    Hello All,

Just wanted to give an update, we went to day to (attempt) to get the passport stamp extension but were told by the officer at the Baltimore field office that the receipt letter extends the GC validity one year from the expiration date of the green card and that they could not give the stamp until within 30 days of that date : ( They said to make another appointment and come back if not approved by then. They did check the status of our case and said that it had recently been assigned to an officer for review. So hopefully an approval is near and we won't end up needing to go back to get the stamp! Fingers crossed!

I dont think uscis has an consistent answer on whether the receipt letter extends from the GC date or the letter date itself.  regardless, its good news that your case was assigned

I just wanted to give everyone an update. After waiting a year I finally received a response from USCIS in the form of an RFE. I'm pretty upset. My status online did not change. I received the notice in the mail.

I wouldnt be upset, at least someone looked at your file.  Just give them the extra information.  As I had said in my post earlier in this thread, the local uscis officer told me that they are asking for more information a lot more these days.

  3. update: my wife went to the local uscis office and got the 551 stamp. the officer said they are aware of the backlog and getting a lot of people coming to get the stamp. the officer also said as an FYI to be prepared for request for additional information as they are doing quite a few of those.

of note: if you go, leave plenty of time to get to the office. My wife was late due to a accident on the highway, but they still took her despite being 30 mins late

  4. just wanted to put my info in here.....we submitted the information and received the notice I 797 extended residence for one year on 1/26/16, from the VT center, She went for biometrics on 2/25/16. We have heard nothing back.

We called the 1800# and the nice lady told us standard answers and that they are handling Oct 2015 cases at this time. I am not sure if they will get to our case before the one year extension expires in January of 2017.

Every time we cross the border, they are asking her questions as to if she renewed the GC and wondering why we havent received the new one.

  5. Provided cousin marriage was legal in the jurisdiction in which you married and the US state in which you both intend to reside then it should be a non-issue. Of course, if asked you must be truthful.

I guess we will find out this wednesday during the interview

the state isnt legal, but the marriage took place where it was, so we shall see

I know what the uscis manual says, but I dont see any consistency

if I do a google or visa journey search for "k-3 denied cousin marriage" plenty of results come up, which is to be expected as the fiance visa application specifically asks if you are related, which the spouse form 130 application does not ask

if i do a google or VJ search for "cr-1/ir-1 denied cousin marriage" there are very few results, and even those cases there seems to be question of bonafide marriage, not its banned in the state they planned to live

the texas thing has come up, and some posters are in the opinion its OK if the marriage was taken in a place where its allowed

    http://www.visajourney.com/forums/topic/411309-first-cousin-marriage-in-texas/

and if one looks in this us embassy link, the cousin thing is mentioned under the K1, but not in the IR-1 section

I dont know if there is a consistent answer, I guess we will find out this week and she will be truthful

  6. question: should wife openly disclose at interview that we are related as cousins. i read through all of these threads on VJ website but found conflicting answers bout the whole situation:

    https://www.google.c...iw=1366&bih=639

Since we are in the ir/cr1 and got married where its allowed, Im thinking it really shouldn't be an issue because form 130 (for spouse visa) doesnt ask if you are related unlike the 129f for fiance visa that specifically asks for it.

to prove its a bonafide marriage i have emails, phone logs, pics, finances, affidavits, etc.

i know this issue may be uncomfortable for some, but originally being from the M.E., its totally part of our culture

    any thoughts?

  8. Have you read post 1 and 2?

Once the invoices show up as paid, print off the bar coded document cover page and mail the documents to the NVC. smile.png

Very exciting to be near the end isn't it? Have you looked at Saylins description of the Montreal Consulate? She has some photos about where to line up and some drawn pictures of the inside. smile.png

hi no i have not seen her posts, i will search it

we are excited but worn out from the process....just hoping 260 gets approved with no issues and the interview line isnt in the many months waiting wise

  9. what the laywer said is pretty consistent from what ive heard from others, including our own

the person you have sponsored obviously has immigrant intent, so the border officer can refuse entry....its very low chance, our lawyer puts it at 3% in his experience.

the "ties to the community" is subjective....b/c guess what, once your spouse paperwork comes thru the spouse is leaving that community/job anyways

  10. Hi, can someone please help us on the clearance required for canadian resident?

we went to her local OPP, in Caledon, we filled the form and they told us response time is 2-6 weeks!

I thought this was supposed to be done in like 1 hour and that this isnt supposed to be a document that should take time. (thats the conclusion I came to after surfing the threads here)

Did we ask for the wrong thing? Any tips? should we go to a RCMP to get it?

there is a Criminal Record Check or a Police Record Check

which one is best? any help appreciated

    thanks!
