  1. You can't adjust status abroad.
  2. You will receive the employment authorization category under the C(31). In the event that you did not file for adjustment of status when you received the approval notice, you must submit Forms I-485, I131, I765, I864W, and G1145 and pay the USCIS fees; if you cannot afford the fees, you should submit Form I-912.

  4. You mentioned " I submitted a motion to reschedule my removal proceeding." Once your Vawa is approved, you need to FILE A MOTION to terminate removal proceedings. If the VAWA petition isn't approved, then your attorney has to ask to close the removal and once your Vawa is approved, the attorney asks to terminate the removal.
  5. Inform Uscis when the case is terminated .If the judge terminated the case because Vawa approval then the judge won’t set up a hearing.
  6. Read the checklist of required Initial evidence. https://www.uscis.gov/sites/default/files/document/forms/attachments.pdf

  12. It is not a problem if the annulment is not granted.
  13. Uscis will not take into consideration what he will tell them, but they will consider his letter if he submits an annulment . Did you submit a psychological evaluation?
  14. It’s not just to write something , the professional must write EVERY abuse that you suffered and he/she needs to do the BAI and the BDI test as well .
  15. If the marriage annulment is granted you won’t have eligibility for a Vawa case .
  16. If you didn't get a letter from USCIS saying your file was transferred to Nebraska, then submit form I-765 to Vermont.
  17. Contacting the Ombudsman won't hurt your case, but did you file a motion to reconsider?
  18. You should end your attorney's representation in writing, and let USCIS know that all mails should be forwarded to you since you don't have an attorney anymore.

  22. I am not sure if I have answered your question previously. The following form must be resubmitted I-485, I-131, I-765, I-864W and G1145. You need to pay USCIS fees, if you are unable to pay fill out form I-912. As soon you receive your I-485 receipt, send a copy of the receipt to your local office and ask that the case not be forwarded to the Court because you refiled your case. Make sure you submit a copy of the receipt for the I-360 as well.

You must write your affidavit stating about the courtship, marriage and abuse. If your don't have a pending I-485 then submit forms I-485, I-360, I-765, I-131, I-864W and G-1145. Pay the USCIS fees, Fill out form I-912 if you are unable to pay the fees. Get affidavits from family and friends. Those who have been divorced for more than two years are not eligible to file a Vawa.
  24. USCIS is not obligated to hold your I-485; however, they are holding it until now, so I do not see any reason why they would deny it. But If your wife withdraws the form I-485 then USCIS will deny your AOS, and you will simply need to refile a new one.
