  1. so how will the uscis going to resolve this lost I-130? sorry to hear dat.

    well the personnel that i have spoken from the atlanta field office told me that he cant find my case file coz if he found it he will adjudicate it for me coz i went their all the way from alabama. Unfortunately our file is nowhere to be found. Been contacting tier 2 my congressman and senator to check on our case and i was given generic answer each time but the truth is no one is really looking into our papers for 9 months. Anyway he gave me a personal envelope with an attention on his name and ask me to give him a copy of my application. I ask him if he needed all the supporting docs and he said he doesnt need it he just need the copy of our application,marriage certificate,and 2x2 id picture of my wife and i and he made a copy of my passport and noa1. I mailed him all the docs the next day and ive been waiting for two weeks now for any info but havent received anything. So I schedule another info pass this Nov 1. I cant believe that they can adjudicate an application right away but ive heard people here at vj that it can really take up to 20 mins to adjudicate a case.

  3. yes i know,but the problem i cant make this to him coz im here in the philippines so maybe i advise him to get help of his freind to make this appointment to him

    yes he will have to be the one who makes the appointment because they

    will not accept appointmens made from a computer abroad I know because

    my wife tried to schedule one for me and the website wouldn't let her because

    she is in the Philippines. the us citizen has to be the one who makes the appointment.

  5. we are married now and i want to make this to my husband but i dont know where place he can go he is on state im still here in the pilippines

    when he makes the infopass appointment the first step will ask for his zip code and then

    press next and it will tell him where his local office is.

  6. have your fiancé to go to uscis.gov and in the left hand side of the page you

    will scroll down until you see free info pass and then just follow the steps.

    the us citizen will have to be the one who makes the appointment online.

    I was going to let my wife schedule one for me but it wouldn't let her into

    the place where you make info pass because she is not in the states.

  7. I have read dozens of posts on different websites that offer conflicting information on this subject. I am hoping someone can clear this up for me. How long shouod I expect to wait after NOA2 and scheduling the interview at the embassy. I have seen people saying it takes months while others claim thst through diligence this can be done in weeks. which is true? how much control does one have over this process?

    after you get your noa1 which is the form that lets you know that the uscis has received your papers.

    your wait for the noa2 can be 6 to 12 months. Im a Jan 22nd filer 2013 still waiting for our noa2. then

    there is the nvc part they say that it can take anywhere from 2 to 4 months after the noa2.

  8. hello , how long does it take before USCIS gives Aprroval on I-130 US Citizen filling for a Spouse? We filed the case last March 26th, 2013. and we received the First NOA last March 29th, 2013. I looked on USCIS dashboard and our case is still on Initial review sad.png . We filed it in California Service Center.

    Well there is no certain time table for the uscis.

    Our priority date is Jan.22nd and we are still waiting

    for our approval notice which is the NOA2.

Don't you agree that it would be a terrible mistake to assume that it's safely waiting in the NBC, where a loving, caring adjudicator will carefully place the file upon his or her desk, and page through it ever so delicately, being sure not to even bend a single corner on it? They have hundreds of thousands of files, and different types. Not to mention, some adjudicators take files home to adjudicate them. Yep, that's right. The adjudicator takes the file outside of the facility and brings it back when it's complete. Don't you think it's within the realm of possibility that it may have been misfiled somewhere o..r just stuck under the leg of the coffee table to provide stability?

    Simply put, you have too much faith in the system.

    I agree...been receiving different answer each time I call tier 2, been waiting for my senators response and my congressman's and it takes 45 days for the ombudsman to reply for my complaint...for 9 months nothing has been done.worst of all the guy in atlanta when I did my info pass I was on cloud nine when the guy told me to look for my file and review it and went back to tell me that he cant find it declare it as lost and ask me to mail him a copy of our application so he can personally adjudicate it (even provided me his personal envelope) and wait another 2 weeks for his reply but nothing happened. Govt sucks!

  10. i just received a call from the congressman and the woman told me that are files is in atlanta office and if was forwarded to an adjudicator. If this is true then its a good thing but i will not put all my confident on it I will still go to my schedule infopass on nov 1. I was given different answer each time. Im Just hoping that I can talk to the same guy I talk to the last time in Atlanta so I can queeze the truth out of him.

  11. hey i also suffered from the same situation whn my file completed 5 months i contacted my senator congressman and thy found tht my file was transferred from NBC to my local office !!!!

    thy even didn't send me any notice for transfer bt i knew it frm my senator aftr tht we took an info-pass and conformed tht our file is thr aur nt ?? it's thr frm July and still we r waiting for the NOA-2 sad.png(

    i m a FEB filler and last 2 mnths ago we again took aninfo-pass and at tht time the officer who has our case informed us to wait for 1-2 mnths

    in ths end of the mnth we completed their time limit

    let see wht happen

    so its nt compalsory for thm to send a notice of transfer just go to ur local office n mak sure thy hav u r case ...

    Thanks I made an info pass appointment and went there Oct.10th but they said they

    couldn't find my file.

  12. Get on the phone with your congressman right away. Then on top of that, you should contact ombudsman: http://www.dhs.gov/ombudsman-case-assistance

    What a complete mockery they have made of us.

    Thanks I have already done that and got an email back the same day saying if they cant

    help me they will contact me promptly but if they are able to help me it could take up to

    45 days before they contact me.

  13. Is there anyone besides my wife and I still waiting for there I-130 to be approved

    from January. I have been told by my congressmans office that our file was transferred

    to the Atlanta office but I never received a notice from the USCIS saying it had been

    transferred. I went to Atlanta on an infopass and talked to an officer he said he would

    pull my file and told me to have a seat and wait only to come back 20 minutes later to

    say they don't have my file. So does that mean its still at the NBC since I didn't get a notice

    from the uscis saying it has been transferred or did the Atlanta office loose my file?

    I know how you feel I am the U.S. citizen who applied for my wifes I-130

    and our priority date on our NOA 1 is Jan 22nd 2013. I have contacted

    my congressman and my senator and I have even been to the USCIS

    office in Atlanta but nothing I do to try to help my wife be here with me

    seems to be working. Our papers also say initial review and we are getting

    discouraged. I have an appointment to go back to Atlanta Nov. 1st maybe

    I will have some luck then.

  15. I was told right from the start by an immigration lawyer not to

    file a K1 because he knew by the source of my income that I

    would need a co-sponsor and that the Philippines doesn't accept

    a co-sponsor for the K1 because it is an non immigrant visa.

    He told me to get married and file a spouse visa which is the CR1

    That is an immigrant visa which makes them your relative so you

    have the right to petition for them. With a CR1 visa since they are

    your relative by marriage the Philippines will accept a co-sponsor

    for the CR1. That is what I was told by an immigration lawyer so

    that's what I did. We are still waiting on approval.

  16. Is your wife here in the US or still in the Phils.? If she is in the Philippines, then your file should have been processed in Missouri then once approved, they will send it to National Visa Center for visa then from there, they will forward it to the embassy in the Phils. where she will be scheduled for interview. Now if she is here in the states, then they will go to the local field office for processing. Try to call the 800 in your receipt and ask for a Tier 2 officer, don't settle for just the customer service coz' they have all kinds of answer that who knows where it's coming from. You've got to seek help from a lawyer or your congressman if the later was the case. Goodluck...

    she is in the Philippines and I have talked to a tier 2 several times and they are the

    ones who told me it was transferred to Atlanta.

  17. It would help to know where you are and where your husband is at this time.

    You may be able to return to the USA using the tourist visa but if the POE officer has any reason to think you as the wife of a USC are attempting to emigrate you could be denied entry.

    yes if you are already married but for less than 2 years you need to file for a CR1 visa

    and if you have been married for more than 2 years you need to file an IR1 visa which

    will give you an automatic 10 year visa. With the CR1 which you need to file if married

    less than 2 years gives you a 2 year visa and you will have to file 90 days before your

    2 year visa is up to get your 10 year visa.
