  1. Hey guys, This is probably off the topic, but it is related to the AOS process, and I was wordering if you guys could light me up ;)

    So I got my EAD card on may 22 and it was issued on may 16. The first thing I did was to apply for my SSN the very next day. When they received my application, they gave me a letter saying that they were going to have to verify my documents so they could assign a SSN for me because my status was not updated by the DHS. it also said that such verification could take around 4 WEEKS!

    I went to the SSA office agan today, and the same guy who processed my application said that my application was still pending and not verified and that I should have waited two weeks after I got my EAD to apply for my SSN and I could have had my number right away (He didnt tell me that when I first brought my application - I felt like yelling at him). After that, of course he said that theres nothing I could do but to wait for the verification process to end and then to wait for my card.

    My questions are:

    Is there anything I can do to try to get my number faster that those ridiculous 4 weeks?

    Should I contact the USCIS since that guy said that my status hasnt been updated after I got my EAD?

    The company who gave me this job offer over a month ago needs my SSN to process my background check. I was never aware that this delay could happen as many of the people here get their numbers right away. I am so desperate now...

    It is annoying, but i truly believe you can't do nothing about it at this point.

    It makes me mad that uscis ask for join assets when they know we don't have ssn.

    My husband can't add my name in nothing... it sucks.

    Geez.. Sorry to hear about this. It's either their online system for confirmation is simply unreliable or the one who assigned your interview date in Kansas was just too fast. Ugh! Hoping with you that you get a new interview date scheduled soon.

  3. So, a little bit of (bad) action on our case:

    May 06: I updated my address online, as we moved from Kansas to North Carolina

    May 12: case was changed to T&I

    May 13: change of address confirmed

    May 22: letter sent with interview date to July 1

    And guess what???

    My landlord in KS got my interview letter!! They schedule my interview to Kansas City (1200 miles away), when I'm already in North Carolina for 3 weeks!!!

    So today, I had my interview cancelled (on the costumer service)....

    And now, waiting for USCIS to reschedule it.

  4. my inteview was at federal plaza was called at exactly 1pm by 117 is was downstairs in the lobby so my case is being held for review.

    interview was 10 mins only ask what is my name date.of.birth phone number, if i work ,some of the yes or no question and if my husband works and what does he does if we have children and their age that was it she gave me a paper saying my case is held for review and they dont need any thing further and a final decision will be mailed to me they didnt even take any of the documents only my i94 since everything is on file so im just waitin now arghhh!!

    update ead was picked up today schedule delivery saturday 24th yippee just waiting for update on my i485!

    hopefully you will see you GC in production on the next hours!

  5. You need to ask your country (through the embassy) for a "no objection" letter. It means you country has no objection on letting you staying in the US and skip the 2YHH. The embassy will sent the letter to the Department of State, while you apply with them as well, sending the DS3035: http://travel.state.gov/content/visas/english/study-exchange/student/residency-waiver/ds-3035-instructions.html#nobjection

    Like I said in your other thread, you are not eligible for AOS at the moment.

  6. what about if i dont file i765 but still work ilegally while waiting for the process? will i get a hard time when im going to interview? and yes my DS 2019 said that 2 yrs home country physical presence requirements and marriage US citizen doesnt remove the requirements. well basically i've ever been a J nonimmigrant but i never accomplished the program. so what should i check then? yes or no? what if i check YES then they ask "where is my waiver" or i check NO but my visa would shows that i came here as J1? i really confuse right now. but anyway thanks for your answer. it was helping (;

    I do think you are going to have a hard time if you keep working illegally.

    Once you entered in the US with a J1 visa, even if you have worked only one day on your program, you are already subject to the 2 years home residence requirement.

    Right now you are not eleble to file the I-485, since you are subject to that rule.

    You need to apply for the waiver asap and pray for it to be approved. I have heard it is not easy to be approved, but the "no objection" one is the most likely to get approved. If it is not approved, you must go back to your country.

    Do not check NO; if you do, you will be lying. If you check YES (if you try to send the paperwork before get an waiver), I doubt you would get the adjustment approved.

    I was also subjected to the same rule and I needed to come back to my home country and stay there for 2 years, even after marry my US hubby.

  7. I'm sorry to interrupt here but I got a question. I was also a j1 visitor, I was an exchange student, this j1 Visa was eligible from Jul 2009 to Jul 2010. I then went to Poland, my country, and after summer got back here again on the F1 student visa, graduated hs here. I've been in my country since June 2011 til February 2013. However my j1 thing in my passport does say "bearer is not subject to section 212e. Two year rule does not apply. (Poland)"

    Am i good? We just got approved for the k1, I'll have to schedule interview in my country soon.

    Does the box in your DS is checked?

    It seems that you are not under the rule.

  8. Read the back of your DS2019. It clearly says that even if you marry a US citizen, you still need to fill the 2 years requirement. If you have been in UK (only in UK) since Oct 2012, you will be elegible to apply for permanent residency in USA only in Oct 2014. You can always try a waiver, but it would take several months, and you would probably have a answer close to Oct anyway.

    I was under the same rule) and I needed to stay in my home country for 2 years to then apply for my green card. I completely understand how frustrating it is. You can always come to US as a visitor, though.

  9. Put lots of neosporin on it and go back on your regularly scheduled day for the appointment.

    I'm using it since when I cut; hopefully it will be healed by Tuesday, but I seriously doubt... Thank you for the tip anyway!

    i also have a cut on my finger. dont know what would happen my appointment in next week

    If your local office is close to you, I would go and see what happens; they may take your fingerprints, who knows...

  10. Went to an early walk in 4 days earlier to take my biometrics in Kansas City, which is 2 hours away from where I live. Well, everything was fine until the officer asked me if I had any cuts in my finger/hands. Yes, I cut my finger yesterday morning, before leave home (unbelievable). It is very small and when I did it, I didn't even thought that it could be a concern. So, when the officer asked me, I said yes and showed the cut. He was very sorry, but said he could not take my biometrics and told me to came back only when it is COMPLETELY healed (he even grabbed a bunch of bandaids and ointments and gave to me!).

    I really don't think it will be completely healed in 4 days, when is my actual appointment. But, he said I do not need to make another appointment, and if my cut is not healed by tuesday, it won't affect or delay my process in any way.

    But the biometric letter states that my process will be considered abandoned if I don't go on the scheduled date and since the officer didn't make any note on my file, how will they know that I'm not there at the app day because I have a cut finger?

    I'm just so frustrated and disappointed with my luck...

    Any insights? Should I call USCIS to let them know what happened?

  11. I'm married for over two years now, but we have lived mostly of this time in Brazil, since my husband got his permanent residency there a lot faster and easier. Now we are living here in the states and we also don't have absolutely nothing showing our both names on it (his bank - BB&T, didn't let he add my name on his bank account; also, we live on his mom's, so we don't have leasing). It makes me worry too, since my AOS interview is upcoming. In those case, like mine and the OP, emails sent to each other, pictures, phone calls, texts messages, itineraries of trips to each other countries, etc, would suffice (I have sent all those things with the I-130, along with 7 affidavits of bona marriage from friends)?

  12. So I called USCIS today regarding my case. My first time calling, so I learned a few things - that many people here already know (so please excuse me as I may be preaching to the choir for some).

    The first and foremost thing was that the first level of customer service is completely useless, i.e. they cannot see anything more or do anything more than you yourself can online.

    I called promptly at 8AM and got access to an agent almost instantaneously after navigating the prompts. The agent asked for the receipt number and why I was calling. I gave him my I-485 number and told him that it has been 30 days and I have not received my biometrics appointment yet. So this guys solution to my issue was to look up New York processing times for I-485s and came back to tell me that they are still processing from June 2013. I told him - yes, but those are adjudicating timelines, biometrics are usually done within a few weeks. I asked if I knew if an appointment letter was mailed out and if it could be possibly lost. He then responded by assuring me how reliable the US postal service is (really guy?). His solution was that I give it another week before calling back - and I have no idea how he came up with that extra week as its been 30 days already (not within protocol). Anyway I quit after that.

    After I got off, I was a bit angry at myself for not asking the right questions. So I called back again, and got to an agent almost instantaneously again. I told her the situation and she started to create a service request. In the process she saw there was already a service request I had made about this online a few days ago. So she said I'd have to wait till May 6th before calling back and proceeded to say thanks and was going to hang up. Not wanting to take no for an answer this time, I asked if she could look into the EAD app since there was not a service request on it. She said yes and took the relevant info. Then she essentially comes back with another service request number and says I need to wait till May 2nd. So I ask her - I could have done this online, and she says yes. I ask her if she has anymore info than I have available online, and she says no. So frustrated at this point, I ask if I can speak with a level 2 person (something I learned here). She says yes and takes info to "escalate" and transfer me.

    It's about 8:30AM by this time and the wait is only 11 minutes. I get to a level 2 officer, from who's voice I can tell is just more adept than the schlubbs I just spoke to. After getting the relevant data, says my appointment has already passed in NYC, can't tell me the date it did, but put in a service request to NYC ASC to reschedule the appointment. I should receive a notice by May 2nd, if not call back - and I cannot go in earlier without the notice. So that's the resolution for now.

    Thought I'd share. I know most of the veterans here already know how useless level one support is, but hopefully the newbies and junior members can take a tip. To me it was just mind boggling as to the fact that their only real use is for people who don't have access to or can't use the website. No added value other than that.

    Moral of the story for March filers - if you haven't received a biometrics appointment yet, call and speak to a level 2 person now to reschedule!

    Hoping to get mine back on track.
