    Hi just had my interview last Sept 11, 2013. I received an email subject 221G, The USEM is requiring me to present Evidence of Current sustainable Income and Petitioner 2013 total Income. It was because my fiance just started his new job this June 2013 so we just presented a coply of his paystubs for his new job and also his latest income tax return for his self employed but a little low, so we didnt meet an income requirement. Anyone there that can give us input. Is there anybody there that can relate with my case? Thank you.

    USCIS is clearing administrative processing as soon as possible. You will require to call USCIS office to to know about your case status.

    Hi i was given a 221(g) form saying they refused to inform me that our application cannot be accepted it was denied for some reason. She stamped my US tourist visa with "cancel without prejudice" i was thinking everyjing was good and she kept our passports . And told us yo wait for a few weeks. What does it mean.? Told us to go home and wait. Urgggg this is such a pain.. I dont know what is the decision and what is missing. Do you know how long does it take for them to communicate after getting that administrative processing?

    Entering US on the intention to get marry is not advisable. For mariage, you have to file Fiancee Visa. Hope that is not a issue for you. It is better to Call to the USCIS officer & explain them that ypu have planned marriage.


    Hello all,

    Starting to worry a bit. My fiance had his interview in Naples 2 weeks ago today, and they told him he was approved but there was still some work to be done on it, and he would get it in 2 days to 2 weeks. They kept his passport. Yesterday he called and they said to look out for an email with a tracking number, but they didn't give him a timeline. I know you shouldn't plan anything until you have the visa in hand but due to family pressure we have already planned the wedding for less than 3 weeks from now and bought his flight for less than 2 weeks from now. So I'm starting to wonder exactly how long can they keep his passport without returning it to him? Most people in the Naples reviews say you can get the visa the next day or sometimes it comes a week later. Anyone have any ideas why it could be taking so long? I am going to call today because I don't think my fiance asked them enough questions, but does anyone have any other suggestions? Thanks all!

    I believe you have to bring all your communication paper, but let it be organized. It may be asked by the immigration officer.

    does the Affidavit of Support (i-134) is to be sent to the Embassy when i received packet 3 or is it to be brought to the interview?

    Just answer to your question asked.

    They will ask on the basis of the Visa you received.

    Hello everybody, finally I will go to my interview on the 25 of september. What a stress!!! I am so scared! Checking and checking the paperwork again, the more i read it the more doubts I have. I really hope you can help.

    For example, it asks "Do you intend to work in the US (if yes, give the name and complete address of employer) Of course I will want to work in the future, but I don't have a job there yet, what should I answer to this question?

    Another doubt I have is concerning the same form, but for my daughter who's immigrating with me, what should I answer in your opinion where it asks the purpose of her trip?

    Moreover, it asks if anyone ever filed an immigrant visa petition on my behalf. Do they want me to write my boyfriend (the petitioner) name? Or should I say no?

    Oh do I need to submit his tax return also or the w2 tax statement is enough?

    Sorry for all the questions, but I am going crazy here, I know you have or had the same concern smile.png

    You can visit the embassy, with a proof & copy of the mail to collect the packet. You can unseal the packet & check with the USCIS office if you have need any clarification.

    There has been several delays here in Kuwait on visa processing. But today I received email notification that our package can be picked up from the embassy.

    "We have received your K1 petition from NVC, please find attached our instructions. The petition is valid till 18-NOV-2013".

    Thank you for your inquiry.

    The letter is ready in a sealed envelope under your name, at the reception window 2 - of the US Embassy. There is no need to come inside the Embassy compound.

    You may come starting from next working day, Sunday through Thursday, from 1 p.m. till 3 p.m.

    If you can, bring a copy of this e-mail with you and show it to the reception.

    The Consular Section is located in the American Embassy in Bayan, Block 6, on Masjed Al-Aqsa Street (302 Bayan).

    To renew your H1B Visa , USCIS will require the following documents,

    1 .Valid passport (at least six months validity remaining).

    2. The original of the form I-94 issued to the applicant by the Immigration and Naturalization Service.

    3 .Form I-797- It should contain the latest approval notice .

    4. Employer's Letter of Support addressed to the Visa Office of the Department of State.

    Hello All,

    I had H1B visa and got expired on 22-Sep-2011. During my visa validity i did not travel to US due to some reasons.

    So my questions are:

    1) Is there any way that I can renew my expired H1B visa. If so what is the procedure for the same.?

    2) Will I come under H1B Cap Exempt?

    3) Do i need new employer to file petition?

    4) If at all i get visa then what would be the validity?

    Hi All.

    We are petitioning my wife's parents.

    We finally submitted the DS-230 and I-864 with supporting documents,

    Two questions:

    1. What happens next?
    2. Do we need to send her parents copies of the I-864, showing all the financial information? Will they need it during the interview? Or can we keep that between us and the US government? ;-)

    Hi everyone,

    Total newbie making my first post.

    I am a British citizen and have been living the US for 11 months. My B1 visa to work as a volunteer is due to expire on December 31st 2013. What is the easiest way to extend my status?

    I read online that it cannot be extended past a year. But this is at odds with what I was told when I originally applied. They told me I would be able to extend it once I was in the US. They granted me a year initially, but this was extended to the above date by officials at the airport when I re-entered after a recent trip abroad.

    I see that the fee to renew is $290 so I can't really afford to get this wrong!

  10. Your Parents intention to live, work & retire in US, ant not to get Citizenship. Living in US they still can maintain their citizenship in Cananda, so that they may get their all the benefits form their home country.

    But, they can enjoy the benefits of both Cananda & US if they get Citizenship form USA.

    I am currently a permanent resident of the US and my husband is a US citizen. My parents are considering coming to the US to live, work, and eventually retire. I'm working on getting my citizenship so that I can bring them down here in the near future. My parents are concerned about whether they will still be able to get their old age pension from Canada and any other benefits they would typically be entitled to in Canada as they get older, if they were to become permanent residents of the US.     I really need every one's say about this :-|

    I have a pending I-130 pending for both my parents while waiting I have been contacting my friend whose been thru this and her parents are now here in the US. Anyways, she advise me to put my underage brother (19 yrs old/unmarried) on the AOS under my moms because she said that my brother can go coz his underage. The reason why she's saying this is because during her mom interview (US Embassy Philippines) the consular officer notice that she has (My friends mom) has a 19 years old son, so the officer ask her, why didnt they put his name coz he can go with her since his underage. And my friend even told me that she has hired a lawyer and the lawyer dont even know about this.

    Anybody know about this? I mean, I would wanna do it, put my underage brother's name on the AOS of my mom if its not gonna hurt.

    **now my questions is anyone who has already done a I-601 waiver for a fiancée, (Canada)

    1. what other documents does one need? do you need to have originals of any forms/paperwork (police records, citizenship, etc.)

    2. do you need to also acknowledge why the fiancée was denied (moral turpitude) do you need their police records, statements, letter from them?(originals/copies)?

    3. does the USCIS only care for the extreme hardship the US Citizen would incur in that portion of the packet, since the fiancée is already denied for having a charge involved in moral turpitude?

    Please anyone who has done a I-601 waiver packet via attorney or on their own guide me so I have all the paperwork. Please give me any input.

    My main concern is putting the packet together properly and also having legitimate proper format for the hardship letter.

    I consulted with 3 attorney's and unfortunately the fee's are extremely high, which I cannot afford at the time. I learned from my research the I-601 waiver is kind of like a k-1 visa binder.

    You need to be organized, good grammar, to the point and sincerity and have the following in the I-601:

    use fasteners or a folder with two prongs on the top.

    tabs should be on the bottom

    1. a brief explaining a bit about the relationship with your fiancée abroad

    2. a letter explaining the hardships you will incur with the most extreme hardship first to show emphasis. Along with the hardship you must have proof.

    Qualifying hardships include: illness, if your a caregiver, anyone dependent on you, education, work, debts, property, your spouse that cannot get into U.S. country is not a good place for your future.(need proof of them)

    3. affidavits/ letters from mom, dad, siblings, cousins, aunts, uncles, friends, community, work, doctor

    4. any documents like taxes, property docs, statements of credit card, copies of checks that may prove you help with anyone dependent on you.

    5. photos of you with your family

    6. photos of you with your fiancée

    7. basically any strong ties to the US that will enable you to move to another country.

    PLEASE, give me your feedback as it will help me.

    My fiancée was denied due to a charge of moral turpitude and the waiver is our only option for him to get approved and get a visa so we can get married.

    You can contact the USCIS as you have been advised. So that you will an idea on what can be dome further.

    My fiance went for his interview and they told him that he needs to go for another one. So we thought he was denied. So we were making plans to get married. Then I got a letter from the USCIS and they said that they are reviewing it. Nobody can tell us why. The state department told me to contact the consulate to find out why we were denied and they would not give us an answer. we do not know what we should do. please tell us

    Once you are US, You Finacee has to file Few Forms in USCIS. If you plan to marry in US in tourist Visa your intention is wrong. You can veiw the USCIS Website to get more information. Marriage has nothing to do with EAD and EAD is a document which authoriz you to work in USA.

    Did you check wiht USCIS?......if not call to USCIS National Customer Service to know about the case staus. You will be receiving a mail notification about your ineterview Date.

    I-485, Application to register Permanent Residence or Adjust Staus & EAD is Employee Autorization Document.

    Hello People,

    We have filed I130 and I485 concurrently and I have submitted fingerprints with early walking in August 1 which was originally scheduled for August 15.

    In August 14 i got text message and e-mail saying that my case status updated to "testing and interview" stage and it is ready for scheduling and no update since.

    I assumed that whenever they decide on a date for interview they will send me a hard copy of the appointment and also they will notify me with e-mail and text message with the date and time. Am i correct? I started to get worried because maybe they will send me the appointment letter without notifying me with e-mail or text message or updating the case status and i may miss the appointment since the mail is lost.

    Also, I read that EAD card is totally separate from I485 and I will get it if it gets approved whether or not i reschedule an interview appointment in case i may not be able to attend. Is that correct?

    You can either marry her in US or UK. Later you can decide on where to get the Citizenship. If your intention to get marry in Tourist Visa, it is advisable to get a advice from an immigration attorney.


    Hey guys,

    I plan to visit my girlfriend in the US (Kentucky) in December, it'll be our second meeting after knowing eachother 11 months.

    My understanding is that I am able to marry under a tourist visa (my intent is to return to the UK and to finish my education).

    However, would this be advisable? Or should we wait?

    Some people have told me the marriage has to be well photographed and documented, is this true?

    We've not got much money at the moment and we probably will keep it closeted, between the two of us for now without a big reception and such so the pictures wouldn't exactly show much.

    We'd like to keep our options open in terms of where we decide to settle - does it matter which country we marry in?

    Also, provided it is advisable to marry in the US, how would we go about this in terms of acquiring a marriage licence?

    Hello.
    I m Russian under L1 and plan to get married to US citizen Sept 13 who I dated for 6 years and then I plan to apply for EAD and advance parole. Though I m going back to Russia feb-mar14 to work on my other assignment. I know that green card process is long and not sure I can wait that much before going back.

    1) Is it an option to get EAD And Advance parole and go to Russia and then get a Greencard in Russia through USA embassy or come back to USA for an interview? Or to get the card I d need to stay in the US until the interview? My visa is valid till oct 14.

    2) Also how much time should I assume for AED card to get after filling in all papers?

    I have sent the DS-230 IV Application Forms of all my Family Members about One Month back to NVC for my Mumbai,India Case Visa Processing.

    Now somebody told me the US Consulate will not accept DS-230 and I have to fill DS-260? is that correct? what happens to my already pending Application?

    will it get delayed again and stop process until new DS-260 is submitted and Reviewd?

    I have my Visa expiring Sep 30 2013. My Eemployer is trying to file the LCA application throug an attorney in the Labor ICert system. The attorney is

    telling me he is not able to submit online siince the system is down since early August. Not sure what is the real reason. Is any one Agetn/Attorney able

    to file the LCA application recently he is also saying this is a known issue, please help

    Can anyone help with possible answer to this situation:

    EB-5 investor's I-526 application was approved. Investor and spouse and minor children can now get visas. Before finishing the visa application through NVC, investor (who was pregnant) gave birth to baby. Is baby also eligible for immigrant visa?

    The Embassy will return back your Passport through post. Id you need earlier, you can request the embassy & speak to the officer & explain to get the passport.

    We had our inverview by June the 10th, everything went good except that we didnt had the medical reports yet and got a yellow paper, we got our medical exam on the 16th, went through medical examination, doctor went on vacation (another delay) for 2 weeks! came back and had our medical reports sent by aug 16 with passports, the secretary of the doctor DIDNT sent my medical report (she did with my parent's), by august 20th i got a call from the embassy telling me that they are waiting for my report and wonder why they didnt sent it all toguether, went to the doctor's office and the secretary told me that my medical report was ready long time ago and i had to pick it up personally and send it by myself trough dhl... the embassy got everything by august 21, sent an email some days after and they just said they got the medical report and that the case is being processed. by sept the 4th i got no news yet, does anyone has an idea how long it takes for them to return the passports?

    I start by wishing everyone good luck smile.png I am new here, I need your help please check the following:

    - My fiance living in N.J submitted the application on 20th March 2013 through a lawyer

    - We provided all the documents as lawyer asked like: pictures, greeting cards, my birth certificate, police clearance from Dubai and Pakistan etc. all original copies

    - Last week my fiance got a letter from USCIS asking for more relationship proof, now we're submitting all the chat logs, facebook , skype, her visit details of Dubai and some more pictures including engagement ceremony pictures.

    - Lawyer also asked us to arrange wedding venue (how we can do that when we don't have any idea about the dates as we don't know when we are getting the visa ? :/ ) relationship timeline and notarized affidavit.

    Is everything is okay and normal? please provide your inputs.

    Also my police clearance certificates validity is for 6 months so should I get new ones for the interview?? and my original birth certificate is also required for interview?
