When My fiance, now wife had her interview in Honduras, I went with her. I had no intention of letting her do this by herself, especially because of the way the embassies in Latin America treat the people down there. I do believe the outcome might have been different if I was not there. And since I love her more than anything else in this world and since it was my money paying for my life long investment, I never considered not attending. Hope this helps

So the answer to all of this is it does not matter if you are "out of status" so qeverbody should quit worrying about it.

I do not believe you are out of status after the 90 days for the K-1 visa. In the instructions for the K-1 visa it says file promptly after marriage, it does not say get married and file within 90 days. we got married gathered our documents as they came available sent in our AOS papers about 4 weeks after the visa expired. They cashed our checks and sent us NOAs, no problem.

It is better to do it right the first time and make sure everything is in order. I have said many times on this website the instructions for the K-1 visa in #9 say file promptly after marriage. No where do they instruct you to be married and file within 90 days.

When I had my wifes birth cert translated I did what you did and called a translating service. Cost me $80, good luck.

We filed the AOS papers about 4 weeks after the K-1 visa expired and already received our first NOA. I know in the K-1 visa aplication #9 It says to "file promptly" after marriage.

In the instructions for the K-1 visa, I think #9 it says AOS must be filed promptly, not within 90 days of entry. It says you must be married within 90 days of entry.

In the instructions for the K-1 it says you must be married within 90 days. Also in the instructions for the K-1 in #9 it says "How does your Alien Fiance obtain permanent resident status? your alien fiance may apply for conditional permantent residency status after you have entered into a valid marriage to each other within 90 days of your fiances entry into the US. Your alien spouse should then apply promptly to UCIS for adustment of status to conditional permanent resident, using form I-485, Aplication to register or adjust status."
I think they know it takes a few weeks to gather the documents. It took me 4 weeks before we were able to obtain our marriage cert and that put us over the 90 days by 2 weeks. Nowwhere does it say that you must file before the 90days is expired.

MR. PRESIDENT, I'M HEADED TO MEXICO
Dear President Bush:
I'm about to plan a little trip with my family and extended family,
and I would like to ask you to assist me. I'm going to walk across
the border from the U.S. into Mexico, and I need to make a few
arrangements. I know you can help with this.
I plan to skip all the legal stuff like visas, passports,
immigration quotas and laws. I'm sure they handle those things the
same way you do here.
So, would you mind telling your buddy, President Vicente Fox, that
I'm on my way over? Please let him know that I will be expecting
the following:
1. Free medical care for my entire family.
2. English-speaking government bureaucrats for all services I might
need, whether I use them or not.
3. All government forms need to be printed in English.
4. I want my kids to be taught by English-speaking teachers.
5. Schools need to include classes on American culture and history.
6. I want my kids to see the American flag flying on the top of the
flag pole at their school with the Mexican flag flying lower down.
7. Please plan to feed my kids at school for both breakfast and
lunch.
8. I will need a local Mexican driver's license so I can get easy
access to government services.
9. I do not plan to have any car insurance, and I won't make any
effort to learn local traffic laws.
10. In case one of the Mexican police officers does not get the
memo from Pres. Fox to leave me alone, please be sure that all
police officers speak English.
11. I plan to fly the U.S. flag from my house top, put flag decals
on my car, and have a gigantic celebration on July 4th. I do not
want any complaints or negative comments from the locals.
12. I would also like to have a nice job without paying any taxes,
and don't enforce any labor laws or tax laws.
13. Please tell all the people in the country to be extremely nice
and never say a critical word about me, or about the strain I might
place on the economy.
I know this is an easy request because you already do all these
things for all the people who come to the U.S. from Mexico. I am
sure that Pres. Fox won't mind returning the favor if you ask him
nicely.
However, if he gives you any trouble, just invite him to go quail
hunting with your V.P.
