Hey guys, hope someone can help me out here in regards to I-864, my husband and I have been living out of country for the past 6 years and have filed no taxes as we were told there was no need because his income was low; Should I send copies of the last taxes declaration we have along with an explanation letter ? Do I find myself a co sponsor or do I wait until they review and they let me know ? ... Thank you for any reply that may help

During the I-130 stage, USCIS doesn't approve anything, per se. They just make sure the petitioner is eligible to petition and that neither of you are terrorists or anything.
For NVC, they don't approve anything either. They just collect paperwork and fees. This is the stage where the beneficiary actually applies for the visa.
It's at the interview where the CO goes over everything and decides to issue the visa or not. And even if it is approved, it's still ultimately up to the border officer at POE to let you in. They can always still deny you if they wish. It's extremely rare; I've only ever seen one case here on VJ in the nearly 4 years I've been here.

Hey guys, wishing us all a speedy processing at NVC. I do have a concern and please if anyone knows or had experience about appreciate if could explain;
Is it true that even if your I-30 has been approved only at the time of the interview you will know for sure if you will get your green card?, like for instance if you overstayed your visa or any type of case of that nature, only at the time of the interview you will find out that you need to wait some period of time before you are able to go into the states. Is this really happening ??

My question is if I can contact the US embassy and since the I-30 has been approved I can file AOS, IV packets and make the payments to them directly or nothing else to do but wait for the snail mail from NVC, Thank you.

Hello to all fellow filers, congrats to all of you receiving good news and for those still waiting to hear best of luck and stay strong don't loose hope!!
Wanted to give and update as after calling NVC was told my case was received on 04-11- 14 and of course is way too early for a case #, was told to call back the very last week of May to check if a case # has been assigned by then.
One question, at this point is it possible to continue with the filing at the embassy or does it have to be completed at NVC ? would be awesome to save some time on snail mail

Trying to get somehow ready for NVC, so I got a question and hope someone can help; my husband and I have been out of country since 2008 so he has not filed taxes since, is it better for him to file right now before we get to fill out I864? household of 4, he made 32k last year 27k on '12 and 22k on '11 not sure if that would make it worse or if they ask for co sponsor anyway

Last week of October. I have not seen any November filers yet.
I wonder what is NBC planning on doing with our files then? Will they keep them or transfer them? and when?
I really do not believe in Overland Park anymore. Not saying it doesn't exist. Just doubt our files are there.
Thx Blueberry for keeping up with the game and keep us informed, so what do you think would be best for us (September Filers) to happen ??? to stay on Lee Summit or get transfer to Nebraska ??
any ideas on waiting times from both places??

I do believe that there are some people who are working there now, so maybe they haven't begun sending a huge volume of files there. I will tell you that Overland Park and Kansas City are so close to one another--probably less than 20 minutes, depending on traffic. With the government shutting down for a couple weeks, pretty much everything slowed to a stop. Employees who were transferring to other offices in different states were delayed that transfer until the government opened again (info from friend). So, now that the government is up and running again, I'm sure they will be working on getting the office fully staffed. Hopefully for all of you things will go quickly. I'm waiting on the Cairo embassy, and she told me they were so backed up there my fiancé's interview might not even occur by spring (sigh).
As for being a stalker for you guys, I'm thinking that might be a fun side job! I'm always interested in honing my stealth-like skills

Thanks, I hope so let's see how it goes from now to December. Wow is a long wait, but with the situation there I was under the impression Embassy was rushing up on the cases as the way of living gets harder by the day

Sorry if someone already posted this I haven't read the above posts...she said Overland Park is not fully operational yet and they are still hiring ISOs. She also mentioned that the government shut down has delayed that hiring process but they may be back on the hiring trail. She didn't know when it would become fully operational. "This is our latest report from our "stalker" in KS he lives there and was kind enough to inquire in our behalf basically the are "hiring" so no processing yet at least it appears that way, USCIS told me that our files might be at Lee Summit getting processed there but again is only a guess because no one knows for sure where our files areI hope there are at LS at least we have a better chance, they have working people in the building ... Prayers of hope to everyone !!

that sucks! but on a brighter side, "not fully operational" could also mean it still operates atleast somehow...
I highly doubt there is any bright side, all they have is a room where all of our files are just being piled up they have not even hired all the ISO's they need to open. I do agree that sucks!!!!!!!!!!

KS, we all got this NOA 1 and on the envelope has a PO Box Overland Park, KS Now, how the hell they send over all of our files to a place that is not even ready and workers are not yet hired !!!????

there's a June filer who's NOA1 had overland park, kansas as the address on it and he was approved just the other day. See the June 2013 filers post.

Overland Park is a large city just outside of KC, MO (more like a suburb), but yes, it is in Kansas. I met a woman who works for immigration, but she only mentioned the downtown office (meaning KC, MO). When I see her again, I'll ask about anything in OP. I live on the Missouri side of Kansas City.

Does anyone know anything else about this ghostly place ?? seems like they are still deciding on the decorations and color of paint that is going to be used while more and more files keep piling up ....
At the beginning of the process I was thinking it could take about 8 months then with all the happenings moved to 10-12 but now is like 16 and beyond
.......... no one seems to know anything for sure about this place which is terrifying ....

I just started researching the k-3 process..As a September filer , I'm starting to think seriously about filing a I-129..I know there's talk of the I-130 process going back to a 6 month or less timeframe, but none of us really know that to be true..We could be in for a long long wait of 12 months or longer before getting our loved one/one's to the good ol US of A.
my #1 priority is getting my wife to the usa ..the conditions really dont matter to me as far as permanent residence status or green card status....we can deal with that once she's here..
Exactly !!! that's what I said let us get there and then have us wait no matter the time but let us get there first!!! please post any info or updates you get and, if anyone else knows something please share, it is insane and depressing to see all those applications getting approvals so soon, makes no sense at all !! somehow if you are only thinking about marriage you get to travel right away but, if you already married so you going no where..... it should be the other way around,filing for a spouse should be priority over a fiancee

To file a K-3 does the petitioner has to be in the US ??? With no clear answers or accurate processing times I think the best option we are left with is to file for k-3 ... Anyone has more details about this process ??? For what I understand the processing time is about 5-6 months (better than the year estimate that we have for the I-30) that cost more and that in order to complete the whole process (receive the green card) may take longer at the end are basically the cons but, I personally don't care to wait 2 years or pay more for the green card if I'm already in the States, I'm honestly anxious, desperate and willing to do whatever necessary to get out of this country and go back to the States .. I'm starting to feel that I'm no longer stressed out but sinking into depression
If anyone knows anything about this K-3 please!! please !!!!!!!!!!!!!!!!!!!!!! HELP !!

Hello everyone, best of luck to us all and congrats as we made it this far
Got a question and hope someone can help to answer
I have been told that the officer at the embassy is the one that basically denies or approves your visa request, can he also request that you file additional forms or even request a sponsor for your case ?? Thanks for any helpful answers
