  1. Did you file a 2555 or 2555 EZ ?

    If you can pass the Bona Fide Foreign residence test in the prior year to tax year -- OR physical presence test .... you can exclude these periods of time

    as Exception Code C on Form 8965 for those months.

    You are also permitted the 3-month continuous gap (Code B) in the year also...

    So if you passed the 330 day physical presence test or qualify as bona fide ending in that year, you run Jan - Sep as C and then Oct, Nov, Dec as Code B - 3 month gap.

    If for some reason you did not meet Bona Fide or 330 Day Physical Presence while in Canada, then I think you are stuck UNLESS your Canadian plan was deemed QHP by HHS or you can use the affordability exception etc.

    Aren't you only suppose to use Code "B" for less than 3 months? Shouldn't he just put exemption code "C" for the full year?

  2. I also saw that someone mention exemption letter B for gaps of insurance. Would she be considered to have a gap from end of April to end of July? Or would I just label that as C also? I know for form 2555-ez she met the physical presence test for 12 month period since she was living in her home country before she came to the USA in April. This stuff is a pain. Any help would be appreciated. Wow I'm hating Obamacare right now. LOL!

  3. I have a question about form 8965. My wife from Brazil came here at the end of April 2014 and we were married July 2014. She was added to my insurance on August 2014. We applied for AOS in October 2014. We got her SS# in February 2015. We are considering her as a Resident Alien as we signed the Declaration page and filed MFJ(I know she also meets the substantial presence test but thought this made it more clear).

    My question is on form 8965 should we fill out the exemption type as letter C and for the full year? Or should we just exempt her for the months she wasn't covered under my insurance Jan-July? How do they know she had health insurance under my plan since she didn't have a SS# until February of 2015. Just want to make the easier declaration that won't leave a grey area when the IRS reviews our taxes.

    We also filled out form 2555ez to exclude her money made in Brazil for the first 3 months of the year she worked there.

  4. Well we are still in the Administravtive Processing stage as our Interview was on 2/18/14 and approved. Unfortunately we had to do the medical one day before and they just received the results recently. Now we are waiting for them to issue the visa. I guess since they gave us a verbal approval during the inteview and the medical results were fine we should have to problems with the visa but the waiting sucks. Hopefully other people get their visas faster than us. It will be 3 weeks since our interview on next Tuesday. The wait sucks!

  5. We had our interview yesterday and were approved contigent on the passing of her medical exams she did the day before. It is in Administrative Processing as of today. We are very happy and can't wait for her to get the visa. We do have some time as she won't be able to come until April as she has to fill in for a girl at her job who coverered for her while she was out. Still, we are very anxious to get the visa in her hands fast. How long does Administrative Processing normally take in the visa process?

    Congrats!!! We have our interview date on Feb. 18th as we had to push it back a couple weeks as we need time to plan for the interview(paperwork and all). We just saw each other during the new year so the 5 weeks wait won't be too bad. This process has moved so fast!!!

  7. A note for everyone who received their case number from NVC/DOS, here's a way to figure out exactly* when your case left NVC.

    By exactly, I mean given normal circumstances and your package was not lost or something to that effect.

    First, let's take apart your case number from NVC/DOS. It should be in AAA########## format. For the purposes of this note, let's use MTL2013756004 as an example.

    • AAA - this is the three letter consulate code. MTL is for Montreal.
    • #### - the first four numbers is the year, i.e. 2013.
    • ### - the next three is the Julian day your case number was created. Subtract 500 from the number to determine the day of the year. 756-500=256. 256 is September 13 in Julian calendar of a non-leap year.
    • ### - the last three is the total number of cases sent to the beneficiary's consulate with yours being the latest one processed as of that day. 004 is the fourth case they've processed, so far, for this particular consulate.
    Now that we have September 13, 2013 as the date when the case was created, let's check when the package left NVC. The shipping reference used by NVC to ship out packages is in EXP DD MMM YYYYA format, In this case, EXP 13 SEP 2013A.
    • Go to DHL to track the package using the shipping reference.
    • Enter a date range for from and to. Normally, when you call NVC/DOS they tell you when your case left or forwarded to the consulate so use those dates.
    • Look for your package from the list result!
    ***You might have to play around with the DD part of the shipping reference as well as the from and to date ranges. In my case, for example, I had to enter a DD three days prior as my case actually left on a Monday but the shipping reference was created the Friday before.

    I used this to make sure that my case was picked up and actually delivered and signed for at my local consulate. I was also able to print a copy of the proof of delivery so that's a bonus.

    thanks worked like a charm. It seems they actually received our package dec. 10th even though the guy at nvc said they only sent it electronically on the 5th. We'll now we just have to wait on the Brazilian consulate to five us an interview date. Too bad we can't pick out date like others. Oh well at least we will see each other right after Christmas. I would like to know when I'm in her country our interview date.

    I received my case number today.

    Where do I go to fill out the DS-160? I thought I went to the right place but they are asking for an invoice ID number. When I called the DOS back they told me, I will get the invoice number once the package reaches the embassy. I don't think the person I spoke to knew what I was talking about, when I said 'invoice ID number'.

    Should I try calling again or do I have to wait till my package is at the US embassy?

    Never mind I figured it out. You need to call nvc for the invoice I'd number if you didn't receive it with your case number. I just got it. I wonder why no one mentioned this before as you need it to fill out the ds-160 form.

    NVC received our case on November 25 and assigned us a case number on December 2, on December 9, NVC replied our email by sending us both case and Invoice ID number. Since then we've been checking CEAC status saying at NVC.

    What next do we do from here....

    What is this Invoice ID number you speak of? I just received the letter and only see a Case number and USCIS number on the letter. What is the invoice ID number used for?

    The benificiary has to fill out the DS-160 and I have no idea what invoice ID number is. You just need to know your case number. I just got the letter letting me tell her to fill out the form while we wait for our interview. She emailed the embassy on Sunday and they told it would be 3 business days when she would get a reply about when our interview is going to be. We still haven't received any email unfortunately. Hopefully we receive it soon as we are anxious to find out our interview date.

  11. They replied to my email but didn't really answer my questions. They just said they changed the way the interviews are scheduled and asked me to arrive at the date and time written on the letter I received. I'll probably arrive about an hour early though (I'm going to leave home early just in case I get stuck in traffic).

    No, we don't get choose our interview date. The people at the consulate schedule the interview and send us letter with the date and time, and a few other instructions. But since the USC doesn't have to be present at the interview, I'm sure your fiancée will be fine if she goes there by herself.

    My fiancee might have to reschedule her interview at the end of February if that is the date we get as she has a graduation party around that time. Does anyone have a clue if she asks for a new date how much later would they reschedule? I'm sure with Carnival being in early March they won't use the first two weeks of that month? I hope it wouldn't delay her interview by too much time.

Here in PI once you got your case number from nvc you can schedule your own interview date by just paying the interview fee..and we can download the packet from the us embassy manila site.. those are just instructions of what to bring and what to do next.. so i paid already my interview fee and got my schedule :) how about yours?

    unfortunately the USA consulate in Brazil gives us the date. We can ask to reschedule but we have no control of what new date they give us. Kind of sucks but at least our case is moving forward.
  13. David, please forget what I said. My letter arrived today and, just like yours, it says 09:20am. I emailed the consulate 5 min ago, let's see what they're going to say. I have a feeling that now the doors open at 09:20 instead of 07:15...

    Did you guys have any choice on when to schedule your interview or did they just send you the date and time and you have to make it work? We might have trouble making an interview unless it is at the end of February or Mid-March or later. Just curious as it seems they just send it to you which would make it hard for me to be ther with her as I will be in Brazil in December also and don't really have more vacation days to take off.

    No way they could have got it so fast in the snail mail!

    Now I have to figure out how they schedule interviews. It seems in Rio they do it for us. That would suck as I really want ours to be end of February or Mid-March as we will see each other later this month and I won't have any days to go see her for the interview. We might have to cancel seeing each other during the Christmas time and just see each other during our trip to Rio. Wow so confusing!

    Congrats! We got that also and I talked to the agent and they said they sent it our file electronically on 12/5 and that the consulate received it already. Don't they send the physical copy also? Well either way we are ready to schedule are interview. So excited as we are getting close to being together.

    Wow congrats! I'm guessing scheduling your interview that fast is specific to your country? I don't remember reading people doing this for the US Consulate in Brazil. So NVC sent out your packet the next day? Where did you find that out?

  17. Yahoo Congrats to you, yeah i had the same experience yesterday with the lady on the phone, she said it will take 46 weeks, i thought its 4 to 6 weeks but she said again 46 weeks and i was shocked and told here are you sure its four six weeks that's like 1 yr!!!

    Well no need to be bad about it now, cause there was a good news after all smile.png

    Thanks! We needed the good news as my fiancee told me she would have to work most of the time I see her end of this month. Her job informed her of that today. Hopefully she can get out of that as we need to spend some time together and my Portuguese sucks so I would just be at her mom's house the whole time with nothing to do. LOL!

    NVCInquiry@state.gov ... they will email you the complete information including the invoice ID number. Thank God we received it just now smile.png sending good vibes to everyone...

    Congrats!!! I just called after seeing your message and we got our case number now also. Funny, the lady we talked to yesterday was an a-hole and told us it would be 8 more weeks after they sent the package we would recieve our case number as they seemed to be delayed with an uptake of applications. Talk about misinformation. LOL! Who(benificiary or petitioner) receives the packet and in what form(email, mail etc)?

    We finally got a notice from USCIS that our case was shipped to NVC. Wow over one month after we got approved. November 25th sent after October 24th approval. #######! I hope they send yours out soon also. How can they sit on the case for one month before sending it out?
  20. yeah sad to say we havent received any update regarding nvc receiving it or shipping it for that matter.. i am getting so anxious too knowing the available slots for December and Jan. Were all filled up and my noa2 will expire middle of February. I called NVC and DOS yesterday and told me they have not received it STILL!! And wait for more time.. just hoping to get the case number this coming week :) still positive vibes..

    We have almost the same exact timeline as you and were processed by TSC. We were approved on October 24th and still hasn't been received or shipped to NVC yet. I will call USCIS on Monday to find out what us happening. It is frustrating though we are still doing good for time I guess to normal standards.

    Our timelines are very similar and NVC still hasn't received our case yet either. We got our petition approved on Oct. 24th. We were excited it was going so fast but it seems to slowed down. I hope we get our case number before Thanksgiving. It will be interesting when you guys get yours. Good forturne you get yours soon!
