold files for them, or as my lawyers office told me, they always send packet 3 right away when they get NVC number, not waiting until the actual arrival of the file.

    Thats the facts as of today….but you sure got me worried enough to research the whole thing…no biggie, now I know that they have our packet 3…good news!

    I don't know why its taking so long for our file…"in transit" now a week already…ugh.

  4. They won't except the P3 until they have the actual NVC file in hand. Your attorney should have contacted the Consulate before sending the P3. If your P3 gets to the Consulate before the NVC file, most likely your P3 will be discarded.

    For the money these attorneys charge, they should really be more careful about the details.

    Really its Brian Wright in Bangkok and they do hundreds of these all the time and work with embassy all the time. Everything they have done so far has been ok.

    They just took her to her medical exam yesterday.

    Maybe Im misunderstanding but the main contact lady there has told me she requested the interview last week.

    They say they always request the appointment as soon as they get the NVC case number.

    Ill check again, but they seem to have a working relationship with embassy and know their stuff…Id be shocked if they mess it up that badly that my whole packet would be thrown out.

  5. Argh you are 2 weeks ahead of us in the process…I assume that means a probable interview date in late January….this is just agonizing.

    Assuming that even though we had NVC number and packet 3 in, they won't schedule until they actually have NVC paperwork in their hands? Not sure about that, our lawyer said they will accept packet 3 as soon as you get NVC number….

  6. Just got email from embassy. Interview appt 1/8/14. The December slots are all filled. We sent in the package 3, one week ago.

    When did the embassy receive your case or was it still in transit?

    When did you send the packet 3…right before Thanksgiving?

    Our lawyer sent in our packet 3 last week also…we had NVC number but the status showed in transit since then on the CEAC website.

  7. Got our NOA2 by email and text Oct 31 late at night of all things...

    No NVC number yet as of last Friday. Will call tonight (Asia time) but its only been 20 days so my hopes are not too high.

    So the CSC does NOT send notification that the application is forwarded to the NVC but the TSC does???

    My status on the USCIS website says post decision activity but only states in writing that the case was approved the 31st.

    I called USCIS and they said they don't give notification as to when the case is forwarded….

    So I don't understand what people here are referring to when they state when their case was shipped off to the NVC??

    We have our entire application ready with our lawyer in Bangkok so that when we get this darn number we can request the interview date right away.

    I saw one person say they got an expedited interview by asking to be on standby…that seems interesting possibility. Means you need your medical exam done right away after getting your number right?
