This extension period expires on June 18th, in one month and I am not expecting anything like an approval in one month seeing as the processing time is 17.5 to 19 months. What happens on June 19th?     You are still a legal resident, your legal status has not expired.  it's only your documentation which has expired through no fault of your own.  Make an infopass appointment and they will stamp your passport.  It's usually valid for 6 to 12 months (mine was 12 months).  That becomes your new proof of residency.  

     

    Technically you only need it to travel but if you are trying to prove residency for anything else like a driver's license, new job, or mortgage application etc. it's best to have the stamp rather than an expired green card.  (Incidentally since I didn't have the stamp at the time, I just sent my mortgage underwriter a letter, a copy of my expired GC, the extension letter, a print out of the USCIS processing times, and a print out of the USCIS website explanation of what the removal of conditions actually means)

    I didn't receive an approval notice in the mail.  I have moved house and filed the change of address online.  I only filed once, but there are 2 case numbers for ROC though so perhaps I should have it done it twice!?  Did anyone else receive the green card production notification before any written approval notice?  

     

    I'll update the tracker with todays date then, and amend it as soon as I can work out my approval date! :huh:

    This was a condition of my mortgage (US Bank) so here's what I submitted to the underwriters:

     

    photocopy of my expired GC,

    photocopy of the extension letter,

    a cover explaining that although the GC is expired my residency is permanent and I filed to remove the conditions of my residency on mm-dd-yy and what the USCIS current processing times state

    a screenshot of the USCIS processing times, with the current time highlighted

    a copy of the USCIS webpage which shows the process for having conditions removed

    I'm in no way qualified to give you accurate information, you may want to seek advice from an immigration attorney, but if I were in your shoes I would immediately send them a letter with my receipt number explaining my mistake.  good luck

Mirroring what others have said, I previously had no issues travelling using expired GC and letter, however my most recent trip I was sent to secondary inspection.  My husband was told he was not allowed to remain with me, or even in the terminal and needless to say caused unnecessary stress.  It seems their policies may have changed in recent months (hmmm, wonder who could be behind that one) and they automatically send us straight to secondary, however the officer told me that a letter does not replace an expired green card and that i was in the wrong for believing so.  He told me next time I better have a stamp in my passport so I have made an infopass apt to get the stamp.  

     

    My first experience with secondary inspection a couple of years ago  (before I even received my GC) scarred me for life.  It was a traumatic experience where I was treated like a criminal, all my belongings were just dumped out of my suitcase and every item including underwear was inspected.  I was left to pick everything up on my hands and knees as the officer bellowed at me to hurry up.  It was the most degrading experience of my life.  Now my most recent experience (which is the one with the expired GC) was actually quick and painless, but it triggered an anxiety attack in both me and my husband and I'm sure this is how it will be in future.  

     

    It's for this reason I will not leave the office until I have a stamp in my passport, or a 10 year GC in my hand.

    I use my CA drivers licence for domestic travel to avoid any issues.  I know not all states DL's can be used, hopefully yours can.

    I met my husband on a cruise, and we both love to travel frequently.  My mum was getting remarried so we traveled to Scotland to attend her wedding.  The cruise we were on to Mexico was a family vacation (18 of us).  I missed out on the last group cruise because of immigration issues, so I sure wasn't going to miss out on another.  The Alaska cruise is in celebration of my husband turning 40.  I made a decision to exercise my right to travel freely knowing that there is potential for someone to not understand the process, particularly in light of some of the recent border issues (citizens and residents being denied entry from certain countries).  

     

    The agent was only concerned by my expired GC.  He didn't care about anything else.  Interestingly, at the Ft. Lauderdale cruise terminal, when my GC was still valid the agent grilled me on my marriage, asking me questions about my husband, marriage dates, and citizenship questions, which I felt was out of order but I just answered his questions politely.

I traveled on a cruise to Mexico in May, handed over my GC and I-797 and was taken into secondary inspection.  I was told it was not acceptable to travel with an expired GC and a letter which "could easily be forged."  I was let go after he called and "verified with USCIS" and was told to get a stamp in my passport.  In reality (as I was watching him) he got scolded for wasting his supervisors time as she pointed to the letter and showed him exactly where in the letter it says I followed the correct process and to let me go.  I was watching the whole time, and no phone call to the USCIS was made.  

     

    My husband was not allowed into Secondary inspection with me, and was instead ushered to baggage reclaim where he was told he was not allowed to wait and had to leave the terminal.  He was an absolute wreck by this point with visions of me being deported and him no idea what's going on.  Obviously it was very stressful.  (This was Long Beach CA).  It's not my first visit to secondary inspection, I did a stint there when I entered the US on a UK passport but a pending visa application for permanent residency,  This visit to secondary was WAY less stressful for me.  Last time they emptied my luggage, and grilled me for so long I almost missed my connecting flight.   

     

    We are going on another cruise in a few weeks, to Alaska this time.  I have made an Infopass appointment to have the stamp in my passport.  I kept trying to reassure my husband that there's nothing to worry about but he said he would rather cancel the vacation than go through that again.  I had previously flown to Scotland and had zero issues using expired GC and letter when I returned to the US.  

     

    I am a September filer but my GC expires in October.  I was moving house right around the time I was eligible to file and decided to wait until after the move and submit a change of address before filing.

    Many countries return your old passport to you, but make a snip to the top corner to invalidate it.  Make copies to be safe, but hopefully they return it to you.

Upon our return to the U.S. the officer looked at both my GC and the letter and let me right through - No issue at all :)

    While I now feel that my anxiety regarding traveling was perhaps excessive, I think only those that are going through a visa process can really understand the stress that it places on a person. More so now than ever before. 

    I hope my positive experience puts anyone's mind at rest who may be concerned about traveling overseas during this period :)

    Thanks for sharing your positive experience.  I am going on a cruise on April 30th.  Do you mind sharing which port you sailed from?  

     

    I have traveled using the letter, but I was less nervous then since it was prior to January 20th

    I did mine via mail and they extended until 2019 (4 years from original issue but with my birthday instead of date of GC expiration).  I sent them the I-751 Extension letter and both sides of my GC (so they can see the alien #'s match and they approved no questions asked. 

  13. I recently traveled overseas, with a layover at a US airport. I showed the following:

    US - US domestic : DL

    US to International: Passport

    International to US: GC and extension letter

    US - US domestic: DL

    I had no issues entering the UK with my passport, and no issues boarding domestic flights with my DL. The only slight issue I had was checking into the UK - US flight as the API couldn't process my expired GC. I had a message explaining that I had to physically check in at the airport so a staff member could review my documentation. The check in assistant had no issue with the expired GC and extension letter, but they had recently upgraded their system so she had a few technical issues. I had no issues when I landed in the US. The immigration agent just read the letter and checked the A-number on the letter and the GC matched.

  14. I came in through same-sex marriage with K1 visa. He may place a supreme court judge who could overturn that. I'm still on AOS. I hope his win doesn't affect us negatively. ?

    I too came in through same-sex marriage but we filed the I-130. I am in the process of removing the conditions on my GC. Here's my concern:

    Trump (and the Republicans in general) oppose same sex marriage nationally, preferring to leave the decisions at the state level. If the decision to nationalize same-sex marriage is reversed, then I am only considered legally married in the states who recognize same-sex marriage. The issue is that the USCIS is federal, and therefore wouldn't recognize my marriage as legal. If I have my full GC at the time this potential change happens then I'm good because I'm a legal resident. What I'm concerned about is if this (again, potentially) comes into effect before the USCIS review my petition to remove conditions. After all I checked the box which says I've been legally married to the same person on the original petition, and because of my legal marriage I request they remove conditions. If the marriage isn't recognized at a federal level then they may have the power to deny my petition on the grounds that I am not legally married and therefore have no claim to residency in the US.

    All we can do is sit back, watch from afar, and hope for the best. Or I guess move back to the UK and start a petition for my husband to come over.

  15. I traveled into the US once after we submitted my I-130. I arrived by air. I was taken into secondary inspection, all the contents of my suitcase were removed and inspected and I was asked many, many questions. They called my husband to validate my responses, then I was permitted to enter but with the advice/warning that I should not attempt to enter the US again until I have my visa/GC. There was a slight issue with me in that I had received a new passport and was travelling into and out of the states with two separate airlines. The first (inbound) airline had my current passport information, but the return flight was still showing my old passport. What this meant to immigration officers was that it looked like I had not booked a return flight, so they figured I was planning to immigrate illegally. I've heard many stories from others, some had no issues, some were questioned. I haven't heard of anyone being denied entry though.

    I don't know about the "comply" part of your question. I assume it just means that you complied with them and answered all their questions without resistance etc, or that your case complies with the immigration laws. I don't think it's anything to worry about.

    On the advice I was given, try to limit your travel to US as much as possible until you have the visa, just to avoid raising suspicion. If you are travelling, have your lawyer and wife's contact information to hand in case the immigration/border control want to validate any responses you give.

  17. I'm travelling back to the UK in November. Who do I show the docs too? I assume I show my British Passport, US Greencard, and I-751 NOA1/extension letter. I'm flying to Newark then connecting to Edinburgh. Should I show at original airport, Newark, or both? or can I use Drivers Licence at originating Airport and Passport/GC/Letter at Newark?
    Also do I also show all 3 on the way back (at Edinburgh airport flight to Newark?)

  18. Just thought I'd chime in on the process in California, as I was stressing about it!!! My DL expires same day as Conditional GC. The CA DMV wrote me asking for proof of residency or citizenship beyond the expiration date. Responded to the letter (which had a return envelope included) with a photocopy of the I-751 NOA1 (both sides). New DL was mailed out approx 6 weeks later and was extended by 3 years (expires on my birthday now, not the GC expiration date).
