    We've already spoken on the other forum. My answer stands. You must file both the I-212 and I-601. . . .Expedited Removal with Misrepresentation charge.

    (i) In general

    Any alien who, by fraud or willfully misrepresenting a material fact, seeks to procure (or has sought to procure or has procured) a visa, other documentation, or admission into the United States or other benefit provided under this chapter is inadmissible.

    How did she misrepresent herself? I assume that she did NOT claim US citizenship?!!??!? Yes, you will need to have the waiver ready for the interview as your wife is not admissable at this point. I am not sure if the HK embassy accepts the waivers at the interview or not but best to have it ready. Processing waivers is always slow. You will have to show EXTREME hardship for the waiver to be accpeted. Waiver information is available in abundance at www.immigrate2us.net

    I'm a USC. My girl friend and I visited US together in late Oct. 2007. She got a removal due to the immigration officer alleged her intention is to remain in US with a B1/2 visitor's Visa. That's a 5 years ban under sections 212 (a)(6)©(i), 212(a)(7)(i)heart.gif. We took the next flight back to HK at our own expense (return ticket). Then, we got married later that year and I filed I-130 for her. Now, the US consulate interview is scheduled for May, 2009. Do I need I-601 or I-212 ready before the interview? I don't want any more delay if the consulate ask for it. It tooks a year and half to get to this point.

  2. $2000? Not likely.....immigration attorneys are interested in one, and only one thing: money. They charge $2000 to fill out an index card. A typical I-601 package will cost $8000-$10,000 (Laura 'Fleece 'em All' Scott)....

    they bill you for 25-30 hours of their time...in reality, they will spend less than 90 minutes on this project....but will sell you some horse manure story about how much time they will spend 'preparing' (i.e. , Xeroxing) the papers....anyway, it's your money...

    At this point in time, i dont know what else to do, im quite desperate.

    Lizz Cannon worked for Laurel Scott. I believe she was a paralegal and went on to law school. She learned from the best. If memory serves me correct, Lizz went to school here in MA. Laurel has more experience if that's important to you.

    yes, her office is in MA and she did work under Laurel Scott. which one would you suggest form the two, liz cannon or laurel scott?

  5. We reached US safely and at the POE they didn't ask any X-Ray reports. All they asked was the sealed envelop given by the consulate.

    It took less than 20 min at the Immigration.

    My wife's x-ray result is not sealed as well. It is a film. No problem at port of entry. Medical test is in Singapore.

    Our daughter's x-ray result is sealed. It is in the compact disc (CD). Medical test is in the Philippines

    Our daughter is positive in the tuberculine test although the x-ray is clear (i think this is due to the environment in the Philippines) thus there is an annotation in her visa. The health officer at the port of entry asked us to contact the health services in our county for further evaluation and we will bring with us the test and x-ray results.

    your clinic should have provided sealed x-ray report. thats the rule. You can get back to the clinic and ask them for sealed x-ray report. they might want to keep it for their records thats why they ask for it at POE. Also your x-ray report should be clear.

    I just received my X-ray yesterday, they said to keep it in my 'CHECKED IN' baggage when travelling to the US, does that seem right?

    How will i be able to present it to the immigration officer if it is not in my 'HAND CARRY BAGGAGE' ?

  6. Upon endorsement by CBP your immigrant visa serves as temporary proof of a green card for up to one year. People will sometimes enter, "activate" their immigrant visa and then turn around and leave the same day or shortly after to tie up loose ends in their home country before re-entering the US again in a few days / weeks.

    I am thinking of doing the same, as i dont want to tie up all loose ends then have issues at the POE. Once approved by the US embassy, is there any chances of the POE causing issues?

  7. At least an hour, I'd think. You'll go through fingerprinting, etc., at your POE

    I had POE in Los Angeles. I arrived 30 minutes before estimated arrival time. Security told me that I should wait on a tourist line so even thoug I had yellow sheet, so I did. I don't really remember how long did I stay in line , but there were many people. Maybe 30-45 minutes I waited. When I got to the officer it went smooth, just some questions, fingerprints, photo and welcome in United States smile.png so I think it should take around 30-45 minutes depending how many planes will arrive the same time as your. I was at around 3pm

  8. To receive the actual card it could take 2 months from the moment beneficiary steps on US soil.

    mars 76..i don't think you can pay the fees at the usconsulate. They will provide you with an information sheet guiding you how to pay the $165 fees online before you enter USA.

    Hi all,

    Is it possible to leave the country and re-enter after POE and before the GC has been issued?

    Does the Visa issued after the Interview guarantee entry into the US as i dont want to wind up from here then find out about some issue at the POE, as i was rejected entry previously.

    please help.
