It took almost a year to get the green card. You can see my timeline below for specifics but we filed in January, got the letter in April, 6 months was up in October and I hadn't heard anything so I filed a service request and we finally got the green card in December. My best advice is to watch your dates and if you pass the 6 month mark from the date you got the waiver letter file a service request. I don't think anyone would have even looked at our case if I hadn't done that! There is a thread specifically for the Waiver Letter over in the AOS forum....most people who get that letter are getting their green cards 9-18 months after they get the letter.

My husband and I have a 13 year difference and they never had a problem with it. The age difference was never addressed in the K1 application process or at the interview. As long as you have evidence of your relationship you shouldn't have a problem!

You can definitely do it yourself! Just fill out your forms, keep yourself organized and sit back and wait......it is definitely NOT a fast process! But the sooner you file the sooner your hubby can work and travel.

Welcome to the forum! It sounds like you have a strong relationship and having lived in the DR you have lots of evidence so your process should be a breeze! There's lots of information on this site and people are always available to help with questions and share their experiences.
My only advice would be to stop paying for a lawyer (I know it's probably too late but seriously, if you can stop)! Many of us on here successfully completed our processes with the help of this site and there are a lots of stories from people on here who've had lawyers mess up applications, lose applications, or drag the process out to make more money.
If you can't get out of it now at least save yourself the money and don't rehire them for the AOS after you get married. You've got all the help you need here and it's free!

You may actually get it in time! We got our notification on the 9th and then on the 15th we got the notice saying it had been mailed and we had it in hand on the 16th. I couldn't believe that it was delivered that fast!

If your case is approved/card is under production you'll see the status at the top change (the heading in blue). The old case status checker was much more intuitive in this regard. It showed a full timeline from acceptance to approval/denial, with where you were currently at highlighted in a different blue.
I'm attaching a pic of what it looks like when it is in production in the new system. I will say this, the update to the website is nice on this page in that it allows you to see all of the recent updates to your case on the left hand side.

In your case you should be ok to call without him because you are petitioning him. I think that you may still be within normal processing times though because you are an 1-130, I think that those are taking anywhere from 12-24 months to process. We were a K1 so when K1's adjust the beneficiary is the one who actually does the paperwork for themselves and the USC isn't technically involved in the process other than to prove that they married you.
Call, the worst that can happen is they tell you no, you can't file a service request!

I am trying to send an e-request but when i want to submit this message is coming Your application or petition is currently within the posted processing times. An inquiry may not be created at this time. What does it mean? what should i do? please help me out!
I would try calling to file the service request, there have been lots of issues since they "updated" the website. Be prepared to wait, I waited I think at least 30 minutes to get through and others have waited over 2 hours. And if you are not the beneficiary then make sure you are both available to call in because they won't give the petitioner information about the case without the beneficiary's approval. We called as a 3 way call.

Thank you! Yes, the first letter we got after filing the service request said that our case would be transferred to the Houston (our local office) for processing. Then last week we got a second letter saying that our case had arrived at the Sacramento office and would be processed there.

We finally got our text this morning! Our process took a little under 11 months total. So happy to be done with this FINALLY!
If there's anyone left in this thread still waiting hang in there, it seems like they are finally moving along the last of us!

FINALLY!!! HALLELUJAH! Got the text message my hubby's card is FINALLY in production. For those of you waiting just hang in there, our process took 11 months from the time of filing! And don't be afraid to put in a service request if you go over the 6 months from your waiver letter.

We had the same issue and had to pay for another full medical exam. We were not able to find anyone who would just do the vaccines.

The office where my packet was sent is across the country from where we live so I'm 99.9% sure we're not getting called for an interview. I saw somewhere on the VJ site the other day that sometimes NVC sends AOS packets to California to finish their processing but I of course can't remember where I saw it on here and can't find it now!

But I thought the whole idea of the NPIW cases was that they stayed at the National Benefits Center to alleviate the pressure on the local offices? Do you think this is some sort of overflow due to the backlog of cases or because your case was outside of processing times?
I'm not sure what the problem is but when I look at the processing times for most of the local offices they are much shorter than what it's taking people who stay at NVC. Maybe they are preparing for an influx of documents due to the new immigration reform? Who knows.

No, it just means that out packet is finally on someone's desk in the Sacremento office and will be looked at! Most people who get the letter don't have to interview, which is a blessing but the curse is the wait.

Just wanted to say hang in there, we just got some movement on our case! Got a letter in the mail today dated November 20th stating that our case has arrived in the Sacremento office for processing and if we haven't heard from them in 60 days to follow up.
I'm assuming since Houston to Sacremento is not a reasonable expectation for someone to go for an interview that we will see the "card in production" message soon!

We have movement! We got another letter dated November 20th that says that our case has arrived at the Sacremento office (not sure what happened to transferring it to Houston) and that if we haven't heard anything from them in 60 days to follow up.
I can tell you right now we're not traveling from Houston to Sacremento for a darn interview so I'm hoping to see that little "card in production" message soon!

I'm with you guys! A fellow January filer still waiting as well. You're not alone! We got the EAD/AP in March, the letter in April, I filed a service request last month and the last thing we got was a letter saying that our case would be sent to the local office for processing. That letter was the last week of October and nothing has happened since. It's so frustrating!

there's an entire thread dedicated to the Potential Interview Waiver case if you'd like to join us over there! We filed in January, got our waiver letter in April and we're still waiting. Well over 6 months after the letter was received. But it does seem like the majority of people who get the letter get their approval near the 6 month mark.

I have seen other threads on here talking about the medical only being valid for 1 year. I guess at this point I should be thankful that the stupid civil surgeons here made my husband do another exam in the states before they would give him his vaccines....his original medical was November of 2013 so we would have been screwed. We at least have until January now.
Ridiculous that their lack of staffing and lack of urgency is going to cost us more money. Again.

Because the Dominican is a high fraud country she will have a very hard time getting a tourist visa if she can't prove ties that she will return back to the country. I've heard stories from my husband's friends and family and they've said you must have property, a job, bank accounts, etc. and even then it's very difficult to get approved.
All you can do is try!

Well it seems USCIS has free time for unimportant things like updating their website to make it more "user friendly". Which is useless if you never update people's cases! Grrrrrr.
It's like you almost want to have a red flag on your case so they would do the interview instead of waiving you.

Age is not a huge issue. My husband and I have a 13 year age difference and they approved us with no concerns. It sounds like you have lots of evidence for face to face meeting and an ongoing relationship so that will definitely help you!
As for his child, I don't think that will be an issue either. Friends of ours were approved the same day as we were and they included his 2 year old son in their petition and the baby had a similar timeline to yours. From what I've read from others on this site the divorce while you were in a relationship with him may be a red flag but I can't comment on that personally. Hopefully others will be able to give you some advice.
