  1. My husband & I are leaving the country while our case in pending approval and I am just wondering if I should anticipate any problems. We just sent the paperwork off so while I'm hoping we'll have an extension letter by the time we leave (in 2 week) I'm not positive that we will. His current green card doesn't expire until the end of May and we will be returning before then, so I'm assuming this won't be a problem but just wanted to double check.

  2. I have filled the I-175 and am working on gathering the evidence. Should I include our 2006 taxes even though I filed seperately though we were married. (Sam didn't file as he wasn't working in the US during 2006). Also, do personal letters have to accompany the sworn affidavits from the people signing them? I found some sample letters in the guide and wasn't sure if they were optional or not. I noticed on the sample cover sheet, it mentions that a passport is included as evidence but I don't remember reading that it should be. Have you guys generally included it anyway? And finally, I am submitting a copy of our joint taxes for 2007- do I have to include my W-2's as well as Sam's? This is not a transcript from the IRS but a copy of our filing online.   3. My husband just received his EAD and has been hired by an engineering firm. However, when he began filling out the paperwork to begin work he noticed a note to nonresident aliens on his W-4 requiring him to check Form 8233. We are fairly certain he doesn't need to fill this additional form out but just wanted to double check. Does anyone know anything about this? Thanks -Jessica

  4. My husband and I sent in our paperwork for AOS and Ead, received NOA's, and he had his bio appt. in Philadelphia last week. However, when I went online to check the status of our case, it said it had been sent to the California Service Center for further processing. Is this normal? Should I be alarmed (since I thought everything would be done through Philadelphia)? Any thoughts appreciated... Thanks, Jess

  5. Thanks very much for your help so far but I have another question.

    In filling out the I864 affadavit of support is it possible for me to have my mother be the only sponsor. We are having a problem getting her birth certificate which we would need to provide proof of us citizenship for an I864A and her income would be enough to meet the requirments without mine. I am dubious because of the answer to question 1 which would have to be a (I am the petitioner. I filed or am filing for the immigration of my relative). I am not sure if son in law would count as a direct relative and obviously all previous paperwork has been filled out by myself. Thanks very much for your time and help.

  6. I do not meet the income requirements for I864, so I am using my mother's income to sponsor my husband. Does my mother need to be a "joint sponsor" (we live at the same address) and fill out the I864, or can I just use her income so that I am the only sponsor and have her fill out the I864A? If my mother does file the I864A she is required to provide proof of the relationship and that we live at the same residence. What type of evidence shows this? Birth certificate, etc?     Thanks very much for the advice so far. Everything is going well my fiance has his K1 visa and is planning to enter the country in September from the UK. Unfortunately his UK passport expires on February 2007. Is there any problem with him renewing the passport before he arrives in the US. Even though hes already been granted a K1. Thanks very much for your time and assistance.

  8. I have heard that JFK is the only airport that sometimes issues EAD at POE. As my finace and I are considering flying in through JFK I was wondering how common this was. Should we have any additional paperwork with us in order to apply for EAD at POE? And can you use the EAD to work without a SSN? I'm afraid that if JFK rarely issues EAD's at POE than it's a waste of time to fly through that airport when we could use an airport closer to our home in the US... Thanks in advance! Jessica

    Second post today, thanks again for your patience.

    My fiance has informed his work that he wants to leave and this has then inspired them to offer him significant incentives to stay. We have already obtained a K1 visa and plan to get married in late October. Has anyone ever obtained a K1 visa then gone to live in the non US country for a couple of years. If this was the case. How long would it take for the US citizen to be allowed in the UK after the wedding. What other steps would we have to take to make the move possible. It looks like things would get complicated with the Adjustment of status and I'm sure there are issues we haven't even considered. I realise this is a rather open question, so thanks very much for your time, you have all been a great help so far.

    Thankyou very much for your help so far everything has gone well my fiance has his visa and will be arriving in a few months. We are now just wondering whether it is worth him coming into JFK to obtain a temporary work visa. As far as we can work out this is the only worthwile way to start working before obtaining adjustment of status. This work authorization will run out when his I94 runs out. There will be a period of time when he cannot work because he is waiting for AOS. Has anyone ever been denied work authorization at JFK and is there anyway to continuously work if you are waiting for AOS to clear.

    Luckily I did have my passport number and all the information because I had made a photocopy of it for the 129F packet. I just put a deposit down on my dress today and was making myself sick with worry about the whole thing. I am usually pretty organized, I couldn't believe I had lost track of my own passport. :unsure:

    First of all, your passport has NO bearing on the case what-so-ever.

    That is, unless you submitted copies of all the pages of your passport with the petition instead of your birth certificate/naturalization certificate/etc. If that is the case, then the passport would be needed at the interview because the Consular Officer has the right to ask to see originals of any copies submitted with the petition.

    I did submit a copy of my passport for the 129F but only to show passport stamps and that I had been to the UK within the past two years. I submitted my US birth certificate to prove citizenship.

  12. I actually misplaced it somewhere between getting home from the airport. I had just been to England, and came home, got through customs (so I know I had my passport with me then), and I'm fairly sure I had it in the car as well. I got home, dumped everything in the house and the next day i couldn't find my passport. Stupidly enough I lost it somewhere in between... it will probably turn up the second I send in the missing passport report....

  13. I have just returned to the US after visiting my Fiance who lives in the UK. We filed for a K1, sent off packet 3 and are just waiting for an interview date. Unfortunately when I got home I realized I misplaced my passport. I am going to report this asap but am not sure if this will effect the KI process. Again, I am not the beneficiary. Does anyone have any idea if/how a lost passport on the petitioners part will effect a K1 visa? Thanks in advance...

  14. While looking at packet 3 I am confused as to whether you send documents off with it or not. It repeatedly says on the packet not to send any documents. Yet DS156 it says please attach the following documents: birth certificate 134 etc. Also is it necessary to generate barcodes for DS156? I filled it out and printed it online but no bar code came out. Thanks.

  15. My fiance will be off to his medical tomorrow although he has yet to get a passport photo. How strict are they about the passport photo being to the US size will he get away with the standard UK photo. Or does he need to find somewhere with the correct size. If so does anyone know of a photo place near to the Kensington medical centre. Thanks very much for your time.
